Hyde and Wife to John B. Davidson, #233 State of Louisiana, Parish of Washington: Be it Known and remembered that on this the Eleventh day of October in the year of our Lord one thousand eight hundred and Fifty Eight Before me Eldridge ROBERTSON GUNN a Notary Public in and for the Parish of Washington duly commissioned and Sworn and in the Presence of the witnesses hereinafter named and under signed personally came and appeared Samuel Hyde who did declare and say that for and in the consideration of the sum of one thousand dollars payable in the following manner to wit: one note for Five hundred dollars due Twelve months from the date here of and one other note due twenty four months from date both notes drawing Eight per cent interest from date until paid - he has given granted bargained and sold and by these presents does give grant bargain and sell unto John B. DAVIDSON also of said Parish of Washington his heirs and assigns the following described tract of land to wit: all that tract of land lying East of the West prong of Big Creek Known as the Wiley ROBERTSON tract containing Six hundred forty acres more or less bounded on the North by the Benjamin BRADSHAW tract of land West by Peter BANKSTON and Samuel HYDE South by Samuel HYDE East Public Lands also one other tract adjoining the same on the North, on the West by the West prong of Big Creek, on the South by the ADDISON tract of land and on the East by Soloman STRICKLAND containing about one hundred and fifty acres more or less. To have and to hold the said tracts of land and Bargained premises together with all the improvements thereon or thereunto belonging or in any wise appertaining to the only proper use and benefit of him the said John B. Davidson his heirs and assigns forever and the said Samuel Hyde for himself his heirs Executors etc. the before tracts of land and bargained premises will unto the Said John B. Davidson his heirs and assigns warrant and forever defend against himself the said Samuel Hyde and all and every person or persons whomsoever. The parties being present and accepting the same and furthermore agree to wive the exibition of the certificate of the Recorder of Mortgages of said Parish of Washington as required by Article 3328 of the civil code of the State of Louisiane and exonorate me Notary from all responsibility in the premises. And now personally came and appeared Mistress Elizabeth BOND wife of the said Samuel HYDE who after the undersigned Notary had explained to her the nature and purpose of the foregoing transfer from her said husband to the said John B. Davidson declared that she was desirous of Renouncing and relinquishing in favor of the said Davidson the tract of land herein before sold from the Matrimonial dotal paraphernal and other rights and from all claims privileges and mortgage to which she may be entitled whether by virtue of her marriage with her said husband or otherwise. Whereupon the undersigned Notary did explain to the Said Mrs. Hyde verbally and out of the presence of her said husband the nature of her rights which are here detailed to wit: the wife has a legal mortgage of the property of her Said husband in the following cases. For the restitution of her dowery and for the reinvestments of the dotal property sold by her said husband and which she brought in marriage and for the dotal property which came to her after the marriage either by succession or donation and that by renouncing said rights on the land herein sold she would deprive herself irrevocably and forever of all recourses thereon and the said Mrs. Hyde nevertheless persisted in her intention of Renouncing the same in favor of the said John B. Davidson. The parties further agreed that a special Mortgage shall be retained on the before described tract of Land to secure the full and final payment of the Same. Thus done and passed in the Parish of Washington aforesaid in presence of Isaac HYDE and Jesse HYDE competent witnesses who hereunto sign with and in presence of the parties and me said Notary.
