Callaway was born on 25 August 1825 in Alabama, the son of William Abner Callaway and Aseneath (Cenith) Cleveland. The 1849 California Gold Rush lured Allen M. Callaway and his brother Francis W. Callaway to the Spanish Canyon in El Dorado County California, where in November 1850 they were mining for gold. We do not know how long Allen and Francis remained in California. Allen's older brother Larkin Cleveland Callaway settled in southern Union Parish in the 1840s, and Allen joined him there in the 1850s. Allen married Mary Ann Manning (29 Oct 1835 - 3 Mar 1915) on 15 January 1857 in Union Parish. Allen was elected as the Union Parish Sheriff in the latter 1850s, apparently in 1858 or 1859, and he served in this capacity until early 1861. When the War Between the States broke out in 1861, a group of about forty or fifty Union Parish men, including Allen M. Callaway, left the parish to join the Confederate Army. These Union Parish men went south to Camp Moore in what is now Tangipahoa Parish, combined with a similary number from Sabine Parish to form a company of about one hundred soldiers, and they styled themselves the "Union and Sabine Rifles". The men elected Allen M. Callaway as their 1st Lieutenant, and they became Company A, 6th Louisiana Infantry Regiment on 4 June 1861. The 6th Louisiana immediately went to Virginia, where they joined General Thomas "Stonewall" Jackson's Brigade in the spring of 1862. They participated in his Shenandoah Valley Campaign that summer. Company A's captain, Authur McArthur, was promoted to major of the regiment on 9 May 1862. McArthur's promotion led to Company A holding an election for captain, with a majority of the men voting for Allen M. Callaway. Callaway led his men that summer through the fighting at the Battle of Port Republic (June 9), Hundley's Corner (June 26), Gaines' Mill (June 27), Bristoe Station (August 26), Kettle Run (August 27), 2nd Bull Run (August 29-30), and Chantilly (September 1). The men of the 6th Louisiana saw heavy fighting at the Battle of Sharpsburg on September 17. Among those killed in action were Captain Allen M. Callaway's Succession: ================================================================================== To the Honorable the Judge or the Clerk of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana. The petition of J. C. B. White, a resident of your Parish and State aforesaid respectfully represents unto your Honor that Allen M. Callaway, late of the same residence is lately deceased in the Army of the Confederate States dying intestate. That he left a small property somewhat involved and a considerable amount of unsettled business. Petitioner represents that he is security on the official Bond of the said deceased given when deceased was commissioned himself [sheriff] of the Parish of Union which bond has or ever been concilled [sic] and upon which petitioner is informed then and still large outstanding liabilities. He advises that Administration of the Estate is necessary and indisputable. Wherefore, he prays that this his application be advertised according to law and after the legal delays, petitioner be appointed Administrator of the Estate of said Allen M. Calaway, Decd., in accordance the requirements of law, that an appraisement and inventory of said Estate be ordered and for all further orders and desires necessary in the pursuance and for general relief &c. State of Louisiana 11th District Court Parish of Union The premises considered it is ordered, Judged and decreed that the petitioner's application be advertised according to law, further that W. C. Smith, Parish Recorder proceed to make an inventory and appraisement of all the property belonging to said estate and due return thereof make to this office without delay. Guthrie, Clerk State of Louisiana 11th District Court Parish of Union The premises considered and by reason of proper advertisement having been made and no opposition filed thereto, it is ordered and decreed that J. C. B. White be appointed administrator of the Estate of Allen M. Callaway, Decd. and upon his giving bond and good security and to taking the oath prescribed by law, letters do issue to him. White, do solemnly swear that I will faithfully and impartially discharge all and singular the duties incumbent on me as Administrator of the Estate of Allen M. Callaway 11th District Court Parish of Union, Louisiana Whereas J. C. B. White has been duly and legally appointed Administrator of the Estate of Allen M. Callaway, Decd. and he has taken the oath and [unreadable] according to law. Now, therefore, the said J. C. B. White is hereby duly and legally authorized and empowered to do and perform all acts appertaining to said appointment according to Law. Given under my hand and seal of said court Feb. 9, 1863. J. L. Guthrie, Clerk State of Louisiana Parish of Union Know all men by these presents that J. C. B. White as principle and Benj. Tubb and James Edmunds as his security are held and firmly bound unto W. B. Egan, Judge of the 11th District Court or his successors in office in the just and full sum of [blank] dollars to the well and faithful payment thereof well and truly to be made. We bind ourselves, our heirs and assigns together with the legal representatives firmly by these presents. Dated Farmerville, Feb 9th 1863. The condition of the above obligation is such that whereas the said J. C. B. White has this day been duly and legally appointed administrator of the Estate of Allen M. Callaway, Decd. and he has taken the oath required by law. Now therefore if the said Jno. C. B. White shall faithfully perform all the acts required in said capacity as Administrator and shall faithfully account to the Judge of said court for all his acts and doings in and about said Estate and shall a true and correct account make to the judge of said court of all the monies or other property received from this or any other state and whereas legally required so to do pay over all sums of money or other property to the proper person or persons to receive the same. White of your aforesaid Parish and State respectfully shows that having been appointed Administrator of the Estate of A. M. Callaway, Decd., he finds the same to be largely in debt perhaps insolvent and he therefore rays for a sale of the effects of said Estate according to law to pay the debts of the same. Wherefore prays for an order of court authorizing him to sell all of the property of the said Estate or as much as shall be necessary to apy the debts of the same in accordance with articles 990 and 991 of the Code of Practice and for all orders and desires necessary in the premises and for general relief &c. White, Administrator, after making the legal advertisements do proceed to sell the property of the Estate of A. M. Callaway, Decd. according to acts 990 and 991 C. P. 1st the perishable, then the real or so much of the same as shall be found necessary to apy the debts of said Estate. Done in office on this Feb 10th AD 1863. J. L. Guthrie, Clerk State of Louisiana Parish of Union Be it remembered that pursuant to an order of the 11th Judicial district Court in and for the above written Parish and State authorizing the sale of all the property of the Estate of A. M. Callaway, Decd. for the payment of the debts of said Estate having made the legal administration to wit by posting said advertisements at the court house done and at two other public places in said Parish for more than thirty days to wit: from Feby 10th 1863 to March 14th 1863, there being no newspaper published in said Parish at the time which said advertisements is thereto annexed and having in accordance with said advertisements at the time and place therein named announced the terms of sale according to the code of Practice Arts. 991 & 990. I did then and then to wit on the 14th of March AD 1863 offer at Public seat pay all the property of said Estate when Lewis Feazel became the purchaser of the Boy Surry, a slave for life for the sum of eighteen hundred and one dollars cash. He being the highest and last bidder. The other property being offered and no one bidding, the appraisement, I proceeded to unadvertise according to law to be sold on the 4th day of April 1863 which advertisement having been legally posted at the Courthouse [unreadable] two other public places is also hereto annexed in accordance with which having annexed the terms of sale on the Fourth day of April AD 1863 at the Court house door. I again offered the property this advertisement when C. Lassiter became the purchaser of the place known as the late residence (with the land included) of A. M. Callaway, Decd. described as follows: Ten acres in the SE corner of Section 30, Township 21 also the SW ¼ of the SW ¼ of Section 27 Township 21 containing 40 more or less, also NW ¼ of Section 32 Township 21 except a strip one acre wide across the west side of said 40 acres containing 2/3 acres and leaving a balance of 33 1/3 acres. All said land being in the aggregate 83 ½ acres lying and being in Union parish, La. North of Range 1 East for the sum of eight hundred Dollars for which he has executed his note payable April 4th 1864 with security. Now therefore, the aforesaid purchasers having complied with the terms of sale, I in my aforesaid capacity as Administrator of the Estae of A. M. Callaway, Decd. do hereby adjudicate [unreadable] in sell and deliver the said property to the aforesaid purchasers respectfully to have and to hold the same premises at the same time reserving a special mortgage and vendors privelege on the aforesaid house and land to [unreadable] payment of the price of the same.
