Boatright, Decd. ================================================================================= NOTE: William Cleaton Boatright (c1839 - 4 Nov 1861) was the son of Powhatan Boatright (1790-1880) and Nancy Burke. William enlisted in the summer of 1861 in the "Phoenix Rifles", a unit of men from Union Parish who enlisted to fight for the South in the War Between the States. They left Union Parish and went south to Camp Moore, located now in Tangipahoa Parish just across the Mississippi state line. While training there, many of the men caught measles and other diseases. William C. Boatright died at Camp Moore of measles on either November 1 or 4. He is buried in the cemetery there. ================================================================================= To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana The petition of Martha J. Boatright, a resident of your said Parish respectfully represents unto your honor that she is the surviving widow of William C. Boatright, Decd. That her said husband departed this life in the year 1861 leaving a small amount of real property and two minor heirs, William W. and Sarah J. C., the issue of the marriage between your petitioner and her said husband. Petitioner prays to be confirmed by your Honorable Court, natural Tutrix to her said minor children upon taking the oath prescribed by law, and that there issue an order from your Honorable Court ordering William C. Smith, Parish Recorder and Ex Officio Notary Public to proceed to take an inventory of the property belonging to said minors. Petitioner suggests that E. G. Pierce, a resident of said Parish and brother of your petitioner be appointed under tutor to said minors and finally prays for all other orders and decrees necessary in the premises and for general relief. Smith, Parish Recorder &c be and he is hereby authorized and empowered to make an inventory and appraisement of all the property belonging to minor heirs of the Estate of William C. Boatright be and she is hereby appointed and confirmed as natural Tutrix of he following minor children, heirs of the Estate of John C. Boatright, Decd. to wit: William W. and Sarah J. C. Boatright and that upon her taking the oath prescribed by law that letters of Tutorship do issue to her. It is further ordered that Enoch J. Pierce be appointed under tutor of said minors and upon his taking the oath prescribed by law that letters as such do issue to him. Done and signed in office on this 23rd day of August AD 1865. Thos. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the fourth day of September AD One Thousand Eight Hundred and sixty Five pursuant to an order of the Honorable 11th Judicial District Court in and for the parish of Union and State of Louisiana, and to me William C. Smith, Recorder and Ex Officio Notary Public directed communicating me to make an Inventory and appraisement of the property belonging to the Estate of William C. Boatright, Deceased, I have on this day proceeded to make said inventory being assisted by Enoch J. Pierce and Stephen J. Beaird, lawful citizens of the Parish of Union and being duly appointed and sworn by me as appraisers and in the presence of William H. Carson and W. W. Guthrie, witnesses of legal age and domicile. A tract of land situated in the parish of Union, known as the West half of south East quarter and the East half of the south West quarter of Section number nine (9) Township 21 North of Range One West containing 150 acres more or less with the improvements therein apprd. to be with $1.25 per acre $200.00 Having completed the foregoing inventory and appraisement, I on this the 21st day of September AD 1865 closed the same. In testimony whereof, I have cause said appraisers to sign their names hereto in the presence of William H. Carson and W. w. Boatright, a resident of your said Parish and State respectfully represents unto your Honorable Court that petition as the Natural Tutrix confirmed by your Honor of the minors William W. Boatright and Sarah J. c. Boatright that the entire estate consists in a small tract of land in the Parish aforesaid. Petitioner is of opinion that it will be obviously to the interest of the minors to sell said tract of land and the proceeds of it be applied to the raising and education &c of the minors. Therefore, petitioner prays your Honorable court that a family meeting composed of the friends and relatives of the minors be convoked before W. C. Smith, Parish Recorder & Ex Officio Notary Public for the purpose of deliberating and deciding upon the property of selling the said land. That the following named person to wit: Stephen J. Beaird, Wm. H. Carson, Thomas S. Carson, Lewis Henderson, David Reddden, relations and family of said minors compose said family meeting. Smith, Parish Recorder and Ex Officio Notary Public in and for said Parish and State duly commissioned and sworn directed, I caused to come before me at my office in the Town of Farmerville the following named person to wit: Stephen J. Beaird, Wm. H. Carson, Moses S. Carson, Lewis Henderson, David Redden, lawful citizens of the Parish of Union State aforesaid convoked as a family meeting for the purpose of deliberating and advising upon the property of selling a certain tract of land belonging to the Estate of William C. Boatright, Deceased and to fix the terms of said sale &c. Said members being first duly sworn by me proceeded to deliberate and advise touching the subject matter above stated and after mature deliberation, they advised and recommend that it would b4e to the interest of the minors Wm. W. Boatright and Sarah J. C. Boatright for the land aforesaid to be sold and the sum on a credit of twelve months and that the sale be made by the Tutrix Martha J. Boatright. In testimony whereof, I have caused said members to sign this Process Verbal in the presence of W. W. Guthrie and R. W. Futch, male witnesses of lawful age and domicile who have also signed their names with said members and me the said Recorder on this the day and year above written, viz. September 4th 1865. Boatright respectfully represents unto your honorable court that on the fourth day of September AD 1865 in pursuance of an order from your Honorable Court, a family meeting was convoked and held before W. C. Smith, Parish Recorder and Ex Officio Notary Public for said Parish for the purpose of deliberating and advising upon the property of selling a certain tract of land to wit: the W ½ of SE qtr. And E ½ of SW qtr. Sec. 8 Township 21 North of Range one West belonging to the above mentioned minors. Petitioner prays your honor that the proceeding of said family meeting be homologated and that an order issue from your Honorable court authorizing petitioner to sell said tract of land on a credit of twelve months as recommended after duly advertising and all the legal delays and finally for all other orders and decrees necessary in premises and for general relief. State of Louisiana 11th Judicial District Court Parish of Union By reason the law and of the evidence in this case and by further reason of the reconsideration of a family meeting duly convoked before Wm. C. Smith, Parish Recorder and Ex Officio Notary Public, it is hereby ordered and decreed that the following tract or parcel of land to wit: the W ½ of SE ¼ and E ½ of SW ¼, Sec. 8 Township 21 N of Range 1 West belonging to the minors William W. and Sarah J. C. Boatright be sold on a credit of twelve months after having been duly advertised according to law and that the Tutrix of said minors, Martha J. Boatright, be and she is hereby authorized to make the said sale. It is further ordered that the proceedings of the family meeting held in the case be approved and homologated in all its parts. Done and signed in office on this 5th day of September AD 1865. Thos. C. Lewis Clerk, District Court State of Louisiana Parish of Union Be it remembers that on this the fourth day of October AD Eighteen Hundred and Sixty Five in pursuance of an order from the 11th Judicial District Court in and for the aforesaid Parish, I, Martha J. Boatright, Tutrix to the minors, offered for sale on a credit of twelve months to the last and highest bidder at public auction the following described tract or parcel of land to wit and the West half of South East quarter and East half of South West quarter, Section Nine, Township twenty one, North of Range one West situated in the Parish of Union and containing in all one hundred and sixty acres with all improvements thereunto belonging as the property of said minors. Whereupon John F. Futch became the purchaser for the sum of three hundred dollars, executing his note accordingly. All rights and titles vested in said minors is hereby conveyed and transferred unto the said John F. Futch a special mortgage and venders privileges being retained. In testimony whereof, I, Martha J. Boatright, Tutrix together with said purchasers hereunto sign my name officially in the presence of lawful witnesses on this day and date above written. ATTEST M. J. Boatright E. J. Pierce Tutrix R.
