The petition of Sarah C. Bilberry, a resident of your Parish and State respectfully represents unto your Honorable Court that petitioner’s husband Jacob G. Bilberry departed this life about the first of April last (1865) in said parish leaving your petitioner, two small children and a small estate consisting of real and personal property, rights and credits &c, that an administrator is necessary. Wherefore petitioner prays your Honor that Wm. C. Smith, Parish Recorder & Ex Officio Notary Public be ordered to take an Inventory of the property belonging to the said Estate and that after due advertisement and all other legal delays your petitioner be duly appointed Administratrix of the succession of said husband Jacob G. Bilberry, deceased and finally for other orders and decrees necessary in the premises and for general relief. R. W. Futch State of Louisiana 11th Judicial District Court Parish of Union It is ordered and decreed that the written application of Mrs. Sarah Bilberry to be appointed Admx. Of the Estate of Jacob G. Bilberry be advertised according to law. It is further ordered that Wm. C. Smith, Parish Recorder &c be and he is hereby authorized to make an Inventory and Appraisement of all the property belonging to the said Estate and due return thereof make to this office. Bilberry be and she is hereby appointed and confirmed as Admx. Of the Estate of Jacob G. Bilberry, Decd. and that upon her giving bond with good security and taking the oath prescribed by law that Letters of Administration do issue to her. Bilberry, do solemnly swear that I will faithfully and impartially discharge all and singular the duties incumbent on me as Administratrix of the Estate of Jacob G. State of Louisiana 11th Judicial District Court Parish of Union Whereas Sarah C. bilberry has been duly and legally appointed and confirmed as Administratrix of the Estate of Jacob G. Bilberry, Decd. and she has given bond with good security and has taken the oath prescribed by law. Now therefore the said Sarah C. bilberry is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to said appointment according to law. Bilberry as principal and William D. Cooper as her security are held and firmly bound unto Honl. J. D. Watkins, Judge of the 11th Judicial District court in and for Union parish, La. for the time being or to his successor in office in the just and full sum of One Thousand Six Hundred dollars ($1600) to the true and faithful payment whereof well and truly to be made, we bind ourselves, our heirs, assigns and legal representatives firmly by these present. Dated at Farmerville, La. on this 4th day of December AD 1865. The condition of this obligation is such that whereas the above bounden Sarah C. bilberry has been appointed Administratrix of the Estate of Jacob G. Bilberry, Decd. and she has taken the oath prescribed by law. And, therefore, if the said Sarah C. Bilberry shall faithfully and impartially discharge all and singular the duties incumbent on her as Admx. Of the said Estate and shall render to the Judge of said court a true and correct accounting of all her acts and doings in and about said Estate and shall whenever legally required so to do pay over all sums of money and deliver all the property of whatever nature in her possession to the proper person or persons to receive the same, then this obligation to be null and void. Smith, Recorder and Ex Officio Notary Public in and for said Parish directed commanding me to make and Inventory and Appraisement of all the property, rights and credits belonging to the Estate of Jacob G. Bilberry, a resident of your Parish and Administratrix of the Estate of Jacob G. Bilberry, Decd. respectfully represents unto your honorable Court that said Estate is largely in debt and probably insolvent. That it will be to the interest of said Estate to sell all the property belonging to it for the purpose of making a speedy settlement. Wherefore your Petitioner prays your honor for an order authorizing the sell of all the property belonging to the Estate of Jacob G. Bilberry, Decd. both real and personal. That the personal property be sold after ten days advertisement &c. The real to be advertised according to law, say thirty days. That the Administratrix be appointed to make said sale and that it be made for cash for all other orders necessary in the premises and for general relief. R. W. Futch, Atty. State of Louisiana 11th Judicial District Court Parish of Union The prayer of the within petition being duly considered, it is ordered and decreed that all the property both real and personal belonging to the Estate of Jacob G. Of the said Estate be and she is hereby appointed duly authorized to make the said sale and due return thereof make to this office according to law. They all having complied with the terms of sale as announced by me according to law. State of Louisiana Parish of Union Be it remembered that on this [blank] day of January AD 1866 in pursuance to an order of the honorable Eleventh Judicial District Court in and for the Parish of Union, State of Louisiana, I Sarah C. Bilberry, Administratrix of the Estate of Jacob G. Bilberry, Deceased, did offer for sale at the late residence of J. G. Bilberry, Decd. after having advertised said sale for more than thirty days by posting written advertisements in three public places in the in the Parish store being no newspaper published in the Parish and after having cried out the terms of sale in a loud voice at public auction to the last and highest bidder all the real Estate belonging to said succession for cash. Whereupon Mrs. Sarah C. Bilberry became the purchaser of all the said property consisting of the following described tract or parcel of land with all the improvements therein to wit: The West half of NW ¼ SE ¼ of NW ¼ SW ¼ of NE ¼, NW ¼ of SE ¼ of Section eleven, Township 22 Range one East containing two hundred acres and NW ¼ of NE ¼, NE ¼ of NE ¼ Sec. eleven township 21 range one East containing two hundred and forty acres and the NE ¼ of SW ¼ Sec. eleven township twenty two Range one East for the sum of two hundred and Ninety seven and 60/100 dollars, it being the last and highest bid. Now therefore, I Sarah C. Bilberry Administratrix of said Estate of Jacob G. Bilberry, Decd. by virtue of the authority vested in me do by these presents transfer, sell and deliver unto Sarah C. Bilberry all the right, Title and interest to said tract of land including the improvements and appointments therewith belonging vested in said Estate. In testimony whereof, I hereunto sign my name officially in the presence of R. W. Futch and M. C. Ellis, lawful witnesses on this the day and date above written. Attest: R. W. Futch S. C. Bilberry a resident of your Parish and State respectfully represent that she is the Administratrix of the State of Jacob G. Bilberry, Decd. and presents herein her final account of her Administration. 1st Admx. Charges herself with entire amount process verbal of sale $596.22 Admx. asks credit for the following debts which she has paid 1 Clerk’s fee 27.55 2 Recorder’s fee [blank] 3 Atty.’s fee 40.00 The balance Administratrix has paid on her own, privilege claim of $2700.00 Which her husband the said Decd. received from her tutor & used for his own benefit. Petitioner represents that there are several ordinary debts against said Estate but as there are not sufficient effects to pay the privilege claims, the Administratrix has made no effort to ascertain the exact amount of such debts. Petitioner prays that this her final account be advertised according to law and finally homologated in all its parts and she be discharged from the Administration and her bond cancelled and for general relief. R. W. Futch, Atty. State of Louisiana 11th Judicial District Court Parish of Union It is ordered that the within final account be advertised according to law. Done and signed in office this 4th day of June AD 1866. Thos. C. Lewis Clerk, District Court In the matter of the homologation of the final account filed by Mrs. Sarah C. Bilberry as Admx. of the Estate of Jacob G. Bilberry, Decd. Thos. C. Lewis, Clerk of the District Court sworn says that the said final account was filed in the Clerk’s Office on the 4th day of June 1866 and has been duly and legally advertised for opposition in the following manner to wit: by posting a copy of the advertisement at the Court House door in the town of Farmerville and by publication in a weekly newspaper called the Union Record published in the town of Farmerville, Union Parish, La. that said account has been advertised as above for more than thirty days prior to this date and no opposition has been filed to the homologation of the same.
