Bankston to Tobias Smith State of Louisiana Parish of Washington: Be it remembered that on this Twenty fifth day of March in the year of our Lord one thousand eight hundred and Twenty Nine Before me Thomas C. WARNER Parish Judge and Exofficio Notary Public duly commissioned sworn and for the parish aforesaid Personally came and appeared William ROBERSON and Spencer M. BANKSTON of said parish and State does declare that they have this day bargained granted sold and delivered unto Tobias SMITH of said State and parish being also present accepting this sale all that Plantation or tract of Land containing six hundred and twenty five acres lying in said parish on the East prong of Big Creek waters of Tangipaho River Bounded on the lower or Southwest side on land claimed by William B LEGON on all others by Vacant lands and said Land as aforesaid together with all the improvements thereon consisting of a saw mill gin grist Mill and cotton gin dwelling House and whereon said Tobias SMITH now resides that is to say the said ROBERTSON and BANKSTON dost grant bargain sell and make over said land Mill gin and all the Rights and appertenances thereto and thereunto belonging unto the said use benefit and behoof forever and the said William ROBERTSON and Spencer M BANKSTON doth hereby enjoy to warrant and defend the right and Title of the aforesaid described premises from themselves their Heirs and assigns and from every person and persons whomsoever Lawfully claiming or to claim the same or any part thereof unto the said Tobias SMITH his Heirs executors administrators and assigns for ever. This sale is made for and in consideration of the sum of twelve hundred and thirty dollars Two hundred and Five dollars of the same the said ROBERTSON and BANKSTON acknowledge to have received the balance the said Tobais SMITH has furnished his separate promissory notes bearing even date with this instrument -- one for the sum of four hundred and Twenty five dollars payable on the first day of February in the year Eighteen hundred and thirty the other for six hundred dollars payable on the first day of February in the year Eighteen hundred and thirty one and the said parties being present as aforesaid doth hereby Stipulate and agree that the Said described premises do Stand mortgaged and hypothicated to the Said Robertson and Bankston their heirs and assigns for the payment of said notes to the amount of one thousand and twenty five dollars as aforesaid and the said Tobias Smith for himself his heirs and assigns doth hereby engage and bind himself his heirs etc. not to sell dispose alienate or encumber the Title of said premises to the prejudice of this mortgage and sale -- In testimony whereof -- the said parties doth hereunto Severally Sign their names in presence of Thomas C.
