Cooper and after being duly sworn says on oath that on or about the latter part of February eighteen hundred and twelve he came to this country and settled where he now resides and found a certain tract of land now owned by purchase of Uriah Smith, then settled, and disposed and owned by John Wright, said tract of land lying and being situate on the East side of Bogue Chitto River, bounded East by lands of John Chapman's claim, West by lands of Mahlow Holden, North by public lands, South by Bogue Chitto River. Before me appeared this day, James Tate, residing in Marion Co., Miss and after being duly sworn deposes and says, that a certain rifle gun, now in pofefion (possession) of Thomas Holden is his own right and property, and that he has not give, swaped, nor sold the said gun to any person whatsoever. Sworn and subscribed to before, at my office this 29th day of September, A. D. 1846 E. W. Moore, J. P. 1st Ward. Before me this day came and appeared in his proper person, Thomas W., A. J. Tate, residing in Marion County, State of Mississippi, who being by duly sworn, deposes that a certain rifle gun belonging to James Tate, his father, is the pofefion of Thomas Holden, now residing in St. Tammany Parish, State of La., that he knows said gun the stock and bullet molds, the said stock being a plain maple stock, made by one Nelson Delaughter, near his residence, and that he knows said bullet molds by their thisn (?), being made by said James Tate's store in the shop at home, and re the said Thomas W. A. J. Tate further says that he has been to the house of Thomas Holden and saw the said rifle gun and knows it to be the rifle gun that said James Tate ownsd, and that he the said James Tate has not to the best of his knowledge, give swaped nor sold said gun to any person whatever. Morris Justice Court 1st Ward Parish St. Tammany State of Louisiana Claim of this suit was an account for monies loaned. Citation issued the 12th day of October, A. D. 1846 served the 13th day of the same month and year. October 24 - being the day for trying this case - appeared James Erwin the husband of Susannah Erwin and give me to understand that they had come to a compromise and wished the suit dismifed and he paid said costs. October the 24th A. D. 1846 E. W. Moore J. P. 1st Ward. No. 2 - George Th. Gilbert vs. A. L. Carpenter Note of hand 22nd Febry 1845 for Fifty dollars with eight pcent interest till paid from date. Citation Waived Service Accepted. No. 3 - E. W. Seals vs Lewis Singletary This is an action founded on account for sheep furnished for forty dollars. Citation ifued December 12, 1846 and returned served 27th day of the same month. Witnesses examined in this case, John Kellar and W. W. Seals on the part of the Plaintiff and W. L. Crawford on the part of the defendant. Judgment No. 2 - Thursday 29 October, A. D. 1846. The Pltff & Defendant appeared in person in Court when the defendant confefed judgement, wherefore it is ordered that Geo Th. Gilbert recover of A. L. Carpenter the sum of fifty dollars with eight pCent interest from 22nd February, 1845 until paid and cost of suit. E. W. Moore J. P. 1st Ward Judgement No. 3 - January 9, 1847 Defendant appeared in person and for answer please a general denial This cause was to be consent of parties set for tryal on Friday the 15th day of January at 10 o'clock A. M. Friday January, A. D. 1847 10 clk A. M. Both parties appeared and exprefed themselves ready for trial and the same was proceeded in. After hearing the evidence the law, the court is of opinion that both the law and evidence and in favor of the plaintiff and that he has made out his case. It is therefore ordered, ajudged and decreed that by the Court that the Plaintiff recover of the defendant the sum of twenty five dollars and 30/100 with interest and costs of suit - January 13th 1847 E. W. Moore J. P. 1st Ward Parish of St. Tammany. Thomas J. Page as No. 4 vs Carpenter and LaCroix This is an account formed on an account for labor performed for seventeen dollars and twentyfive cents. Citation issued 23rd day of March, A. D. 1849, returned the 31st day of the same month. April 12th A. D. 1829 (?) Defendant appeared in person in Court and for answer pled a general denial. This cause by consent of parties was set for trial on Saturday the 24th day of April, A. D. 1847 and upon defendant failing to have the said monies to render to plaintiff on that day, judgement is to go against defendant by agreement of plaintiff and defendant. April 24th A. D. 1849 appeared in person and after waiting the usual time _______ Plaintiff _______ for defendant proceeded to hear the plaintiff It is therefore ordered, adjudged and decreed, by the court that the plaintiff recover of the defendant seventeen dollars and 25/100 with interest and costs of suit April 24th, 1849. E. W. Moore J. P. 1st Ward Lumpdon and Dennrite vs A. L. Carpenter This is an action founded on a due bill for 24 dollars with a credit of five dollars - Citation issued the 12th day of July A. D. 1849 returned served on the 13th day of the same month. July 24th A. D. 1847 This cause having been assigned for trial today ay 10 o'clock A. M. and after waiting two hours and the plaintiff failed to appear, therefore it is adjudged and decreed that the plaintiff pay costs of suit. July 24th 1847 E. W. Moore J. P. Simpson and Dennsite vs A. L. Carpenter This is action founded on a due bill for twenty four dollars with a cret of five dollars. Citation waived Service accepted. Tuesday the 21st of September A. D. 1847 the defendant appeared in person in Court, When the defendant confefed judgment. It is therefore ordered and adjudged and decreed that the plaintiff recover of the defendant the sum of nineteen dollars with interest and cost of suit. This 21st day of September A. D. 1847 E. W. Moore J. P. 1st ward No. 7 Peter Kuntz vs. Charles Bosse This is an action founded on account for labor performed and money loaned and for rent for farm. Citation issued the 12th day of April 1848, served the 21st day of April, A. D. 1848 No. 8 The State of Louisiana vs. Thos. Holden No. 9 W. Wm. Cooper vs. John Pearson & wife - This is an action founded on an account for board and maintenance for thirty one dollars and fifty cents. Citation issued the 19th day of June 1848, returned served the 30th day of the same month. July 10th A. D. 1848 10 oclk A. M. both parties appeared and exprefed themselves ready for trial and the same was proceeded in, after hearing the evidence and the law, the court is of the opinion that both in law and the evidence are in favor of the plaintiff and that he has made out his case. It is therefore ordered, adjudged and decreed by the Court that the plaintiff recover of the defendant the sum of thirty one dollars and fifty cents with interest and costs of suit. July 10th A. D. 1848. E. W. Moore J. P. 1st Ward. Parish of St. Tammany, La. No. 10 Samuel Starnin vs. William Guck - This is an action founded on an account for money loaned and labor performed. Citation issued 2nd day of August, 1848 served 3rd day of the same month, 1848 August 12th, 1848 defendant appeared in person and for anser ishuded a general denial - & amicable demand August the 12th, A. D. 1848 this cause by concent of parties - said parties being present and exprefsing themselves for trial and the same was proceeded in after hearing and the law. The court is of the opinion that both the law and evidence are in favor of the plaintiff and that he has made out his case. it is therefore ordered adjudged and decreed by the Court that the plaintiff recover of the defendant the sum of sixty six dollars with interest and costs of suit this August 14th, 1848. E. W. Moore J. P. 1st Ward, Parish of St. Tammany, La. No. 11 St. Tammany Parish vs. Estray Sorrell Horse. G. J. Singletary & John Galley sworn to appraise horse horse appraised to twentyfive dollars. Citation issued to the Editor the 10th day of November A. D. 1848 November 15th D. T. Skinner came forward and claimed the Estray and proved the same to be his by the oath of Mr. Harrington of Washington Parish and prayed for an order to be issued to Mr. Letchworth to deliver the horse to Isaac Evans J. P. to be sold to pay the cost and charges which was granted. This 15 day of Nov. 1848 E. W. Moore J. P. 1st Ward Parish of St. Tamy No. 12 The State of Louisiana vs. John G. Sibley Claim - Threat and Abuse Jesse W. Thompson vs No. 13 J. W. Earnest & wife. This action is founded on an account for medical services rendered. Citation issued 19th day of March, 1849 returned served the 29th of the same month. April 7, 1849 defendents produced a receipt from under the hand of J. W. Thompson, defendant for the full payment of all demands up to this date, therefore it is ordered adjudged and decreed that J. W. Thompson defendant, pay all costs in the above entitled suit. This 11th day of April, A. D. 1849. E. W. Moore J. P. 1st Ward of St. Tamy State of louisiana vs No. 14 Aaron S. Foster This is an action founded on an oath of John Edis Smith agaist A. S. Foster for committing assault and battery on the body of Sara J. Edis Smith. Warrant issued the 20th day of March A. D. 1849 to arrest the body of A. S. Foster, returned same the ____ day of April, 1849. Shadrack Collins vs No. 15 E. W. Seals This is an action founded on an account for monies ________ and work done and performed. Citation issued the 6th day of September 1849 and returned service the 22nd day of the same month. Monday the 1st day of October, 1849 this cause having been assigned for trial today, defendant appeared in person and for answer please a general denial. Monday the 1st day of October, 1849 both parties appeared in court and appeared in person and expressed themselves ready for trial and the same was proceeded in after hearing the law and evidence and the court is of opinion that both the law and evidence are in favor of the plaintiff and that he has made out his case. Moore vs No. 17 William Collins This is an action founded on a note of hand services Citation waived Saturday the 31st day of March, 1850 the plaintiff and defendant appeared in court personally when the defendant confessed whereupon it is therefore ordered adjudged and decreed by the court that E. W. Moore receive of William Collins the sum of one hundred dollars with interest and costs of suit. March 31, 1850 W. H. Blroswell Vs. No. 1 J. R. Cooper This is an action founded on an account for groceries. Citation issued the 22nd day of January, 1852 returned servede the 26th day of the same month. W. H. Blroswell vs. No. 1 J. R. Cooper This suit was 1st instituted upon an open account for the amount of thirty five dollars and 10/100 citation issued 22nd of January, 1852 return of sheriff service on the 26th of January, 1852, this being the day for a hearing being the 21st day of February, 1852, the defendant J. R. Cooper appeared and objected to try the case, being of kin or allied to the undersigned justice. The objection was sustained and in conformity to Article 1072, the Code of Practice, the cause is transferred to Ethan Colton, J/ P/ 6th Ward, at Covington, being nearest justice of the peace to the residence of the defendant, J. Morris vs No. 20 Richard Jenkins This is an action founded on an account for three head of cattle for $36.00 Citation issued the 30th day of June, 1853, returned 7th day of July, 1853 Witness Thos Morris, Eliza J. July 16th, 1853 both parties appeared in court and exprefed themselves ready for trial and the same was proceeded in after hearing the law and evidence in favor of the plaintiff and that she had made out her case. Edis Smith vs Jared R. Cooper and family This is an action founded on cash account for merchandise for thirteen dollars and 18 cents. Citation issued ____ of July and served same day Witness on part of plaintiff George Brown Saturday August 11, 1855. This case having been set for trial today Plaintiff and defendant having both appeared in person and did _____ themselves ready for trial and for answer defendant pleads compensation for the use of an ox yoke and the trial was proceeded with and after hearing the law and evidence are in favor of the plaintiff, it is therefore ordered, adjudged and decreed that the plaintiff recover of the defendant the sum of $11.18 and costs of court. Martin vs T. Moore This is an action founded on a note of hand, 18 of June, 1853 for twenty four dollars fifty cents Citation issued 1st day of March, 1856 returned served 3rd day of same month. This case having bin set for tril today at 10 o'clock a. m. and after wayting two hours and the partys failing to appear therefore it is adjudged and decreed that the defendant pay the sum of $24.25 cts with interest and cost of suit. P. 1st Ward Saturday the 10th, 1856 this case having bin set for trial today the parties having both appeared in person and declared themselves ready for trial and the same was proceeded in after having the law and evidence are in favor of the plaintiff. P. 1st ward William Parker versus no 25 John Smith This is an action filed on a claim of land in Honey island filed January 31st, 1867 Citation issued January 31, served and returned February 9th January 31, 1867, this case having bin set for trial february 9th, 1867 defendant and plaintiff appeared in person and for answer the defendant prays for the trial to be continued on the grounds that his witness was not present and wished them to be summoned. The case was continued til February 23rd, 1867. The parties appeared in person and the case eas proceeded with and after hearing the testimony of both plantif and defendant and the law being in favour of the plantif it is therefore ordered and adjudged by the court that plantif Wm. M. W. Talley J. Peace 1st Ward S. J. Leslie vs No. 30 Samuel P. Sartin This is an action founded on a note of hand for twenty two dollars with interest a eight percent from date until paid. Received the citation with a copy of the same April 15th Served and returned on the same day. This case was now taken up pursuant to assignment. Plaintiff appeared in person and defendant represented by L. L. Thomas curator ad hoc when the case was proceed and after hearing the evidence and the law the same was submitted whereupon the court rendered the following judgment, the law and evidence being in favor of the plaintiff Silas J. Leslie it is therefore ordered adjudged and decreed that Silas J. Leslie recover of the defendant Samuel P. Sartin the sum of twenty two dollars & fifty cents with eight per cent per annum interest from the 10th March 1868 until paid cost of suit. It is further order, adjudged and decreed that the land herein attached be sold according to law and that plaintiff be paid amount of his judgment interest and costs and 10.00 as curator ad hoc fee out of the proceeds of the sale of said property to _________ of his attachment M.
