Benton, Union Parish Louisiana Union Parish Louisiana Succession Book E, pp. 545 - 548 ================================================================================== To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, Louisiana. Petition of Alfred W. Johnson, a resident of said Parish and State respectfully represents unto your honor that Martha B. Benton, a minor heir of Archible [sic] G. Benton died late of the county of Union, State of Arkansas, is residing with petitioner in this Parish and State. He further represents that the said minor owner in her own right of a considerable amount of property consisting in real and personal property and in an undersigned witness of the Estate of her father A. G. Benton, Decd. which property and rights is now in the hand of guardian and Administrator. Petitioner represents that the interest of said minor is worth between eight and ten thousand dollars, that said minor being in his care and residing with him. It is his intention to remove her property wherefore he prays to be appointed Tutor to the said minor and Joseph A. Johnson Under tutor and for such other orders and desires as the case requires. H. Rebenburg, Atty. State of Louisiana 11th Judicial District Court Parish of Union I, Alfred W. Johnson, do solemnly swear that I will faithfully and impartially discharge all and singular the duties incumbent on me as Tutor of the following minor heir of the Estate of Archibald G. Benton, Decd. to with Martha Benton, according to the best of my knowledge and ability. So help me God. A. W. Johnson Sworn to and subscribed before me on this 15th day of December AD 1864. T. C. Lewis, Clerk Tutorship of the minor Martha A. Benton State of Louisiana, Parish of Union, 11th Judicial District Court. Whereas, Alfred W. Johnson has been duly and legally appointed and confirmed as Tutor of the following minor heir of the Estate of Archibald S. Benton, Decd. to wit: Martha A. Benton, and he has given bond with good security and sufficient security and has taken the oath presented by law. Now therefore the said Alfred W. Johnson is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to said appointment according to law. Given under my hand and seal of office on this 13th day of December 1864. T. C. Lewis, Clerk State of Louisiana 11th Judicial District Court Parish of Union Know all men by these presents that we, Alfred W. Johnson as principle and Joseph A. Johnson as his security are held and firmly bound unto Honorable W. B. Egan, Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana for the time being or to his succession in office in the full and just sum of Fifteen Thousand Dollars ($15,000.00) to the true and faithful payment whereof well and truly to be made we bind ourselves, our heirs, assigns, Executors and legal representatives firmly by these presents. The condition of the above obligation is such that whereas the above bounded Alfred W. Johnson has this day been duly and legally appointed and confirmed as Tutor of the following minor heir of the Estate of Archibald G. Benton, Decd. to wit: Martha A. Benton and he has taken the oath presented by law. Now, therefore, if the said Alfred Johnson shall faithfully and impartially perform all the duties incumbent on him as Tutor of the said minor Martha A. Benton and shall render to the Judge of said court a true and correct account of all his acts and doings in and about said matter of Tutorship and shall faithfully account for all monies or other property received from this or any other State belonging to the said minor and shall whenever legally required so to do pay over all sums of money and deliver all the property in his hands belonging to the said minor to the proper person or persons to receive the same then and in that case the above obligation to be null and void, otherwise to be and remain in full force and virtue against the principle and his security.
