Abbott moved to Union Parish by 1850, when he owned a plantation worth $1000 located near Spearsville. The 1850 census shows him born around 1820 in Alabama, and he had apparently recently married to Lydia, born about 1830 in Alabama. In 1860, Daniel J. Abbott owned a valuable plantation near Spearsville. That census shows that he was born about 1820 in Alabama, his real estate valued at $5000 and personal estate at 12,710. His wife at this time was L. J. Abbott, born about 1832 in Alabama. They had these children born in Louisiana: Josephine (c1851), D. T. male, born c1853), and J. M. (female, born c1856). In 1870, Abbott still lived near Spearsville, but his birthplace was shown as Georgia. His wife was Mary, born about 1832 in Alabama. Children shown were David (c1856), Daniel (c1858), George (c1862), and Harper (c1858). Also in his household was Nancy Moore, aged 80, and Ann Moore, aged 5. Abbott was a Confederate soldier, serving as a private in Company I, 5th Louisiana Cavalry Regiment. He received a parole at Monroe on 12 June 1865. ================================================================================= ================================================================================= Succession of Daniel J. Abbott, Decd. To the Honorable the Judge of the Parish Court in and for Union Parish, State of Louisiana. The petition of Joseph Abbott, a resident of your said Parish with respect represents that Daniel J. Abbott, late of same residence departed this in said Parish intestate leaving a surviving widow, Mary J. Abbott, several five children, four of which are minors, David T., Daniel, George and Earnest Abbott, the oldest one Josephine being married and a considerable amount of property both real and personal. Petitioner represents that an administration ought to be appointed to take charge of said Estate. That the surviving widow declares to take the appointment. That petitioner being the brother of decd. is willing to be appointed administrator. Wherefore, petitioner prays your Honor that W. C. Smith, Recorder and Ex Officio Notary Public be ordered to take an Inventory of the property of said Succession and that after due advertisement, petitioner be appointed Administrator of said succession upon his given bond as the law required. Petitioner prays for an order appointing petitioner provisional administrator to act as such during the pendency of the advertisement for a permanent appointment. That such an appointment is absolutely necessary. That there may be someone authorized to take immediate charge of the property and prevent its being wasted and squandered. Smith, Recorder and Ex Officio Notary Public be and is duly authorized to make inventory of the property of said Estate and make return to this office and that Joseph Abbott be and is hereby appointed curator to take charge of the property of said succession pending the final appointment of Administrator upon his given bond in amount equal to the amount of property upon inventory with good security and condition according to law. The conditions of this obligation is such that whereas the above bounders Joseph Abbott has been duly and legally appointed Administrator of the Estate of Daniel J. Abbott, deceased and he has taken the oath required by law. Now therefore, if the above bounders Joseph Abbott as principal shall faithfully and impartially discharge all the duties incumbent on him as Administrator of said Estate and shall render to the Judge of the said Court a full, complete and correct account of all his acts and doings in and about said Estate and shall when legally required so to do pay over all the money and deliver all the property of whatever kind belonging to said Estate to the proper person or persons to receive the same, then this obligation to be null and void. Otherwise, to be and remain full force and effect against the principal and his said securities. Wherefore petitioner prays your Honor for an order decreeing that the whole of the property of the succession of Daniel J. Abbott, Decd. both real and personal be sold after legal advertisements according to law and that petitioner be authorized to make said sale for all other orders and decrees necessary in the premises and for general relief. Abbott, Decd. did offer for sale between the legal hours of sale at Public Auction in the town of Farmerville before the Courthouse door to the last and highest bidder for cash with the benefit of appraisement the following real estate belonging to the said Estate of Daniel J. Abbott, Decd. The North half and East half of South west quarter of Section One Township 22 Range 2 West together with all the improvements thereon including half interest in gin house running gear and screw situated on E. V. Dudley’s land also one and half are more or less taken from the North part of West half of South West quarter of Section one in said township and range after advertising the said sale for more that thirty days in the Union Record, a newspaper published in the town of Farmerville, Parish of Union and State aforesaid. Whereupon Daniel Stein became the purchaser of said land as follows: The North West quarter of NE ¼ Sec. One Township 22, Range 2 W for the sum of one and 25/100 dollars per acre the NE ¼ of SW ¼ of Sec. One Township 22, Range 2 W at ten and 25 dollars per acre. The South W ¼ of North 6 ¼ for the sum of two and 35/100 dollars per acre. The South E ¼ of North 6 ¼ Sec. On Township 22, Range 2 W for the sum of two & 99 ½ /100 dollars per acre North E ¼ of North E ¼ Sec. One T 22 Range 2 W at two dollars per acre. The South 6 ¼ of South W ¼ Sec. On T. 22 R 2 W at the sum of five & 20/100 dollars per acre. The South E ¼ of North W ¼ at one & 25/100 dollars per acre. The south West ¼ of North W ¼ at one and 25/100 dollars per acre and the North ½ of North W ¼ at fifty cents per acre all in Section one Township 22 Range 2 West situated in said parish of Union also the one & half acres more or less taken from the northern part of West half of South West quarter of said Section and Range included in sale of North E ¼ of South W ¼ of said Section. The said Daniel Stein being the last and highest bidder. The aggregate of said sale amounting to eleven hundred and two dollars and being more than the appraisement. Abbott, Decd. by virtue of the authority vested in me by law do by these presence sell, transfer, adjudicate and deliver unto said Daniel Stein the said land as herein before described guaranteeing to said purchaser all the right title and interest in said property vested in said succession of Daniel J. C.Carr State of Louisiana Parish of Union Be it remembered that on this sixth day of July AD Eighteen hundred and seventy two (1872) I, Joseph Abbott, Administrator of the Succession of Daniel J. Abbott, Decd. pursuant to an order from the Honorable Parish Court in and for Union Parish, State of Louisiana and to me directed did offer for sale at public auction before the courthouse door in the town of Farmerville in the aforesaid Parish between the legal hours of sale to the last and highest bidder for cash with benefit of appraisement after having advertised said sale for more than thirty days in the Union Record, a newspaper published in the town of Farmerville in said Parish of Union, the following described real estate or tract of land belonging to the said Succession of said Daniel J. Abbott, Decd. The North East quarter of Section two Township twenty two North of Range two west containing in all one hundred and sixty acres more or less and situated in said parish of Union with all the improvements. Thereafter having cried said land for a reasonable length of time in a loud voice Daniel Stein became the purchaser thereof, he being the last and highest bidder as follows. The North West quarter of said North East quarter at five cents per acre. There being forty acres more or less. The north East quarter of said North East quarter at one dollar and twenty five cents per acre, there being forty acres more or less. The South East quarter of said North East quarter at six dollars per acre, there being forty acres more or less and the south west quarter of said North East quarter at two dollars per acre, there being forty acres more or less making in the aggregate three hundred and seventy two dollars as the price given by said Daniel Stein for the entire tract of one hundred and sixty acres more or less. The said price bid by said Stein being more than the appraisement of said land. Said Stein became the purchaser thereof by complying with the terms of sale and said land was accordingly adjudicated to said Stein. Now therefore, I, Joseph Abbott, Administrator of the Succession of Daniel E. Abbot, Decd. by virtue of the Authority vested in me by law do hereby sell, transfer, adjudicate and deliver unto said Stein the above described tract of land with all improvements thereon in consideration of the above mentioned price. The receipt whereof is hereby acknowledged guaranteeing whatever title vested in said Succession. Petitioner prays that said account Tableau of Distribution be duly advertised according to law and after all legal delays said account and Tableau of Distribution be approved and homologated in all its parts and the Administrator be authorized to pay out the funds on hand according to said account & Tableau of Distribution to wit: The full amount of unpaid privileged claims and twenty seven cents and two mills on the dollar of the ordinary debts as the pro rata share.
