Bearden, Decd., Union Parish Louisiana Union Parish Louisiana Succession Book F, pp. 356 - 361 ================================================================================= ================================================================================= To the Honorable Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana. The Petition of William P. Bearden, a resident of your State and Parish respectfully represents unto your honor that James B. Bearden, late of same residence departed this life a few days ago leaving a small Estate and several minor heirs, also a surviving spouse that the entire Estate belonging to the deceased. The marriage between the deceased and his surviving spouse having been contracted but a few days before his death there is now community property. The minor heirs being the issue of a former marriage. Petitioner represents that an Administrator is necessary at once as a good portion of the property is perishable goods and ought to be disposed of as soon as possible, that the Petition is the elder Brother of the deceased is willing to serve in the administration. Wherefore, Petitioner prays your honor that W. C. Smith, Parish Recorder and Ex Officio Notary Public be ordered to make an Inventory of the Effects of said deceased and after legal advertisement and all other legal delays, Petitioner be appointed Administrator of the Estate of James B. Bearden, Decd. and for all other orders and decrees necessary in the premises and for general relief. R. W. Futch, Atty. State of Louisiana 11 Judicial District Court Parish of Union The premises considered and by reason of the proper and legal advertisement having been made and no opposition having been filed thereto, it is ordered and decreed that W. P. Bearden be and he is hereby appointed Administrator of the Estate of James B. Bearden, Decd. Done and signed in office this 11th day of February AD 1866. J. W. Smith, Parish Recorder make an Inventory and Appraisement of all the property belonging to the Estate of James Bearden, Decd. and due return thereof make to this office without delay. Bearden do solemnly swear that I will faithfully and impartially discharge all the duties incumbent upon me as Administrator of the Estate of James B. Bearden, Deceased and he has given bond with good security and has taken the oath prescribed by law. Now therefore the said William P. Bearden is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to said appointment according to law. Bearden as principal and Phillip Bearden and William Skains and Decalb Bearden as securities are held and firmly bound unto the Honorable J. D. Watkins, Judge of the Eleventh Judicial District Court in and for Union Parish, La. for the time being or to his successors in office in the just and full sum of two thousand dollars, to the true and full payment thereof we bind ourselves, or heirs, executors, administrators and legal representatives, firmly and in solido by these presents. Dated at Farmerville, La. this 11th day of February AD 1867. The condition of this obligation is such that whereas, the said William P. Bearden has been duly and legally appointed and confirmed as Administrator of the Estate of James B. Bearden, deceased and he has taken the oath required by law. Now therefore if the said William P. Bearden shall faithfully and impartially discharge all the duties incumbent on him as Administrator of the Estate and shall render to the Judge of said Court a true and correct account of all his acts and doings in and about said Estate and shall when legally required so to do pay over all sums of money and deliver the property belonging to the said Estate to the proper person or persons to receive the same, then this obligation to be null and void, otherwise to be and remain in full force according to law. Bearden a resident of the Parish aforesaid respectfully represents unto your honor that Petitioner is the Administrator of the Estate of James B. Bearden, Deceased, late of the same residence. That the personal property of said Estate is maturing daily and that it might be sold as soon as possible wherefore Petitioner prays your honor that an order of sale issue from your Honorable court authorizing your petitioner to sell all the personal property belonging to said Estate as the law directs for all other orders and decrees necessary in the premises and for general relief. Bearden, Decd. be sold in accordance with articles No. 990, 991, and 992 Code of Practice and it is further ordered that J. B.
