NELLIE JOHNSON, the duly qualified natural tutrix to the minors,CLARENCE BICKFORD, AULTON BICKFORD, BESSIE BICKFORD AND LUCILLE BICKFORD, with respect shows: 1.That the said minors together with your petitioner and ALONZO BICKFORD AND VERDO BICKFORD, majors, are the owner in common of the following described property, to-wit: All that certain lot or parcel of land situated in the Parish of Tangipahoa, State of Louisiana and described as follows: Twenty-five and one-half (251/2) acres of land lying and being in the North East Corner of the North East Quarter of the North East Quarter of Section 32, and bounded as follows, on the North by section line, on the East by section line, on the South by land by TOM M. JOHNSON and on the West by land owned by JAMES HARPER. 2. That the said persons are unwilling to remain any longer in indivision, and desire to affect a partition. 3. That the said property is not divisible in kind, and a sale thereof is necessary to effect said partition. 4. That. A.J. TAYLOR has offered to purchase the above described property for the price and sum of Five Hundred Dollars, which amount is the appraised value of said property. 5. The acceptance of said offer would be advantageous to said minors. 3. That said offer can not be accepted, except by the advice of a family meeting. Wherefore petitioner prays that a family meeting in behalf of the above named minors be convened to deliberate upon the subject matter of this petition, and advise whether it is to the interest of said minors that the said property be sold at private sale for the purpose of effecting a partition; and to appraise said property and fix the terms of said sale, and determine whether the offer made by the said TAYLOR should be accepted, said family meeting to be composed of the following named persons, EUGENE PETTITTE, ED BICKFORD, GEORGE BICKFORD, M. FARELL and DR. C. GOULD HOUSE, all relatives and friends residing within the circle prescribed by law; and that ALONZO BICKFORD, under tutor of minors be notified to attend family meeting. NELLIE JOHNSON, as principal and H.G. HUNGATE as surety, of the State of Louisiana, are held firmly bound unto the Clerk of the Twenty-fifth Judicial District Court of Louisiana, or his successors in office, in the sum of One Hundred Sixty (160.00) Dollars, current money of the United States of America, which we promise to pay to him or his successors in office, for the faithful performance of which we bind ourselves, and each of us, our heirs and assigns, executors and administrators, jointly and severally, firmly by these presents, renouncing all benefit of division or discussion whatever. The condition of the above obligation is such, that if the above bounden principal, MRS. NELLIE JOHNSON, natural tutrix to the minor children, CLARENCE BICKFORD, AULTON BICKFORD, BESSIE BICKFORD, AND LUCILLE BICKFORD, do well and truly administer the property of the said minors, and further make a just and accurate accountings and doings in such capacity, and the same to be examined by the Clerk of the Twenty-fifth Judicial District Court of Louisiana or any other persons entitled thereto by law, and also delivers up to and pays to such persons respectively, as are entitled to the same, all the goods and chattels, rights and credits which may remain in her hands belonging to the said minors, when he administration shall expire, then this obligation shall be void, otherwise to remain in full force and virtue. HUNGATE Surety (3rd page) To the Honorable Twenty-fifth Judicial District Court of Louisiana in and for the Parish of Tangipahoa: The Petition of MRS. NELLIE JOHNSON, widow by first marriage of HENRY BICKFORD, now wife of WALKER JOHNSON, with respect shows: 1.That pursuant to an order of this Honorable Court an inventory and appraisement has been made belonging to the estate of HENRY BICKFORD, deceased by N.B. TYCER, Notary Public duly commissioned and qualified in and for the Parish of Tangipahoa, State of Louisiana. 2.That as will appear by reference to the said inventory the real estate belonging to the said estate amounts to the sum and amount of Five Hundred (500) Dollars, and that there was no personal property belonging to the said estate. 3. That said inventory and appraisement should be approved and homologated, and your petitioner be allowed to qualify as natural tutrix to the said minor children. Wherefore your petitioner prays that said inventory be approved and homologated and petitioner be allowed to qualify as natural tutrix to her minor children, AULTON BICKFORD, CLARENCE BICKFORD, BESSIE BICKFORD, AND LUCILLE BICKFORD, and that letters as such issue to her, after the requisites of law have been compiled with. And for all further orders and for general relief in the premises. By her attorneys, ROWND, HUNGATE, AND TYCER ORDER The foregoing petition and the law considered, it is ordered that the inventory and appraisement referred to in the petition be approved and homologated; and that accordingly petitioner, MRS. NELLIE JOHNSON, be allowed to qualify as natural tutrix to her minor children in said petition and let letters of tutrixship issue to her after the requisites of law have been compiled with. And let L.V. SETTOON be and he is hereby appointed under tutor to the said minor children and let letters as such issue to him upon his having taken the oath prescribed by law. And considering the fact that petitioner desires to qualify as natural tutrix to said minors by giving bond in lieu of having the abstract of inventory recorded, it is further ordered that petitioner, MRS. NELLIE JOHNSON, be and she is hereby allowed to qualify as natural tutrix of said minors by taking the oath required by law, and giving bond with good and solvent surety, conditioned as the law directs, in the sum of one hundred sixty (160) dollars. NELLIE JOHNSON, widow by first marriage of HENRY BICKFORD, deceased, now wife of WALKER JOHNSON, with respect shows: 1.That prior to the year of 1906 your petitioner was married to HENRY BICKFORD, and that since said marriage your petitioner has been a resident of your said Parish of Tangipohoa. 2.That on the 12-day of August 1915 the said HENRY BICKFORD departed this life intestate in the Parish of Tangipahoa. 3. That the said HENRY BICKFORD left surviving him, besides your petitioner, his widow in the community, the following named children, to wit: ALONZO BICKFORD, aged 24 years, VERDO BICKFORD, aged 21 years, CLARENCE BICKFORD, aged 18 years, AULTON BICKFORD, aged 16 years, BESSIE BICKFORD, age 13 years LUCILLE BICKFORD, 9 years 4.That said HENRY BICKFORD left an estate consisting of real estate situated in the Parish of Tangipahoa, State of Louisiana. 5. That inventories of all property left by the said HENRY BICKFORD should be made in the manner prescribed by law. 4. That in due time, and after complying with the requisites of the law, your petitioner should be permitted to qualify as natural tutrix to her said minor children. Wherefore your petitioner prays that it may please the court to order inventories made of all property belonging to this estate; and that after due time, petitioner be permitted to quality as natural tutrix to the minor children. NELLIE BICKFORD, now wife of WALKER JOHNSON, and the children named in the foregoing petition, who are the sole and only heirs. Sworn to and subscribed before me on the 14th day of November 1923.
