He was born about 1807 in North Carolina, and living with him were Henry (born c1849), James M. (born c1851), Nancy (born c1853), and Georgia Ann Bilberry (born c1855). His wife must have already been dead. ================================================================================= ================================================================================= To the Honorable the Judge of the 12th Judicial District Court in and for the Parish of Union, Louisiana. The petition of John B. Robinson, a resident of said Parish and State respectfully shows unto your Honor that two minor children of M. Daniel Bilbery, deceased named Nancy A. and Georgia A. Bilbery who reside in said Parish and State and you render the charge and protection of your petitioner who is a brother in law of said minors have no Tutor appointed to represent them, that said minors have an interest in the succession of their deceased father and it is necessary to their interest that they should have a Tutor to represent them in the proceedings relative to the statement and distribution of said Estate. That petitioner knows of no other who will take upon himself the Tutorship of said minors if required to comply with all the formation of the law prescribed in order on cases in regard to giving bond &c and that he makes this application under the provisions of Section 4 Act of 1855 dispersing with a bond and security on the part of the Tutor in cases therein provided for. Wherefore petitioner prays that a family meeting composed of the relation of said minors or friends in default of relations deliberate upon the foregoing application and that with their advise, petitioner be appointed Tutor and be appointed Under Tutor to the same for all other orders necessary in the premises and for general relief. Todd & Brigham, Attys. The foregoing petition considered, it is ordered the Recorder of the Parish of Union be and he is thereby ordered to convoke before him a family meeting composed of E. B. Bilbery, John Baron, James Barron, Wm. Barron relations and a friend in default of other relations. The family meeting when convoked to deliberate and advise in relation to the application of Jno. B. Robinson, relation to the appointment of Tutor and Under Tutor to the minors Nancy A. And Georgia A. Bilberry and due return of these proceedings to this court. Done and signed in office this 11th day of May 1868. J. W. Smith, Recorder in and for said Parish and State personally came and appeared E. B. Bilberry, William Barron, Alfred Honeycutt, John Dawkins and Thomas B. Findley with legal qualifications composing a family meeting convoked under an order of the Honorable the 11th District Court in and for said Parish and State for the purpose of deliberating and advising in regard to the application made by Jno. B. Robinson in and for the appointment of a Tutor and Under tutor to the minors Nancy A. and Georgia A. Bilberry, heirs of M. D. Bilberry, Deceased and the said family meeting after they had been sworn according to law and after due deliberation do advise that the application made by Jno. B. Robinson be granted and the said Robinson be appointed tutor to said minors upon his taking the oath required by law and that for the reason set forth in his petition that he be dispensed from the requirements of giving bond prescribed in other cases and that Elsey B. Bilberry be appointed Under Tutor upon taking the oath prescribed by law. In faith whereof the said members of the family meeting have signed these proceedings together with me Recorder on this 16th day of May AD 1868 in presence of the attending witnesses. ATTEST: W. P. Bilberry be homologated and that in [blank] therewith Jno. B. Robinson be appointed tutor to said minor and [blank] be appointed Under to the same upon their respectively taking the oath prescribed by law. Robinson and [blank] do solemnly swear that we will discharge the duties of Tutor and Under Tutor respectively to the minors Nancy A. and Georgia A. State of Louisiana Eleventh Judicial District Court Parish of Union I, John B. Robinson, do solemnly swear that I will faithfully and impartially discharge all the duties incumbent on me as Tutor to the following named minor heirs of the Estate of M. D. bilberry, deceased to wit: Nancy A. and Georgia A. Bilberry accordingly to the best of my ability and understanding. So help me God. John B. Bilberry and he has taken the oath prescribed by law. Now, therefore, the said Jno. B. Robinson is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to the said appointment according to law.
