The Petition of James W. Anderson, a resident of the Parish of Union and State above written respectfully shows that Henry P. Anderson of the Parish of Union, late a resident departed this life on or about the 16th November 1866 leaving an estate consisting of land, stock, personal property, rights, credits and debts. That he died intestate and left also five minor children to wit: Sallie, Mary, Martha, Henry Anderson, Frank and John Anderson together with Alice Anderson, wife of Daniel M. Payne and your petitioner majors also his heirs. Petitioner alleges that he is the only beneficiary heir of age and present in the state. That he has the best right to administrator, that an administration and [blank]. Therefore he prays that this his application be advertised according to law and after the legal delays that he be appointed Administrator of the said Estate of Henry P. Anderson, Decd. Wherefore he prays that an order may issue ordering the sale of said property in the terms of the writ of the Code of Practice regulating such sales and for such other orders in the premises as may be necessary. Reid Clerk, District Court State of Louisiana Parish of Union Be it remembered that pursuant to an order of the 11th Judicial District Court in and for the Parish of Union aforesaid after having made the Legal advertisement be having the same advertised 30 days in the Union Record, a newspaper published in the Town of Farmerville, Union Parish, La. from 11th February AD 1867 till 16th day of march 1867 and read the said advertisement in a loud voice and made the terms of sale fully understood to those present, I offered for sale on Saturday 16th day of march 1867 between the legal hours of sale at the Town of Farmerville, La six hundred and seventy five acres of land more or less known as the residence of the late Henry P. Anderson, deceased together with the Plantation thereon and all the appurtenances thereto belong to the highest and last bidder and after crying the same a sufficient time James M. Anderson became the purchaser for the sum of fifteen hundred dollars. Now therefore the said James M. Anderson having complied with the terms of law and having paid the amount of his bid to wit, fifteen hundred dollars in National currency the receipt whereof is hereby acknowledged by this authority in me vested, I do hereby sell, transfer deliver and adjudicate to the said James M. Anderson to have and to hold forever six hundred and seventy five acres more or less land lying and being in the parish of Union and State of Louisiana known as the Tract of land of Henry P. Anderson, Deceased, resided upon together with all the appurtenances thereto belonging the numbers of said land being marked, I cannot more fully describe it. The other property advertised was not sold for want of bidders. In testimony whereof, I have signed my name to this process verbal officially in the presence of W. C. Carr, J. E. Anderson, Decd. respectfully represents unto your honor that in order to pay the debts of the succession it will be necessary to sell the balance of the property belonging to the succession which consists of certain town lots and buildings thereon in the Town of Farmerville and an interest of the deed in the academy building and other property belonging to the Male and Female Academies near the Town of Farmerville and also some personal property which was not sold at the sale heretofore had and also some small debts owing the Estate and which all worthless. Petitioner further shows that some of the Inventory of said Succession was made, then has been a great depreciation in the value of the said property [unreadable] in the Inventory and remaining unsold and owing to said fact there is no possibility of the said property bringing the price at which it was originally appraised and that a new appraisement is necessary for the premises aforesaid. Wherefore, petitioner prays that the recorder of the Parish be required to make a new Inventory and Appraisement of the property of said succession remaining unsold and that Petitioner as Administrator of said Succession be directed by an order of your Honorable Court to sell according to law. Now by virtue of the premises and the authority in me vested as Administrator of said Succession by the Law of the State, I do hereby sell, transfer and deliver to the said purchasers above named respectively all the rights, titles and interest of said succession of Henry P. The petition of James M. Anderson, a resident of the Parish and State aforesaid respectfully shows unto your honor that Mary Anderson and Benjamin F. Anderson, minor children of H. P. Anderson, Decd. and half sister and brother respectively of petitioner, have no Tutor nor Under Tutor, that it is important for the interests of said minors, that it is important for the interests of said minors, that a Tutor should be appointed to them, they being orphants without father or mother, that the said minors reside with petitioner and since the death of their parents. That petitioner is the nearest of kin to said minors in the collateral line, they having no ascendants and he is therefore preferred by law to be appointed the tutor (legally) of said minors.
