Auld, Deceased To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, Louisiana. The Petition of Caroline E. Shaw, a resident of said Parish, respectfully represents that Washington C. Auld, late of said Parish departed this life on the 28th day of August AD 1862 leaving Petitioner, his widow and a minor child, Laura T. Auld, the issue of a legal marriage between petitioner and the said deceased and also real and personal property, rights and credits. She prays that an inventory and appraisement may be had according to law and that she being the partner in the community after due proceedings may be appointed Administratrix of the Estate of W. C. Auld, Decd. and for such other orders and decrees in the premises as may be necessary. H. Regenburg, Atty. State of Louisiana 11th Judicial District Court Parish of Union The premises considered, it is ordered and decreed that the petition of Mrs. C. E. Shaw to be administratrix of the Estate of Washington C. Auld, decd. be advertised according to law. It is further ordered that Wm. C. Smith, Parish Recorder &c be and he is hereby authorized and appointed to make an Inventory and appraisement of all the property belonging to said Estate and due return make to this office without delay. Done and signed in office this the 20th of Oct. 1862. State of Louisiana 11th District Court Parish of Union The premises considered it is ordered, adjudged and decreed that whereas the proper advertisement having been made and no opposition having been made and also by reason of the law, that Caroline E. Auld be and she is hereby duly and legally appointed Admx. of the Estate of Wash C. Auld, decd., and upon her giving bond with good security and taking the oath required by law that letters do issue to her. Done and signed in office this the 22nd Oct. 1862 J. L. Guthrie, Clerk State of Louisiana 11th District Court Parish of Union Know all men by these presents that I, Caroline E. Auld, as principal and Elijah M. Auld, her Security are held and firmly bound unto W. B. Egan, Judge of the 11sth District Court, Parish and State aforesaid, for the time being or to his Successors in office in the full and just sum of one thousand nine hundred and eighty four 56/100 dollars, the true and faithful payment thereof well and truly to be made we bind ourselves, our heirs, assigns, administrators, executors and legal representatives firmly by these presents dated at Farmerville, La. October 31st AD 1862. The condition of the above obligation is such that whereas the said Caroline E. Aulds has been duly and legally appointed Administratrix of the Estate of Washington C. Auld, decd. and she has taken the oath prescribed by law. Now, therefore, if the said Caroline E. Auld shall faithfully and impartially discharge all and singular the duties incumbent on her as Administratrix of said Estate and shall faithfully account to the Judge of said Court for all moneys or property received in this State of any other State belonging to said Estate and shall render a true and faithful account of all her acts and doings in and about said Estate to the Judge aforesaid and whenever legally required so to do, pay over all sums of money or other property to the proper person or persons to receive the same, then the above obligation to be null and void otherwise to be and remain in full force and virtue. The petition of Caroline E. Auld, Admrx. of the Estate of Washington C. Auld, decd. herewith respectfully files her final account as follows to wit. She represents that the estate is claimed by herself as partner in community and her only child Laura T. Auld, who is the only child of deceased and prays that the said child be recognized as heir to the Estate, that the petitioner being the mother and natural Tutrix to the said minor heir, be authorized to take the part due her said child as such and that her bond as Administratrix be cancelled and for general relief. H. Regenburg, Atty. Succession of Washington C. Auld, Decd. Homolgation of the final account filed by Mrs. Caroline E. Auld, Administratrix of said succession, 1st Vouchers filed with the final account, 2nd Thos. C. Lewis, Clerk of the District Court, sworn says that the final account was filed in the Clerks office on the 2nd day of February 1864 and has been legally advertised in the following manner, by posting a copy of the advertisement at the Court House door in the town of Farmerville and by handing two copies of the said advertisement to David Arent to be posted in two public places in the Parish of Union, and that there has been no opposition filed. P. 3rd David Arent being sworn says that he was acting as Deputy Clerk on the 2nd day of February 1864, and that on that day the final account of Caroline E. Auld as Admrx. of the Estate of W. C. Auld, Decd. was filed by him and that he handed two copies of the advertisement to James A. Bransford, to be posted at Downsville and at W. J. Rainey’s residence in said Parish of Union and that there has been no opposition filed to this homolgation of said final accounting to the present date. D. Auld, Admx. of the succession of W. C. Auld, Decd. be approved and homolgated in all its parts and that her bond as Administratrix be cancelled and she be discharged from said Administration. Lewis, Clerk, District Court Union Parish Louisiana Succession Book E, pp. 400-403 Tutorship of Laura Theodosia Auld To the Honorable the Judge of the Judicial District Court in and for Union Parish, Louisiana The petition of Elizabeth C. Shaw, Admx. of the Estate of Washington C. Aulds, decd. respectfully represents unto your honor that she has lately intermarried with George W. Johnson, who joins herein as her husband authorizing and assisting. She further represents that by said marriage having lost the right to the Natural Tutorship to her child, Laura Theodosia Auld. She prays that a family meeting may be convoked consisting of the relations and friends of her said child, to consider upon her interest &c, and also to appoint Tutor, Undertutor &c according to law. She prays that such legal proceedings may be had as the case requires and for general relief. H. Regenburg, Atty State of Louisiana 11th District Court Parish of Union The prayer of the above petition being duly considered it is ordered that a family meeting consisting of E. M. Auld, B. F. Dillard, F. H. Cann, Geo. A. Stinson and W. A. Darby be convoked before William C. Smith, Recorder & Ex-officio Notary Public of said Parish to consider the matter and things set forth therein and that he make due return of the Pros [sic] verbal of the said meeting. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the sixteenth day of February AD one thousand eight hundred and sixty four, pursuant to an order issued from the Honl. 11th Judicial District Court in and for the Parish of Union, State of Louisiana and to me, William C. Smith, Parish Recorder and Ex-officio Notary Public, and for said Parish and State directed. I caused to come before me at my office in the town of Farmerville, La. The following persons, to wit: Elijah M. Auld, Wm. A. Darby, George A. Stinson, Benj. F. Dillard, and Fredrick H. Cann convoked as a family meeting for the purpose of recommending a suitable person to be appointed Tutor to the minor Laurie Theodosia Auld. Said members being first sworn by me proceeded to deliberate on the subject matter as above set forth and after mature deliberation they advised and recommended that Mrs. Elizabeth C. Johnson, the mother of the said minor Laura T. Auld, be appointed and confirmed Tutrix and George W. Johnson, her husband, Co-Tutor complying with all the requirements of Law in such cases made and presented that E. M. Auld be appointed Undertutor. This done and signed in the Town of Farmerville on this the 16th day of February AD 1864 in the presence of the undersigned lawful and competent witnesses and me the said Recorder. ATTEST: E. M. Auld and pray that the same be homolgated and confirmed and that the appointments may be made according to the law of the same. District Court Parish of Union By reason of the law and evidence in the case, it is hereby ordered, adjudged and decreed that the proceedings of the family meeting duly convoked before William C. District Court Parish of Union The premises considered and by reason of the recommendations of a family meeting duly convoked before William C. Smith, Parish Recorder, it is hereby ordered and decreed that Mrs. Elizabeth C. Johnson be and she is hereby appointed and confirmed as Tutrix to her minor child Laura Theodosia Auld and that George W. Johnson be appointed Co-Tutor to said minor and that upon their giving bond with good security that letters do issue to them. It is further ordered that Elijah M. Auld be appointed Under-Tutor to said minor and that letters issue to him upon his taking the oath required by law. Done and signed in office on this 18th day of February AD 1864. Thos. C. Rhinehart as their security are held and firmly bound unto Hon. W. B. Egan, Judge of the 11th Judicial District Court in and for the Parish and State aforesaid for the time being or to his successors in office in the full sum of One Thousand four hundred and Seventy Dollars ($1470.00) the true and faithful payment whereof well and truly to be made, we bind ourselves our heirs assigns, administrators and legal representatives firmly by these presents. Dated at Farmerville, La, February 17th AD 1864. The condition of the above obligation is such that whereas the said Elizabeth C. Johnson has been appointed Tutrix and the said George W. Johnson has been appointed Co-Tutor of the minor heir of the Estate of W. C. Auld, Decd. to wit: Laura Theodosia Auld and they have taken the oath prescribed by law. Now, therefore if the said Elizabeth C. Johnson and the said George W. Johnson shall faithfully and impartially discharge all the duties incumbent on them in their respective capacities (as Tutrix and Co-Tutor) and shall faithfully account to the Judge of said Court for all moneys or other property belonging to said minor received from this or any other State, and shall whenever legally required so to do pay over all sums of money or other property to the proper person or persons to receive the same and shall faithfully look after and study the interest of said minor in all things, then and in that case this bond to be null and void, otherwise to remain in full force and effect against the principal and securities.
