Sibley to Peter Bankston, #279 State of Louisiana Parish of Washington Be it known and remembered that on this the Twenty second day of December in the year of our Lord one thousand Eight hundred and thirty Eight and of the Independence of the United States of America the sixty third Before me Benjamin Richardson Parish Judge and Exofficio Notary Public duly authorized to exercise the duties therein as such Personally came and appared William L. SIBLEY and Cyrena ROBERTSON of this Parish wife of the said William L. Sibley the said Cyrena acting of her own free and accord yet duly authorized and assisted by her said husband. They did declare and say that for and in consideration hereinafter expressed they do by these presence grant, bargain sell convey transfer assign and set over with a full guarantee against all troubles debts mortgages claims evictions donations alienations or other incumbrances whatsoever unto Peter BANKSTON also of this Parish here present accepting and purchasing for himself his heirs and assigns and acknowledging delivery and possession thereof a certain tract or parcel of land containing three hundred and twenty acres being the undivided section the section being purchased by the said William L. Sibley and I. M. Bankston in common with Jado Elizabeth and March Chance lying and being in the state and Parish aforesaid situate on Big Creek bounded as follows to wit: adjoining Cullen SANDERS on the south Samuel THOMPSON and T. SMITH on the East land of the Estate of Green H. Bradford on the South and government land on the west together with one half of all the immoveable improvements ways and advantages there on in any wise appertaining to have and to hold the said property unto the said purchaser his heirs and assigns to their proper use and behoof forever and the said Vendors for themselves their heirs and assigns shall and will warrant and forever defend agains the lawful claims all persons whomsoever by these presents and the Vendors moreover subrogating the said purchasers to all the rights and actions of warranty which they have or may have against their own Vendor or the Vendors of their Vendors hereby authorizing the said purchaser to exercise the said rights and actions in the same manner as they might or could have done. This Sale is made for and in consideration of the price and Sum of four hundred dollars in hand paid the receipt of the same is hereby acknowledged. This done and passed before me the day month and year first above written in presence of Wm. S. Hamilton and Lewis B. Cutrer of full age who have Signed their names together with Said appearers and me Said Judge. The vendors having failed to produce the Certificate of Mortgage from the Register's office as required by law said purchaser dispenses with the same and binds himself to hold the said Notary Public harmless for the passing of this act without that covenant.
