Carson (1809 - 23 Sept 1859) was a partner with John A. Bayless (27 Mar 1812 - 8 Oct 1857) in the Farmerville mercantile firm of Carson & Bayless during the 1850s and perhaps 1840s. Carson ================================================================================= State of Louisiana Parish of Union Be it remembered that pursuant to an order of the 12th Judicial District Court in & for the above written Parish & State Authorising the sale at auction of a sufficient amount of effect of the Estate of James H. Carson, Decd. to pay the debts of said estate. The Personal Property for cash & real property on a credit of 12 months, purchasers giving their notes with approved security bearing eight per cent Int. from date & a special mortgage & vendors privilege reserved upon the property to secure the Payment of the price of the same. Having made the legal advertisement by publishing the same in the “Union Democrat” a newspaper published in Union Parish aforesaid for more than thirty days press to the day of sale and having publickly read the said advertisement and announced specially the terms of sale as above to those present at the court house in said Parish on Monday November 28, 1859, I then & there proceeded to offer for sale in accordance with the said terms to the last and highest bidder the following personal property. When after causing the following persons being the last and highest bidders became the purchasers of the following property respectively. D. M. Davis Bot 1 Bay Horse 110.00 And sale amounting in all to Two Hundred and sixty one & 80/100 Dollars and each and every of the aforesaid parties having complied with the terms of the sale. I have delivered to each the property purchased as aforesaid. In Testimony whereof I have hereunto signed my name in my aforesaid capacity as Adm. On this the 31st day of December AD 1857. John L. Of the Inventory of said estate of James H. Carson, Decd. made by William C. Smith Parish Recorder & c dated October 5th 1859 & filed in the clerks office on the 11th of October AD 1859 amounting to the sum of Forty eight thousand Two Hundred & Twenty & 88/100 Dollars $48,227.88. He further charges himself with interest on Sums collected by him which items do not appear in inventory but are shown by Skedule A files herewith amts. $43,226 ½ 216.13 He charges himself with amt. Of sale of negroes over their appraised value 13800 ½ 69.00 He charges himself with amt. Of sale of personal effects of Time over & above the appraisement of same $267.49 ½ of which is due by him 133.74 John M. Barrett Administrator In acct. with the Estate of James H. Carson, Decd. The admr. herewith returns certain property found in the Inventory of said Estate for which he claims credits as Follows: Of Individual Effect of said Estate 1st House & Lot known as the Bailey residence returned as appraised @ 1400.00 2nd The Old Store House in Farmerville returned as appraised @ $1700.00 3rd Negro Boy Edmund returned as appraised @ 1500.00 4th Invoice of stock of Gords[?] claimed to be due by estate of Jno. Smith Tract of Land appraised @ 273.20 2nd The mill tract of Land appraised @ 2988.17 ½ of which is 1494.09 3rd The J. Crawford Tract appraised [unreadable] 73.91 1841.29 4th He returns a list of Judgments found after the Inventory as per schedule B which amounts in the aggregate to 2258.52 the one half of which 1129.21 1129.23 Amt. of credits brot. Forward 8373.82 5th He returns a list of Judgments which he had obtained on claims found on the Inventory for the ½ of which he has charged upon the Invtys. & for which ½ he claims a credit See Skedule C amounting to 7423.42 & ½ of which is 3711.71 6th He returns a list of claims Inventory as good See Skedule D amounting to $44512.30 with the one half of which he is charged for which he claims credit of 22257.19 7th He returns a list of claims Inventoried as worthless or doubtful as per schedule E amounting to 8416.30 with one half of which he has been charged & now asked a credit 3208.15 8th He returns a list of notes taken at the sale of the property of the estate as per schedule H amounting to 5750.12 for ½ of which he claims a credit 2365.06 9th He shows as per schedule G that certain errors were made in the Inventory amting in all to the sum of $1114.30 the Half of which is $507.19 for which he claims a credit 507.19 Amt. Forward $40637.12 10th He has paid debts of the said estate amounting as per schedule H & accompanying voucher from [unreadable] Inclusive 3621.86 11th The amount for which the land sold for less than its appraisement is 809.75 for one half of which he claims a credit 404.85 44663.86 To the Honorable the Judge or the clerk of the 12th Judicial District Court in & for the Parish of Union State of Louisiana. The Petition of Jno. L. Barrett Adm. Of the estate of James H. Carson Decd. of the Parish & State aforesaid respectfully shows that in obedience to an order of your honorable Court bearing date April AD 1860, you Petitioner does now hearwith file this as his full final and complete account of his acts and doings as Admr. of aforesaid. That from this his said account it appears that petitioner is chargeable with Sundry Sums amounting in all to Forty eight Thousand Six Hundred & Fort six 75/100 Dollars. That he is entitled to a credit for sundry sums returned and for debts paid amounting in all to Forty Four Thousand Six Hundred & Sixty Nine Dollars & eighty six cents which leaves a balance due by petitioners of Three thousand nine hundred and eighty & 87/100 Dollars. Petitioner further vows that not having heard from the crops of cotton appraised upon the Inventory he has accounted for it at the amount of the appraisement to wit ($750.00) seven hundred and fifty Dollars with one half of which he is charged to wit ($325.00. He therefore prays that he have & recover back of the estate of Jas. H. Carson Decd. the difference between ½ the appraised Value of said cotton as per inventory and the ½ of the net proceeds of same as per account sales when the same shall be produced. Wherefore petitioner prays that this account be advertised according to Law that E. H. Brigham wife of Geo. W. Brigham be duly witnessed and cited according to Law and after the legal advertisement and delays this account be approved and Homolgated in all its Part. That the Admr. be ordered to pay over to the said E. H. Carson wife as aforesaid and sole heir of Estate of J. H. Carson decd. all and singular the effects of said estate and take receipts for the same and upon his producing the said receipts to the clerk of this court his bond as Admr. be cancelled. He further prays for all orders and discuss necessary in the premises and for general relief. Jno. L. Barrett per se State of Louisiana 12th Judicial District Court Parish of Union In the motion of the succession of James H. Carson Decd. the previous considered. It is hereby ordered adjudged and decreed forgoing final account of Jno. L. Barrett admr. be advertised according to Law and that the Heirs of said estate have due and legal notice of the same. Bayliss Admirx. examing and adjusting the merchandize acct. of the firm of C. & B against Est. of Jno A. Bayless marked “A” notice same account as A. No. 2 said acct. being appraised on the Inventory at $34276.03 added to acct. marker B note appraised as all find that by compensating them two accts. Property with acct. “6” due by C & B to estate Jno. A. Bayless the real amt. due by the estate of Jno. A. Bayless to C & B is on the 1 Jany. 1859 $25,666.52 see settlement between C & B & Estate Jno. Bayless marked “H” for the purpose of settlement the admr. charges himself with one half of the above acct $12,833.26 He also charges himself with ½ of a Bal. of mistakes in final acct. amt. to $109.69 ½ is 54.84 He charges himself with reduction on comm. To the Honorable the Judge of the 12th Judicial District Court in & for the Parish of Union, State of Louisiana. The petition of Jno. L. Barrett adm. Of the Estate of James H. Carson Decd. respectfully shows that he has filed his final account as administrator of said Estate but that he has since discovered some slight Errors in the same to correct which accounts for other purposes which follow he prays to be allowed to file this his supplemental account in which the errors aforesaid are corrected. In this account petitioner charges himself with the amount of the Balance that appears against him in the final account aforesaid to with: Thirty nine hundred and eighty two & 87/100 Dollars ($2982.87) also with other sundry claims that he assumes for the purpose of adjustment & settlement viz. Deft. due by the Estate of Jno. A. Bayless to the firm of Carson & Bayless $25,666.52 with the one half of which he charges himself (say $12,833.26) & deft. due by J. H. Carson Est. to firm of Carson & Bayless $2740.49 with the ½ of which he charges himself (say $1370.24 amtg. In all to $18,437.53) Eighteen thousand four hundred & thirty seven & 53/100 Dollars which includes sundry other items set forth in this foregoing accounting. Petitioner claims accredits for assets returned and for debts paid as set forth in the foregoing accounts amounting in the aggregate to $14,219.30 Fourteen Thousand Two Hundred & nineteen & 30/100 Dollars leaving a bal. due by Admr. to estate of J. H. Carson of $4218.23 Four Thousand Two Hundred & Eighteen & 23/100 Dollars including the amount of $3982.87 due on final account of which this is a supplement. Petitioner further represents that he is admr. of the Estate of James H. Carson & Mrs. A. D. Bayless Admx. of the Estate of Jno. A. Bayless being the legal representation of the late firm of Carson & Bayless as well [unreadable] of the aforesaid Estate have carefully liquidated all claims aggregating between the estate of Jas. H. Carson & est. of Jno. A. Bayless and also between each of the said Estates & the late firm of Carson & Bayless and these liquidated they find on the first of January 1859. The estate of Jno. A. Bayless was due the firm of Carson & Bayless the sum of Twenty Five thousand six hundred sixty six & 52/100 Dollard (25666.52) and the Estate of Jas. H. Carson is due the firm on the same date to wit: Jany. 1859 the sum of ($2740.49) Twenty Seven Hundred and forty & 49/100 Dollars. This latter debt was then settled paid & extinguished by compensation or [unreadable} an equal amount of the debt due by the Estate of Jno. A. Bayless to firm of Carson & Bayless which amt. $2740.49 deducted leaves that Estate due the firm of Carson & Bayless $22,926.83 Dollars Twenty Two thousand nine Hundred & Twenty six & 83/100 Dollars on the first of Jany. 1859. They further pray that the estate of James H. Carson Decd. on the first of Jany. 1860 was indebted to the estate of Jno. A. Bayless in the sum of Twenty eight hundred and fifty six & 95/100 Dollars which amt. is compensated paid and extinguished by giving credit for the said amt. $2856.95 on the part to wit the undivided half of the debt due by the estate of Jno. A. Bayless to Carson & Bayless which reduces the said debt by $2715.90 to 17,212.13 seventeen thousand Two Hundred & Twelve & 13/100 Dollars besides interest 1 year shich is $1140.30 which added makes $18358.43 Eighteen thousand treen Hundred & fifty Eight & 43/100 Dollars due Jan 1, 1860 the one half of which is the amt. due to the estate of Jas. H. Carson from Estate of Jno. A. Bayless viz. Wherefore he prays that E. H. Carson wife of G. W. Brigham be duly notified or cited hereto as well as A. D. Bayless Admx. and all others in interest that this acct. be advertised according to and after the legal delays that the same with the account Final filed June 1860 which is a part of this & to which this is a supplement be approved and homolgated in all its [unreadable] in every particular that then be Judgment for four Thousand Two Hundred & Eighteen & 23/100 Dollars as shown by said account against Jno. L. Barrett adm. And further for the sum of $9979.22 nine thousand one hundred and seventy nine 22/100 Dollars against the estate of Jno. A. Bayless & in favor this Estate of Jas. H.
