He was born about 1830 in Georgia, and his wife Mary was born about 1828 in Alabama. Marion Bailey enlisted as a private in the "Sparrow Cadets", Company I, 31st Regiment Louisiana Infantry on 2 May 1862. He was present for duty through February 1863, and he served with his unit during the climax of the Vicksburg Campaign during the summer of 1863. He was present for duty when his unit surrendered to the Yankees on 4 July 1863. He reported for duty at Vienna by April 1864. The record below reveals that he died 23 December 1864. ================================================================================= ================================================================================= To the Honorable the Judge of the Eleventh Judicial District Court in and for the Parish of Union, State of Louisiana. The petition of Mary Bailey of said Parish, a widow of Marion Bailey, Decd. late of said Parish respectfully represents that her said husband, Marion Bailey departed this life on the twenty third day of December AD 1864 leaving an estate consisting of land and personal property, rights and credits, also leaving petitioner a widow in community, one minor child the issue of a marriage between petitioner and the said deceased by name Sarah Alice Bailey. Petitioner represents that as widow in community and natural Tutrix to the minor child, she is [unreadable] to the administration and prays that after due proceedings had, she may be appointed Administratrix of said estate and confirmed natural Tutrix to her said minor child Sarah Alice Bailey. She also prays that an Inventory and Appraisement may be had according to law and for such other orders and decrees in the premises as may be necessary. H. Rebengurg, Atty. State of Louisiana 11th Judicial District Court Parish of Union Let the prayer of petitioner be granted and it is hereby ordered that Mrs. Mary Bailey be and she is hereby appointed Admininstratrix of the Estate of Marion Bailey, Decd. after the proper and legal advertisements having been made. Smith, Recorder al. in and for said parish directed authorizing me to make and Inventory and Appraisement of the property, rights and credits belonging to the Estate of Marion Bailey, Deceased and being assisted by William Willhite and Ellias Taylor who are hereby duly appointed and sworn by me as appraisers and in the presence of witnesses proceeded to make said Inventory and Appraisement as herein after set forth: A tract of land known as the late residence of Marion Bailey, Deceased situated in the Parish of Union containing 320 acres more or less apprd. @ $2 per acre $640.00 8 head sheep apprd. @ 10.00 12 head hogs more or less apprd. @ 30.00 1 broad axe, cross and hand saw apprd. @ 11.00 1 pair balance drawing 411 [?] apprd. @ 3.00 Running geer for two horse wagon wood apprd. @ 30.00 1 mule at this time estranged or stolen worth $125.00 ________ Total amount of Inventory $730.00 Thus done and signed in my office in the Town of Farmerville on this the day and date above written in presence of David Arent and Jeff Lee witnesses of lawful age and domicile who sign with said appraisers and me Recorder on this the 28th day of December AD 1866. Smith, Recorder State of Louisiana 11th Judicial District Court Parish of Union Know all men by these presents that we Mary Bailey as principal and Elias Taylor security, are held and firmly bound unto the Honorable J. D. Watkins, Judge of the Eleventh Judicial District Court in and for Union Parish, Louisiana for the time being or to his successor in office in the just and full sum of Nine hundred and ten dollars to the true and full payment thereof we bind ourselves, our heirs, executors, administrators and legal representatives firmly and in solido by these presents. Date at Farmerville, La. this 28th day of December AD 1866. The condition of this obligation is such that whereas the said [blank] has been duly and legally appointed Administrator of the Estate of Marion Bailey, Deceased and she has taken the oath required by law. Now therefore if the said [blank] shall faithfully and impartially discharge all and singular the duties incumbent on her as Administratrix of the said Estate and shall render to the Judge of said Court a true and correct accounting of all her acts and doings about said Estate and shall whenever legally required so to do pay over all sums of money and deliver all the property to the proper person or persons to receive the same. Then, this obligation to be null and void. Otherwise to be and remain in full force and virtue according to law. Reid, Clerk Succession of [blank], Deceased State of Louisiana 11th Judicial District Court Parish of Union I, Mary Bailey have been duly and legally appointed Administratrix of the Estate of Marion Bailey, Deceased and she has given bond with good security and has taken the oath prescribed by law. Now, therefore, the said Mary Bailey is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to said appointment according to law. The petition of Mary Bailey, Administratrix of the Estate of Marion Bailey, Decd. Respectfully represents that the property of said Estate both personal and real is unproductive, deteriorating in value, subject to waste and [unreadable] besides being in part expensive to keep. Wherefore she prays that an order may issue ordering the sell of said property according to the Articles of the Code of Practice regulating such sale, and for such other orders in the premises as may be necessary.
