To the Hon’l Judge of the 34d Dist. Court holding sessions in and for Union Parish, La. The petition of Mrs. Helen Carroll a resident of Union Parish, La would respectfully represent unto you Hon’l Court that her husband Abe. A. Carroll departed this life in your aid Parish on January 2, 1893, intestate and leaving a small estate comprised of both really and personally and which is all community property that belonged to petitioner and her deceased husband and the same is all situated in Union Parish, La., where the Dec’d resided. She avers that she is the surviving widow in connection with Dec’d and is entitled to the administration of his Estate and she desires to administer on said Estate with the benefit of Inventory. She avers that there are four minor children issue of her marriage with Dec’d to wit: Garland, Maude Rena, Cleo, and Carl Carroll. She avers that they are in necessitous circumstances as well as petitioner and it is necessary that and administration be had of said Estate and an Inventory taken according to law. Wherefore she prays that an order issue out of your Hon’l Court directing that B.F. Pleasant a Notary Public duly qualified and acting in and for Union Parish, La., to take a immediate inventory and cause an appraisement to be made of all the property belonging to the Estate of A.A. Carroll, Dec’d according to law. That petitioners application to administer be duly advertised for a period of ten days and if no opposition be made thereto that she then be duly appointed Administratrix of said Estate and that Letters of Administrationship issue to her on her giving bond with approved security in such an amount as the law requires. Jamison and J.W.(unreadable) & as securities are held and firmly bound unto Hon’l Allen Barksdale, Judge of Third District of Louisiana in and for the Parish of Union, Louisiana, or his successors in office in the just and full sum of Eleven Hundred Dollars, to the true and faithful payment of which we bind ourselves, our heirs, administrators, and legal representatives firmly and in solido by these presents. Dated at Farmerville, La. on this the 26th day of January A.D. 1893 The condition of the above obligation is such that whereas the above bound Mrs. Helen Carroll has this day been duly and legally appointed Administratrix of the Estate of A.A. Carroll, deceased, and she has taken the oath required by law. Now therefore if the above bound Mrs. Helen Carroll as principal shall faithfully and impartially discharge all of the duties incumbent on her as Administratrix of said Estate and shall render to the Court a true and correct account of all sums of money and deliver all the property of whatever nature that she may have in her hands belonging to said Estate to the proper person or personas to receive the same, then this obligation to be null and void, otherwise to be and remain in full force and effect, according to law. A. Carroll, Deceased according to law and according to the best of her knowledge and understanding, so help her God. Ward Four State of Louisiana Parish of Union Third District Court This shall certify to all whom it may concern, That on the 14th day of January A.D. 1893, an application was made to the Honorable Judge fo the said District Court, in and for Union Parish, La., by Mrs. Helen Carroll, praying that she might appointed Administratrix of the Estate of Ab. A. Carroll, deceased and she has this day been duly and legally appointed Administratrix of said Estate and she has given bond with good and solvent security and taken the oath required by law. Now, know ye, that Mrs. Helen Carroll has been and she is hereby appointed Administratrix of said Estate and that she has fulfilled all the requisites of the law. Witness our hand and seal of said Court, on this the 27th day of January A.D. 1893 Jas. M. Smith, Clerk, District Court To the Hon’l Judge of the 3rd Dist. Court in and for Union Parish, La. The petition of Mrs. Helen Carroll, Administratrix of the estate of A.A. Carroll Dec’d and a resident of Union Parish, La., would respectfully represent unto your Hon’l Court, that said Estate owes some debts that is the cost of these Mortuary Proceedings and also the widow claims a debt of a Thousand Dollars as being in necessitous circumstances and it is necessary to sell all the property both real and personal belonging to said Estate in order to pay said debts, and petitioner desires an order of Court authorizing her to sell said property for cash to the last said highest bidder and for not less than two thirds of the appraisement . She avers that some of said property is perishable & should be sold without delay. Therefore, she prays that an order issue out of your Hon’l Court authorizing her to advertise for sale all the property belonging to the Estate of A.A. Carroll in the Gazette for not less than thirty days and on Wednesday, the 19th day of April, 1893, to sell to the last and highest bidder for cash and for not less than two thirds of the appraisement all the property real and personal belonging to the Estate of A.A. Carroll Dec’d and due return of her process verbal thereof she make to this Court according to law. She prays for all necessary orders and for general relief. Carroll Dec’d #82 Be it remembered that Helen Carroll, Administratrix of the Estate of Ab. A. Carroll Dec’d pursuant to an order of the Hon’l Third Dist. Court authorizing and commanding one to sell all of the property belonging to the succession of Ab. A. Carroll Dec’d, did on Wednesday, April 19th, 1893, after having duly and legally advertised said sale for more than thirty days in the “Gazette” a weekly newspaper published at Farmerville, La. proceed to the late residence of the deceased where the property was situated and after reading the advertisement and order of sale and announcing the sale and terms thereof in an audible voice I proceeded to offer all of said property belonging to the Estate at public outcry between the hours of eleven o’clock a.m. and two o’clock p.m. to the last and highest bidders for cash and after crying the same for a sufficient length of time the following persons purchased property for the terms set opposite their name: Mrs. Helen Carroll the surviving widow in community—with the deceased bought the following: One Sorrel mule $125.00 One Iron Gray mule 25.00 One wagon & harness 25.00 90 bsh corn @ .5c 45.00 11 head cattle @ $5.00 each 55.00 12 head hogs 8.00 Chickens and fowls 2.50 Household and kitchen furniture 75.00 Plow tools and grind rock 4.00 Cotton seed of 4 Bs 8.00 2050 brick 12.50 500 stalks sugar cane 5.00 Lumber 5.00 Also one hundred and twenty acres of land, the late residence of the deceased described as follows: the North half of the North-East quarter and the South-East quarter of the North-East quarter of Section Twenty-one (21) Township Twenty Three (23) North Range Two (2) East situated in Union Parish, La. and containing One hundred and Twenty acres together with all the improvements thereon situated and belonging thereto for $300.00 Three Hundred Dollars Total $695.00 Which amount of Six hundred and ninety-five dollars the said widow reclaims in her hands until the Estate is finally settled she desiring it to be applied toward the payment of the One Thousand Dollars secured to her out of her deceased husband’s Estate she being in necessitous circumstances, Now, therefore Mrs. Helen Carroll Administratrix as aforesaid do hereby bargain, sell, transfer, convey and deliver unto Mrs. Helen Carroll all of the aforesaid property purchased by her. The petition of Mrs. Helen Carroll Administratrix for the Estate of Ab. A. Carroll Dec’d would respectfully represent unto your Hon’l Court that she has administered said Estate to the best of her ability and presents herewith her final account as Administratrix and avers that the same is correct and she desires that the same be duly homologated. She charges herself with the total inventory amounting to Eight Hundred Forty-Four and 70/100 Dollars and also with an amount she collected from T. J. Roark over the appraisement of Twenty-three and 20/100 dollars making the total charges amount to Eight Hundred Sixty-seven and 90/100 dollars. She avers that the debts of the Estate except ordinary debts amount to only one hundred seven & 95/100 dollars which she has paid and presents her receipts for same herewith numbered from one to five inclusive. Petitioner avers that she is the surviving spouse of deceased and all their property was community property and she is in necessitous circumstances and desires to retain and does retain the balance of seven hundred fifty-nine and 95/100 dollars in her hands as being widow in necessitous circumstances and which amount she desires to hold in (unreadable) there being several minor children of her husband and your petitioner. Wherefore she prays that this final account be ordered duly advertised as the law requires and on a final trial hereof that the same be approved and duly homologated in all its (unreadable) and that there be judgment thereon and petitioner be recognized as a widow of deceased A.A. Carroll and as being in necessitous circumstances and entitled as such to the balance of Seven Hundred Fifty-Nine and 95/100 Dollars remaining in her hands as administratrix and that her bond as administratrix be cancelled. Court Union Parish Louisiana Estate of A.A. Carroll Dec’d No. 82 Before me the undersigned legal authority personally came and appeared Mrs. Helen M. Carroll, who being by me duly sworn deposes and says she is the administratrix of the estate of Ab. A. Carroll, Deceased, and the surviving spouse in community with him. She further states that she has duly administered said Estate to the best of her understanding and ability. That she charges herself with the total inventory amounting to Eight-Hundred Forty-Four and 90/100 Dollars and also with an excess collected on T.J. Roark’s account amounting to Twenty-three and 20/100 dollars, making total charges amount to Eight Hundred Sixty-Seven & 90/100 dollars. That the debts of said estate are small only amounting to One Hundred Seven & 95/100 dollars for the privileged debts which she has already paid and produces the vouchers from one to five inclusive for same. She further states that she is a widow of deceased in necessitous circumstances and that she has five minor children of deceased Robert G., Maude Irene, Lulu Cleo, Albert Carlton, Mary Frances Carroll all dependent on her for a support and that neither she nor either of said minor children own any property in their own names and she desires to retain the balance of the funds of said Estate amounting to Seven Hundred Fifty-Nine and 95/100 Dollars in her hands as being due to her and the minor children being in necessitous circumstances. That she files herein her receipt for said sum. That her final account filed herein is correct and she desires the same homologated and her bond as Administratrix of the Estate cancelled. Carroll, Dec’d Evidenced adduced in open court on the application to homologate the final acct of Admrx. This Feby 7, 1895 Jas. M. Smith, sworn for admix says: I am Clerk of Dist. Court in & for Union Parish, La. That a notice of the filing of the final account of Admrx was advertised by publication in the “Gazette” a weekly newspaper published in the town of Farmerville for that issue being more than ten days prior to this date & that no opposition was made thereto and filed in my office. Affidavit of Admrx filed in evidence herein & marked “A” Vouchers No.s 1 to 6 inclusive enclosed in an envelope & filed in evidence herein by Admrx & marked “B.” Evidence closed Feby 7, 1895 I hereby certify the above one page contains all of the testimony and evidenced addressed in open court together with a note of the filing in evidence of all documentary evidence filed in evidence herein on the trial of application to homologate the Final Account of the Admrx of said Estate given under my hand and seal of office this February 7th, 1895 Jas. Carroll, Dec’d No. 82 In this on a trial of the homologation of the final account of Mrs. Helen Carroll, Admrx and no opposition having been filed and by reason of the law and the evidence being in favor thereof it is ordered (unreadable) and decreed that the final account of Mrs. Helen Carroll, Admrx filed on January 9th, 1895, be approved and homologated in all its parts and made the judgment of this court. It is further ordered and decreed that the balance in the Administratrix hands amounting to Seven Hundred Fifty-Nine and 95/100 Dollars belonging to the minor children be turned over to the widow as (unreadable), and that her bond as Administratrix be cancelled.
