W. Hart to John H. Robertson, #278 State of Louisiana Parish of Washington Be it remembered that on this twentieth day of August in the year of our Lord one thousand Eight hundred and Thirty Eight and in the year of the Independence of the United States of America the Sixty third. Before me Peter BANKSTON Notary Public in and for the said Parish duly commissioned and Sworn personally came and appeared Augustus W. Hart of this Parish who did declare and Say that for the consideration herein after expressed he does by these presents grant bargain sell convey transfer assign and set over with a full guarantee against all troubles debts claims mortgages evictions donations Alienations or other incumbrances whatsoever unto John H. ROBERTSON of the Parish of Point Coupee and State aforesaid him present accepting and purchasing for himself his heirs and assigns and acknowledging delivery and possession thereof a certain tract or parcel of land the same being one third part of the undivided Section Containing Six hundred and forty acres lying and being in the state and Parish of Washington. Situate on the River Tangipahoa bounded as follows on the North by land belonging to the Estate of Vincent PRICE on the East by government land and on the West by Said river Tangipahoa together with one third part of all the immoveable improvements ways and advantages thereon or in any manner appertaining to have and to hold the said property unto the Said purchaser his heirs and assigns to their own proper use and behoof forever. And the said vendor for himself his heirs and assigns shall and will warrant and forever defend against the lawful claims of all persons whomsoever by these presents and the vendor moreover subrogating the said purchaser to all the rights and actions of warranty which he has ______ him against his own Vendor by the Vendor of his vendor hereby authorizing the said purchaser to exercise the Said rights and actions in the same manner as he might or could have done. This sale is made for and in consideration of the sum of Seven hundred and forty six dollars and sixty six cents paid as follows as it is well understood that the foresaid section of land was on the 20th day of December 1836 Sold as part of the Succession of the late Mathew ROBERTSON, dec. and that David ROBERTSON, John H. ROBERTSON, and the aforesaid Augustus W. HART became the purchasers at the price of Two thousand two hundred and forty Dollars for which Sum of 2240 dollars they gave their promissory notes jointly payable in two and three years after date which land a mortgage was given to secure the payment of said sum and is now sole subject to said Mortgage the above sum of Seven hundred and forty Six 66/100 dollars being an third part of said Sum given for Said section. The said purchaser John H. ROBERTSON hereby agrees and binds himself to release the Said Augustus W. HART from the payment of any part of Said notes now held by the administrator of the Said Estate. Then to these presence personally came and intervening Mrs. Alpha ROBERTSON wife of the said Augustus W. HART duly authorized and assisted by her said husband to the full extent and validity hereof did declare that she was aware that She had a legal Mortgage herein Sold as well as on all other property of her Said husband for the distribution of her dotal affects whether brought in marriage or subsequently acquired either by Donation or Succession and absenated by her said husband and had the administration or enjoyment and alienation the Same for debts which she has contracted and to which She has made herself liable jointly with her Said husband and for nuptial presents but wishing to give the purchaser a perfect title to the property herein sold She hereby declares that She Voluntarily relinquishes to him as the right title claim lien privilege or mortgage which she has on or to Said property owing from any cause whatsoever the vendor having failed to produce the Certificate of the recorder of mortgages for this Parish the said Vendor dispenses with the Same, binding himself to hold him Said Notary harmless for the nonproduction for all legalities the said certificate. This done and passed before me day month and year first above written. In presence of Benjamin BRADSHAW and Ceborn R.
