Bradshaw, #256 The State of Louisiana Parish of Washington Be it known and remembered that on this twentieth day of August in the year of our Lord One Thousand Eight hundred and Thirty Eight and of the Independence of the United States of America the Sixty third. Before me Peter BANKSTON Notary Public in and for said Parish duly commissioned and Sworn Personally came and appeared John H. ROBERTSON of the Parish of Point Coupee and State aforesaid who did declare and Say that for the consideration hereinafter expressed he does by these presents grant bargain sell convey transfer assign and set over with a full guarantee against all trouble debts mortgages Claimed evictions donations alienations or other encumbrances Whatsoever unto Benjamin BRADSHAW of this here present accepting and purchasing for himself his heirs and assigns and acknowledging possession and delivery thereof a certain tract or parcel of Land the same being one Sixth part of the undivided Six hundred and forty acre tract lying in the Parish aforesaid on the River Tangipahoa and Known as the Mathew ROBERTSON's headright and was on the 20th of Dec (1836) Sold at probate Sale at the price of two thousand two hundred and forty dollars on one two and three years' credit together with one sixth part of all the immoveable improvements ways and advantages in any wise appertaining to have and to hold the said land unto the Said purchaser his heirs and assigns to their proper use and behoof forever. and the Said Vendor for himself his heirs and assigns Shall and will warrant and forever defend against the lawful claims of all persons whomsoever and by these presents and the said Vendor moreover subrogating the said purchaser to all the rights and actions of warranty authorizing the said purchaser to exercise the said rights and actions in the same manner as he might or could have done it is expressedly understood that the same named section of Land was Sold as above stated for the sum of Two thousand Two hundred and forty Dollars and the said notes now in the hands of Samuel HYDE administrator of the Estate of the said Mathew Robertson Dec. This sale is made and in consideration of the sum of three hundred and seventy three 1/3 dollars to paid in manner following as the said John H. Robertson is bound in said notes to said administrator for the above sum of Two thousand Two hundred and forty Dollars the said Benjamin Bradshaw hereby agrees and binds himself to pay the above administrator the sum of thirty three one third dollars three hundred and seventh three 33 1/3 dollars together with the interest if any is due thus relieving the said John H. Robertson from the payment of that amount and it is also understood that a mortgage was given on said land at the time of said succession to secure the payment of the sum of 224 dollars it is therefore understood that this Sale is made subject to said Mortgage the Vendor having hereby agreed to purchase the Certificate of the Mortgages for this Parish and Vendor ______ binding himself to hold said Notary harmless for the nonpayment of said Certificate. Thus done and passed before me in the Parish of Washington, day month and year first above written in the presence of Augustus W. Hart and Ceburn R.
