Ltd. --- Be It known and Remembered that under and by virtue of a Writ of fieri facias and order to seize and sell, of date the 11th day of January, 1927, issued out of the Honorable the Seventeenth Judicial District Court in and for the Parish of Terrebonne, State of Louisiana, and to me directed, in the above numbered and entitled cause, I have seized and will offer for sale at public auction, without appraisement, to the last and highest bidder, for cash, in the manner provided by law, at the principal front door of the Court House at Houma, in the Parish of Terrebonne, State of Louisiana, on SATURDAY, the 19th day of February, 1927, between the hours of eleven (11) o'clock A.M., and four (4) o'clock P.M., the following described property: 1. A certain sugar plantation, situated in the Parish of Terrebonne, on Bayou Grand Caillou, about seven (7) miles below the City of Houma, known as the ASHLAND PLANTATION, having a front on the East bank of the said bayou of twenty five (25) arpents and on the west bank of thirty-seven and one-half (37 1/2) arpents; and a depth on each side of said bayou of forty (40) arpents; bounded above on both banks by the Woodlawn Plantation of the Ashland Planting & Manufacturing Company, Ltd., and below on the East bank by the Caillou Grove Plantation, formerly of Lapene & Barrow, and on the west bank by the Cedar Grove Plantation of A. P. Cantrelle. And Lots One and Two of Section Fifteen (15) Township Eighteen (18) South, Range Seventeen (17) East, containing now one hundred and eight-four and 4/100 (184.04) acres. 2. All and singular that tract of land, or plantation known as the WOODLAWN PLANTATION, situated in the Parish of Terrebonne and having a front of fifty-six arpents (56) on the East side of Bayou Grand Caillou, and a front of fifty (50) arpents on the West side of the said Bayou, with such depth on each side thereof as to make it contain three thousand four hundred (3,400) arpents; being bounded above by land belonging now or formerly to Robert R. Barrow and below by lands formerly belonging to Lane & Mayfield, later to A. C. Cage, et als, and now to Ashland Planting & Manufacturing Company, Limited. 3. A certain tract of land, measuring twenty-eight (28) arpents and fifty-six and 10/100 feet front on the left bank descending the Bayou Grand Caillou by a depth of survey; situated in the Parish of Terrebonne, and bounded above by the Ashland Plantation of the Ashland Planting & Manufacturing Company, Ltd., and below by tract of land formerly belonging to Robert R. Barrow and Mrs. V. R. Woods. 4. A certain tract of land, situated in the Parish of Terrebonne, at about nine miles below the City of Houma, known as the Caillou Grove Plantation, and measuring sixteen (16) acres front on the left bank of the Bayou Grand Caillou, by the depth of survey bounded above by land of Caillouet & Maginis formerly, now belonging to Ashland Planting & Manufacturing Co., Limited, and below by lands formerly belonging to R. R. Barrow, afterwards to Albert C. Kohmann. 5. A certain tract of swamp land, and timbered land (comprised formerly in the Cedar Grove Plantation) situated in the Parish of Terrebonne, at about eighteen miles below the City of Houma, on the west bank of the Bayou Grand Caillou; commencing at a distance of ten arpents from said Bayou Grand Caillou, and measuring more or less fifty arpents front in the rear of land of A. P. Cantrelle, above by the Ashland Plantation of Caillouet & Maginnis, formerly, now Ashland Planting & Manufacturing Company, Limited, and below by land of A. P. Cantrelle. 6. A certain body of swamp lands, situated in the Parish of Terrebonne, in Township 18 South, Range 17 East, composed of lot No. One (1) of Section Thirty- nine (39), containing fifty-four and 50/100 acres (54.50); Lot No. One (1) of Section Forty (40), containing One Hundred twenty-three and 13/100 (125.13) acres; Lot No. Two (2) of Section Forty (40), containing Eighty (80) acres; and the upper portion of Lot No. Three (3) in Section Forty (40), containing thirty- nine and 76/100 (39.76) acres; making a total of Two hundred ninety-seven and 39/100 (297.39) acres; as per plan of survey made by A. Jolet, Jr. Surveyor, dated July 22nd, 1898, of record in the Clerk's Office of the Parish of Terrebonne; bounded North by Lot No. 2 of Sectino 15, East by the John Talrade and Joseph Talbo Grants, west by the Joseph Gabon Grant, and south by Lot No. 2 of Section Thirty nine (39) and a portion of Lot No. 3 of Section Forty (40) belonging to Dulac Planting & Manufacturing Company, Limited, in said Township and Range. 7. A certain sugar plantation situated in the Parish of Terrebonne at about seven (7) miles below the City of Houma, on both banks of the Bayou Little Caillou, known as the RANCH PLANTATION, and composed of the following described tracts of land, to-wit: 1. A tract of land on the right bank descending the Bayou Little Caillou, having a front of about twelve (12) arpents, more or less, with the depth of survey; bounded above by lands hereinbelow secondly described, and below by the land commonly known as the Fan Land of the said Ranch Plantation. 2. Another tract of land, above and adjoining the one above described, on the right bank descending the said Bayou Little Caillou having a front of five (5) arpents, by a depth of survey; bounded above by lands now of Adam Boquet, and below by lands just above described. 3. Another tract of land, known as the "Paulin Tessandier" tract, situated below that firstly described on the right bank descending the said Bayou Little Caillou, having eleven (11) arpents front by depth of survey, say forty (40) arpents, bounded above by tract firstly described, and below by land of Mrs. C. Daspit or assigns. 4. Another tract, measuring one (1) arpent and a half front on the right descending bank of the Bayou Little Caillou, about seven (7) miles below Houma, by a depth of survey; known as the Chauvin Tract, bounded above and below by lands of said Ranch Plantation. 5. A certain tract of land on the right bank descending Bayou Little Caillou, about six (6) miles below Houma, and designated in the new survey of the United States as Lots Fifty-six (56) and Fifty-seven (57) Township Eighteen (18) South, Range 18 East, containing about six hundred and fifty (650) acres. 6. A certain tract of land opposite the said Ranch Plantation, measuring three (3) arpents front on the left descending bank of the said Bayou Little Caillou, by a depth of about ten (10) arpents, more or less, bounded above and below and in the rear by land of the Front Lawn Plantation belonging to Bonvillain & Chauvin. LESS AND EXCEPT That Certain tract of land of irregular shape, formerly a portion of Ranch Plantation, sold by the Ashland Planting & Manufacturing Company, Ltd., to Ulysse Hebert, on February 25th, 1916, by act before A. J. Caillouet, Notary Public, in and for the Parish of Terrebonne, recorded in Conveyance Book 65, folio 116, under which said act the lower boundary line of the Ranch Plantation was definitely fixed. 7. A certain strip of land, fronting on the Bayou Grand Caillou and comprised between the lower line of the Ashland Plantation and a line drawn along the Drainage Canal at Twenty five (25) feet from the lower edge of the said canal, said lower line being parallel with the lower edge of the said canal and extending back until it strikes the property of Caillouet & Maginnis, formerly, now Ashland Planting & Manufacturing Company, Ltd. ALL OF WHICH SAID PROPERTY was acquired by purchase by the Ashland Planting & Manufacturing Company, Ltd., from Jean L. Caillouet, Trustee, by act before John Janvier, Notary, on the 30th day of April, 1906, which said act is registered in Conveyance Book 55, folio 135, on the 30th day of April, 1906. THERE IS EXCLUDED FROM THIS ACT OF MORTGAGE the Cypress, Timber on the above described property sold by the Ashland Planting & Manufacturing Company, Ltd., to J. E. and J. M. Burguieres, on June 20th, 1911, and there is also excluded the tract transferred to Ulysse Hebert, on February 26th, 1918, as above set forth. Together with the above described property, I have seized, as a part thereof, all of the buildings and improvements of any and every nature whatsoever (other than the mules and farming implements) situated upon said property, including cabins, dwelling houses, feed mill,s sugar factory and refinery, machinery, apparatus, tools and applianes located thereon, necessary for the purpose of carrying on the operations of the said factory, in fact everything place upon said properties for their service and improvement, and for the operation of the said sugar factory and refinery; and also fifteen (15) miles of railroad and tram-roads, together with the rights-of-way, tracks, cross-ties, bridges over canals and streams used to transport cane to the factory located on Ashland Plantation, including the whole of the rights-of-way, tracks, cross-ties, and bridges over canals and streams located on the above described property, and on Dulac, Ellerslie, and Live Oak Grove Plantation, and on other property, including the Honduras and Cedar Grove Plantations, as well as 351 Cane Cars; 35 Freight Cars; 3 Locomotives; in fact everything connected with said railroad, or tram-road, and its equipment; also 2 towboats named "Usona" and "Gladys," 52 Cane Barges, and 2 Freight Barges, one (1) Dredge Boat, all Scales, Derricks, and other equipment, in fact all of the property located on said Plantations, and used for their operation, service, or improvement, with the exception of the said mules and farming implements thereon. The said sale will be made to satisfy a judgment rendered in the above numbered and entitled cause on December 23rd, 1926, in favor of Whitney Central Trust and Savings Bank, as pledges, and against Ashland Planting & Manufacturing Company, Ltd., in the sum of One Hundred Thousand ($100,000.00) Dollars, with interest at the rate of eight per cent (8%) per annum until paid on amounts and maturities as follows: On Fifty Thousand ($50,000.00) Dollars from January 5th, 1924. On Twenty-five Thousand ($25,000.00) Dollars from January 15th, 1924. On Twenty-five Thousand ($25,000.00) Dollars from January 25th, 1924, together with five per cent on the aggregate amount of principal and interest as attorney's fees, and all costs, as well as my own costs and charges for making seizure and sale, with recognition in favor of said Whitney Central Trust and Savings Bank, as pledges, of the special mortgage containing the pact de non aliendo, recognized and granted by the defendant, Ashland Planting & Manufacturing Company, Ltd., and recorded in the Mortgage Records of the Parish of Terrebonne, in Book 59, folio 256, which said three collateral mortgage notes were identified with said act of mortgage by the Notary before whom same was executed. R. E. Milling, Jr., Notary Public for the Parish of Orleans, the said mortgage bearing upon and affecting the property hereinabove described, the said notes above described having been merged into said judgment, and the said notes and the said judgment having been decreed pledged to said Whitney Central Trust and Savings Bank to secure the payment of certain indebtedness hereinafter mentioned, due said Whitney Central Trust and Savings Bank by said Ashland Planting & Manufacturing Company, Ltd., which said indebtedness, by said judgement of date December 23rd, 1926, judgment was awarded said Whitney Central Trust and Savings Bank against said Ashland Planting & Manufacturing Company, Ltd., in the sum of One Hundred Thousand ($100,000.00) Dollars with interest thereon at the rate of 6 1/2 per cent from the 6th day of December, 1924 until paid, together with 5 percent upon the aggregate amount of principal and interest as attorneys' fees, and all costs of these proceedings, amounting to sixteen and 85/100 ($16.85) dollars; the said judgment having decreed said Whitney Central Trust and Savings Bank to enjoy a prior lien upon said notes and the judgment into which they were merged, superior to all other persons for the full amount of said judgment awarded to it, with the right in said Whitney Central Trust and Savings Bank to be paid by preference and priority, over all other persons, from the proceeds of the sale of said property, all as will appear from said write to me directed. The terms of said sale will be cash, with the condition that I said Sheriff, before commencing the crying of said property, will give notice as required by Article 679 of the Code of Practice of the State of Louisiana, that is to say, I will give notice that the said property will be sold subject to all privileges and hypothecations of whatsoever kind they might be with which the said property is burdened, with the condition that the purchaser shall pay into my hands whatever portion of the purchase price for which the property shall be adjudicated which may exceed the amount of such privileges and special mortgages to which said property is subject.
