She moved with her parents to what is now Union Parish Louisiana in early 1837, settled several miles east of Farmerville. Rachel married first about 1849 to Benjamin Franklin Hall. After his death in 1852, she married about 1854 to John R. Auld (c1834 - May 1870), the son of James Alexander Auld (c1813 - 1870/1880) and Elizabeth Ann Hester (c1816 - 1850/1852). Over the next few years, Rachel and John build a plantation along the Wards Chapel Road east of Farmerville. Along with numerous relatives, John enlisted as a Confederate soldier in 1862, serving in Company G, 31st Louisiana Infantry Regiment. After the war, John and Rachel experience serious financial problems. In fact, John was severely in debt when he died of pneumonia in May 1870, leaving Rachel with seven young children and seven months pregnant. Rachel continued to manage the affairs of her plantation during the year 1870. She died in childbirth or shortly after giving birth to her son in December 1870. Her children were raised by relatives. ================================================================================= ================================================================================= Succession of Rachel Jane Auld, Decd. To the Honorable the Judge of the Parish Court of the Parish of Union, State of Louisiana. The petition of Elijah H. Ward, a resident of the Parish and State above written respectfully shows that Rachel J. Auld, late of your said Parish and State departed this life intestate leaving a small estate consisting of land and personal property, rights, debts and credits. Also leaving eight minor children to wit: Cynthia Jane, Eliza Ann, Julia Annis, Mary Alice, Permelia, Elizabeth Sarah, John Wesley and James D. Auld all issue of the marriage of Auld with her late husband John R. Auld. It is alleged that the Estate is so much in debt that it will be necessary to sell all the property to pay the debts of the Estate. Petitioner further represents that it is necessary that a Tutor should be appointed to the aforesaid minors. That he is as near as any other and nearer than any except his father and brother. Wherefore petitioner prays that this his application to be appointed Administrator of the Estate of Rachel J. Auld and Tutor of her aforesaid minor heirs be advertised according to law. That an appraisement and Inventory of the Estate be made and after the legal delays and formalities are complied with, that he be appointed Administrator of said Estate and Tutor to said minor children and that John T. Ward, the brother of petitioner and uncle of said minors be appointed Under Tutor for all further orders and decrees necessary and for general relief &c. Jno. L. Barrett, Atty. The premises considered, it is hereby ordered, adjudged and decreed that the within and foregoing application of E. H. Ward to be appointed Administrator of the Estate of Rachel J. Auld, decd. and Tutor to her minor children Cynthia Jane, Eliza Ann, Julia Annis, Mary Alice, Permelia, Elizabeth Sarah, John Wesley and James D. Auld be advertised according to law. That William C. Smith, Notary public do make an inventory and appraisement of said Estate and make due return of the same to this court. Done and signed in chambers on this the 12th day of December 1870. T. B. Auld as securities are held and firmly bound unto the Honorable T. B. Tompkins, Judge of the Parish Court in and for Union Parish, La. for the time being vs. to his successors in office in the just and full sum of two thousand and two hundred and twenty five dollars to the true and full payment thereof we bind ourselves, our heirs, executors, Administrators and legal representatives firmly and in solido by these presents. Dated at Farmerville, La. this 23rd day of December AD 1870. The condition of this obligation is such that whereas the said Elijah H. Ward has been duly and legally appointed and confirmed as Administrator of the Estate of Rachel J. Auld, deceased and he has taken the oath required by law. Now therefore, if the said Elijah H. Ward shall faithfully and impartially discharge all the duties incumbent on him as Administrator of the said Estate and shall render to the Judge of said Court a true and correct account of all his acts and doings in and about said Estate and shall when legally required so to do pay over all sums of money and deliver all the property belonging to the said Estate to the proper person or persons to receive the same. The petition of Elijah H. Ward, a resident of your said Parish and State respectfully shows that he has this day been appointed Administrator of the Estate of Rachel J. Auld, Decd. That the Estate has a considerable amount. That the debts are passing and that a sale of all the property of said Estate is necessary to pay the debts of said Estate and for the present support of the minor children. Wherefore petitioner prays that a family meeting be convoked to advise and recommend with regard to the sale and the terms of sale of the land belonging to said Estate. Said meeting to consist of the relations of said minors according to [blank] and for an order of court authorizing petitioner as Administrator of said Estate to sell all the property of said Estate according to law. To pay the debts for the benefit of the minor heirs. For all orders necessary and for general relief &c. Jno. L. Barrett, Atty. Parish Court of Union Parish, La. The premises considered, it is hereby ordered, adjudged and decreed that a family meeting of the relatives of the minor heirs of Rachel J. Auld, Decd. be convoked by Wm. C. Smith, Notary to advise and recommend with regard to the sale of the said Estate of the Succession of said Rachel J. Auld, Decd. in which her minor heirs are interested and fix the terms of such sale and further that E. H. Ward, Admr. be authorized to sell all the property of said Estate according to law and in accordance with the advice and recommendation of said family meeting as regards the real property. Smith, Recorder State of Louisiana Parish of Union Be it known that on this the 23rd day of January AD one thousand eight hundred and seventy one by virtue of an order from the Honorable T. B. Tompkins, Parish Judge. I caused to come before me at my office in the Town of Farmerville the following persons to wit: Elijah H. Ward, John T. Ward, James Wyatt Auld, Michael Auld, John J. Auld and David Auld, males of lawful age and residents of the Parish of Union and relatives of the minor heirs of the Estate of Rachel Jane Auld, decd. convoked as a family meeting for the purpose of advising and recommending with regard to the sale of the land belonging to said Estate. The minors aforesaid being the sole heirs parties being first sworn according to law proceeded to deliberate and advise on the subject matter as above stated and after mature deliberation. They advise and recommend that all the property both real and personal belonging to the Estate of Rachel Jane Auld, decd. situated in the Parish of Union be sold and further recommend that the sale be made for cash at not less than the appraised value and that E. H. Auld be authorized to make said sale according to law. Thus done and signed in my office on this the 23rd day of January AD one thousand eight hundred and seventy one in presence of [blank] and [blank], witnesses called for the purpose who sign with said family and me, Recorder. Done and signed in chambers this 27th day of January 1871. T. B. Tompkins Parish Judge To the Honorable Judge of the Parish Court of Union parish, State of Louisiana. The petition of J. Shepherd Auld of the Parish of Ouachita, Louisiana respectfully shows that the following minors, the children of John R. Auld, a brother of petitioner are without a Tutor. That the Administrator of the Estate of Rachel J. Auld, their mother, is nearly compete and it becomes necessary that said minors should have a Tutor appointed to support them. Petitioner says that he is the paternal Uncle of the said minors to wit: Cynthia J., Eliza Ann, Julia Annis, Mary Alice, Permelia E., Sarah, John Wesley and James P. Auld and that there is no person who has a better right to the Tutorship except their Grandfather David Ward, but said David Ward being quite old and infirm (over seventy years of age) is not willing to take upon himself the duties and responsibilities of said Tutorship. Wherefore petitioner prays that this his application be advertised according to law and after the legal delays and due compliance on his part with all legal provisions, that he be appointed Tutor to the said minors and letters of Tutorship do issue to him accordingly and that [blank] be also appointed Under Tutor for all orders and decrees necessary in the premises and for general relief &c. Shepperd Auld be and is hereby appointed Tutor to the minor heirs of R. J. Auld, decd., he having complied with the law by having his bond duly recorded in the Recorder’s office of Union Parish, La. Tompkins Parish Judge State of Louisiana Parish of Union Pursuant to an order of the Parish Court of Union Parish, La. authorizing me to sell all the property of the Estate of Rachel J. Auld, decd. which order was granted upon the recommendation of a family meeting composed of the relatives of the minor heirs of said Estate having advertised the sale of said property both real and personal for more than thirty days by publishing the same in the Union Record, a weekly newspaper published in the Town of Farmerville, Union parish, La. and having made said advertisement in a loud voice to those present at the late residence of said R. J. Auld, decd. on the 24th day of January 1871 and having also made known the terms of sale to wit: Cash with benefit of appraisement. I, E. H. Ward, Administrator of said Estate, proceeded to offer the land of said Estate to the last and highest bidder by parties when after crying the same for a sufficient length of time, J. B. Rossiter became the purchaser as follows: the SE ¼ of NE ¼, Sec. 23 T 21 North, R 1 # at $2.00 per acre in all eighty acres. Also the SW ¼ of NW 1/4 , Sec. 24 T 21 North R 1 East at $2.00 per acre in all $80.00. The NE ¼ of SW ¼ of Sec. 24 T 21 North of R 1 East at $2.00 in all $80.00. Also, the NW ¼ of SW ¼ of Sec. 24 T 21 North of R 1 E at $2.00 per acre in all $80.00. Also, the NW ¼ of SE ¼ of Sec. 24 T 21 North of R 1 E at $2.00 per acre in all $80.00. The aforesaid five parcels being in the aggregate 200 acres more or less and bringing in the aggregate four hundred dollars. Now therefore the said J. B. Rossiter having complied with the terms of sale by paying me the cash in hand. I hereby in my capacity as Administrator of the Estate of Rachel J. Auld, decd. grant, adjudicate and deliver the advise described land being and lying in Section twenty three and twenty four in Township Twenty one North of Range one East in Union Parish, La. unto the said J. That the total amount of credits are one thousand four hundred and thirty nine 48/100 dollars leaving a balance in the Administrator’s hands of five hundred and eighty one 98/100 dollars ($581.98) besides the bedding and worthless notes herein returned which balance the Administrator is ready to turn over to the tutor of said minors whenever called for. Wherefore petitioner prays that this his final account be advertised according to law and after the legal delay that the same be approved and homologated in all its parts and there be judgment for the heirs of the Estate of Rachel J. Auld was advertised for more than fifteen days by publication in the Union Record, a paper published in Union parish, La. and by posting on the door of the Courthouse due proof of which was made in open court and no opposition having been filed to said final account, it is hereby ordered, adjudged and decreed that said account be approved and homologated in all its parts. Ward as his security are held and firmly bound unto the Honorable T. B. Tompkins, Judge of the Parish Court of Union Parish, La. and unto his successors in office in the just and full sum of eight hundred and twenty five dollars to the true and full payment of which we bind ourselves, our heirs, administrators and legal representatives firmly and in solido by these presents. Dated at Farmerville, La. this 1st day of February 1872. The conditions of the above obligation is such that whereas the above bounders J. Shepperd Auld has applied to the Judge of the parish Court of Union Parish, La. for the appointment of Tutor to the minor heirs of the Estate of Rachel J. Auld, Decd. and said application has been advertised according to law. Now therefore if the above bounders J. S. Auld as principal shall faithfully discharge all the duties incumbent on him as Tutor to said minors and shall render to the Judge of said Court a true and correct account of all his acts and doings in and about said Tutorship and shall when legally required so to do pay over all sums of money and deliver all the property belonging to said minors to the proper person or persons to receive the same.
