The purchaser giving notes with good personal security with a mortgage on the real Estate. I, Avery Breed, Sheriff of said Parish and State in pursuance to said order have advertised said sale to take place on the 14th day of December 1846 as per copy of advertisement hereto annexed to be sold on the terms & conditions as above expressed in said Parish where upon said day I proceeded to said place and after declaring the Terms of sale to the bystanders & all the conditions in return thereto proceeded to the sale of said property and the following persons became purchasers at the following prices to wit: Elizabeth Banks 1 Bay mare $65.00 1 Sorrell mare 50.00 1 filly 45.00 1 sorrel mare, old 30.00 1 sorrel filly 40.00 36 head of cattle $4.50 per head 162.00 80 hogs more or less 120.00 1 rifle gun 4.00 1 small wagon 25.00 Farming tools 10.00 Household & kitchen furniture 50.00 Crop on land __100.00 $701.00 The North east quarter of the south west quarter of section No. 27 in Township No. 20 of Range 1, No. 1 East 300.00 The advertised ½ of the North East quarter Of Section No. 26 Township No. 20 Range No. 1 east appraised to ___20.00 Amount brot. Judge of the 12th District court in & for the Parish of Union, State of La. The petition of Elizabeth Banks a resident of your said Parish & State with respect represents unto your Honor that about [blank] day of October AD 1843 her husband, late of your Parish departed this life intestate leaving your petitioner, his wife & the following children the issue of his marriage with Petitioner to wit: Mary Ann, Euller Maria, Susanah, Jane M., Kizzyann, Alfred M., Jacob A., William H., minors and a considerable property consisting of real & personal property wherefore petitioner prays your honor to cause your Petitioner as the legal wife of the said Peragrin Banks to be appointed Administrator of said Estate and that she be appointed Tutor of the children as above named. That be appointed Under Tutor and that your Honor cause an inventory of the property of said estate to be made and for all other orders and decrees as the nature of the case may require & as in duty bound &c. Witnesses: Thoms. Simpson Elizabeth (her X mark) Banks Let the prayer of the petitioner be granted, and it is ordered that an inventory & appraisement be made by Thomas VanHook, Notary Public & John Feazle & Thomas Simpson who is hereby appointed appraisers, done & signed on this the 18th day of September AD 1846. By reason of no opposition being made to the within petition after due & legal notice, it is ordered that the prayer by petitioner be granted, & that Elizabeth Banks wife of Deceased Peragrin Banks be appointed Administrator. His estate and its is further ordered that she be appointed and confirmed as Natural Tutor to the minor children upon giving bond & security & taking the oath according to law. Done & signed on this the 18th of Sep AD 1846. State of La. 12th District Court Parish of Union It is ordered that John Feazle be appointed Under Tutor to the minor children of Peragrin Banks, deceased to wit: Jane M., Kizzyann, Alfred M., Jacob A., William C. Done & signed on this the 18th of Sep 1846. State of La. Parish of Union Be it remembered that pursuant to an order of the Honorable 12th District Court holding session in & for the said Parish and State, I Thomas VanHook, a notary Public duly commissioned and sworn in & for the said Parish appeared on this the 18th day of September 1846. Takes an inventory & appraisement of the property belonging to the said estate of Peragrin Banks, deceased, and after administering the oath to John Feazel & Thomas Simpson the appraisers appointed to make the appraisement by me priced as follows to wit: Elizabeth Banks being present & giving in said property under oath. 1 bay mare about seven years old $65.00 1 Sorrel about five years old 50.00 1 sorrel mare very old 30.00 1 3 year old filly 45.00 1 2 year old sorrel 40.00 36 head of cattle at $4.50 per head 162.00 80 head of hogs more or less at $1.50 per head 120.00 1 rifle gun old 4.00 1 wagon small 25.00 Farming utensils 10.00 Household & kitchen furniture 50.00 The North west qtr. of the South west qtr of Section No. 27 T N 20 Range 1 East 40, 300.00 The undivided half of the North East qtr. of S No. 26 T. 20 Range 1 East 20.00 Crop growing 1021.00 The foregoing inventory amounting in all to one thousand & twenty one dollars in testimony whereof the appraisers have signed hereto & me the said Notary in the presence of H. State of Louisiana Parish of Union Do you & each of your solemnly swear that you will appraise the property belonging to the Estate of Peragrin Banks, deceased, that may be given in or that may come to your knowledge according to the best of your understanding. I solemnly swear that I have named & given in all the property belonging to the Estate of Peragrin Banks, deceased of which I have any knowledge. State of La. 12th District Court Parish of Union Know all men by these presents that we Elizabeth Banks as principle & Thomas Simpson, her security are held and firmly bound unto G. W. Copley, Judge of the 12th District Court in and for the said Parish and his successors in office in the sum of one thousand three hundred and seventy six dollars and to the true & faithful payment of the same, we bind ourselves, our heirs and assigns firmly by these presents dated on this the 18th day of Sep 1846. The conditions of the above obligations is such that whereas the said Elizabeth Banks has been appointed Administratrix of the said Estate of Peragrin Banks, deceased. Now therefore if the said Elizabeth Banks does well & truly discharge all & singular the duties incumbent on her as administratrix aforesaid sand shall render a just and impartial account of her acts and doings as administratrix aforesaid when thereunto legally required so to do. Then the above obligations is to be null and void or else to be & remain in full force & effect signed and acknowledged on the date above written. State of Louisiana 12th District Court Parish of Union Whereas Elizabeth Banks has been appointed Administratrix of the Estate of Peragrim Banks, deceased and having given bond & security and taken the oath as prescribed by law. Now therefore she is hereby authorized and fully empowered to discharge and perform all and singular the duties appertaining to said appointment according to law. In testimony whereof I have hereto signed my name & affixed the seal of Court on this the 18th day of Sept. AD 1846. State of Louisiana Parish of Union I do solemnly swear that I will impartially discharge all and singular the duties incumbent on me as administratrix of the Estate of Peragrin Banks, deceased to the best of my abilities & understanding according to law. To the Honorable the Judge of the Twelfth Judicial District Court in and for the Parish of Union in the State of Louisiana. The petition of Elizabeth Bank, resident of your said Parish and State and Administratrix of the Estate of Peragrin Banks, deceased with respect represents unto your Honor that lately that two of the heirs of said Estate to wit: Mary Ann & Susanah have married & are entitled to their interest in said Estate. That your petitioner has a separate interest in said Estate in consequence of the community existing between petitioner & said descendent from the time of there to this time. That she is desirous that the said heirs have their interest in said Estate set apart to them & that Petitioner have her interest set apart to her, that the property in such as cannot be partitioned in kind wherefore she prays that all the property belonging to said Estate be sold to pay the debts of said Estate and that a petition be made between petitioner & the heirs & for general relief &c. Elizabeth (her X mark) Banks Estate of Peragrin Banks 12th District Court Let the prayer of the within petition be granted and it is ordered that the property be sold on a credit of twelve months, purchasers to give notes & security with mortgage on the real estate & it is further ordered that Avery Breed, Sheriff make said sale according to law. Done & signed in office on this the 18th of December 1846. To the Honorable Geo. W. Copley, Judge 12th District Court in and for the Parish of Union, State of Louisiana. The petition of Elizabeth Banks, Administratrix of the Estate of Peragrin Banks respectfully represents unto your Honor that it will be to the interest of said Estate for the property to be sold. Wherefore she prays that your Honor cause the said property to be sold on a credit of twelve months & for general relief as in duty bound &c. Elizabeth (her X mark) Banks Let the prayer of the petitioner be granted & it is ordered that all the property be sold belonging to the estate of Peragrin Banks on a credit of twelve months, purchasers to give notes with approved security with a mortgage on the real Estate & that is further ordered that Avery Breed, Sheriff make said sale according to law. Done & signed on this the 19th day of Sept. 1846. Notes Elizabeth Banks having filed in the office of the Clerk of the 12th District Court in & for the Parish of Union, La. an application to be appointed Administratrix of the Estate of Peragrin Banks, Deceased all persons having objections to make to said appraisement are hereby notified to file the same in the office of the said Clerk at the Court House in said Parish within ten days from the date thereof. Done & signed at my office on this the 15th day of August AD 1846.
