Armstrong, Dec'd., Union Parish Louisiana Union Parish Louisiana Succession Book F, pp. 509 - 512 ================================================================================== ================================================================================== To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, Louisiana. The petition of H. Regenburg, Exec. of the Estate of A. Armstrong, Decd. respectfully represents that it is necessary to sell real property of said Estate in order to settle the indebtedness of the same. He therefore prays that an order may issue directed to the Sheriff to sell under the Act of Code of Practice 990 and 991 a certain office and two lots of ground in the town of Bastrop numbered as 18 and 38. He further prays that said Sheriff be ordered to cause a re-appraisement of said property before making said sale and for such other orders &c as may be necessary. H. Regenburg, Atty. State of Louisiana 11th Judicial District Court Parish of Union The premises considered and by reason of the Law and the evidence it is ordered and decreed that the Sheriff of Morehouse Parish, La. make a re-appraisement and sale of the property as prayed for in the within Petition and due return thereof make to this office as the law directs. Pugh, Notary Public in and for said parish duly commissioned and sworn by virtue of an order directed to the Sheriff of said Parish from the Honorable the 12th Judicial District Court commanding him to make a re-appraisement of two certain lots in the town of Bastrop to wit: Lots No. 18 and 38 and a certain office belonging to the Estate of A. Armstrong, Deceased and in pursuance of said order, I appointed N. F. McGraw and Josiah H. Traylor, men of lawful age and residence of said Parish to act as appraisers to whom I administered the following oath to wit: We and each do solemnly swear that we ill true and faithfully appraise all of the property pointed out to us as belonging to the Succession of A. Armstrong, deceased to the best of my knowledge and belief. So help me God. J. H. Traylor N. F. McGraw Sworn to and subscribed before me this the 10th day of January 1867. After the said appraisers had taken and subscribed the foregoing oath they made the appraisement found following to wit: Lot No. 18 and Lot No. 38 $1000.00 Which amounted in the aggregate to the sum of one thousand dollars. There being no other property pointed out to the appraisers the Inventory is closed. Thus done and signed on this the 10th day of January AD 1867 in presence of J. E. Pugh State of Louisiana Parish of Morehouse In the matter of the Succession of A. Armstrong, Deceased, be it remembered that by virtue of an order of sale issued from the Honorable 11th Judicial District Court in and for the parish of Union and State of Louisiana and to me directed as Sheriff of the Parish of Morehouse, directing the sale of a certain office and two lots Nos. 18 and 38 situated in the Town of Bastrop, La. according to Articles 990, 991 and 992 Code of Practice and also to cause a re-appraisement of said office and lots to be made all belonging to the Succession of A. Armstrong, deceased. I did on the 7th day of December 1866 proceed to advertise for sale in the Weekly Dispatch, a newspaper published in the parish of Morehouse, the office and lots No. 18 and 38 situated in the Town of Bastrop and according to Articles 990, 991 and 992 of the Code of Practice sale to take place at the door of the Court House in said Parish of Morehouse on the 10th day of January 1867 within the house prescribed by law to the highest bidder for cash at the appraisement and on said 10th day of January 1867 I did by my Deputy W. B. Douglas repair to the door of the court House and after having a re-appraisement made of said office and lots according to law, I did within the hours prescribed by law proceed by my said Deputy to read aloud the advertisement and to offer for sale to the highest bidder the said office and lots aforesaid for cash at the re-appraised price or value and no bid being made therein, there was no sale. Whereupon I did proceed on the 18th day of January 1867 to re-advertise in the aforementioned newspaper the above named and described office and lots for sale on twelve months credit, purchaser to give note with approved security sale to take place at the door of the Court House in said Parish of Morehouse on the 5th day of February 1867 within the hours prescribed by law and to the highest bidder, when on said 5th day of February 1867, I did by my Deputy repair to the door of the Court House aforesaid and within the hours prescribed by law proceeded to read aloud the advertisement and there offered the said office and lots above mentioned at public auction to the highest bidder when Abigail Condon became the purchaser at the price or sum of Six Hundred Dollars and she being the last and highest bidder the same was adjudicated to her for the price or sum of six hundred dollars and she the said Abigail Condon having complied with the terms of sale by giving her note with Daniel Newton as her security dated the 5th day of February 1867 for six hundred dollars payable to the legal representatives of the Estate of A. Armstrong, deceased, twelve months after date. Now therefore I, William P. Douglas, Sheriff of the Parish of Morehouse do by these presents and for the consideration of the terms of the sale being complied with as above stated sell, transfer and deliver unto the said Abigail Condon, her heirs and assigns forever all the rights, credits, title and Interest which the succession of A. Armstrong, deceased had in and to the above named office and Lots No. 18 and 38 situated in the Town of Bastrop, La. as fully and efficiently as the law of the State of Louisiana authorizing me as Sheriff of Morehouse Parish to do. It is also understood that a Mortgage herein retained on the office and lots above named and herein sold and transferred to the said Abigail Condon until the final payment of the said purchased price of six hundred dollars the said Abigail Condon being present and consenting to the same and hereto signing her name.
