The petition of William P. Cherry, a resident of your said Parish and State respectfully represents unto your honor that he is the paternal uncle of the following six minors orphaned to wit: Maranda J., Mary D., John C., Oliver H., Sarah V., and Allen R. Cherry, who as heirs of Allen W. Cherry were owners of a small estate which heretofore has been administered by their mother, Lettitia Cherry as Natural Tutrix. Petitioner represents that by the death of the said Tutrix, the said minors have been deprived of any legal representatives. He further prays that he may be, being the nearest relation in the ascending line, appointed Tutor to said minors and that Henry Barren be appointed Under Tutor, and such other orders &c as may be necessary. He prays that an order be issued to the Recorder of Morehouse Parish where said property is situated to make an inventory according to law of the property of said minor heirs of Allen W. Cherry and of the property left by the said deceased Tutrix of the said minors for the purpose of delivering the amount of Tutor’s bond to be given. H. Regengurg, Atty. State of Louisiana 11th Judicial District Court Parish of Union The premises considered, it is ordered and decreed that the Parish Recorder in and for the Parish of Morehouse, Louisiana be and he is hereby authorized to make an Inventory according to law of all the property belonging to the minor heirs of Allen W. Cherry, Decd. and of the property left by Lettitia Cherry, the Natural Tutrix of said minors and return thereof make to this office without delay. Cherry do solemnly swear that I will faithfully and impartially discharge all the duties incumbent on me as Tutor to the following minor heirs of the Estate of Lettitia Cherry, Decd. to wit: Maranda J., Mary D., John C. Oliver H., Sarah V. and Allen R. Cherry according to the best of my ability and understanding. So help me God. Wm. P. Cherry Sworn to and subjugated before me on this the 29th day of October AD 1861. Cherry has been duly and legally appointed Tutor to the following minor heirs of the Estate of Lettitia Cherry, Decd. to wit: Maranda J., Mary D, John C., Oliver H., Sarah V. and Allen R. Cherry and taken the oath prescribed by law. Given under my hand and seal of said Court this 24th day of October 1861. Jas. L. Guthrie, Clerk State of Louisiana 12th Judicial District Court Parish of Union Know all men by these presents that we Wm. P. Cherry as principal and J. D. Barron his security are held and firmly bound unto W. B. Egan, Judge of the 12th Judicial District Court in and for the Parish of Union and State of Louisiana for the time being or to his successors in office in the full and just sum of Seventeen Hundred and one Dollars, the true and faithful payment whereof well and truly to be made. We bind ourselves, our heirs and assigns, administrators, executors and legal representative firmly by these presents. The condition of the above obligation is such that whereas the said William P. Cherry has been duly and legally appointed Tutor to the following minor heirs of the Estate of Lettitia Cherry, Decd. to wit: Malinda J., Mary D., John C., Oliver H. Sarah V., and Allen R. Cherry. And he has taken the oath prescribed by law. Now, therefore, if the said W. P. Cherry shall faithfully and impartially discharge all the duties incumbent on him in his said capacity and shall faithfully account to the Judge of said Court all monies or property received from this or any other State and shall render yearly to the Judge of said Court a true and faithful account of all his acts and doings in and about said matter of Tutorship and shall for the faithfully look after the body of said minors and study their interest in all things and shall whenever legally required so to do pay over all sums of money and deliver all the property of whatever nature to the said minors or to their legal representatives or to the proper person or persons to receive the same, then the above obligation to be null and void. Otherwise, to remain in full force and effect against the principal and his said securities. Done, signed and acknowledged on the 24th day of October 1861. ATTEST: Wm. P. Cherry Jas. L. Guthrie, Clerk J. D. Barron State of Louisiana Parish of Union Be it known that on this the 2nd day of October AD 1861 that I, Isaac T. Naff, Recorder and Ex Officio Notary Public duly commissioned in and for said Parish by virtue of an order to me directed from the Hon. 12th Judicial District Court in and for the Parish of Union commanding me to make an inventory and appraisement of all the property to be found in this Parish belonging to the Succession of Mrs. Lettitia Cherry, Decd. and due return to make as the law directs. I, the said Recorder in pursuance to said order proceeded to appoint W. C. Sharp and Warren Felton men of lawful age and residing in this Parish to act as appraisers of said property to whom I administered the following oaths to wit: We and each of us do solemnly swear that we will a true and impartial appraisement make of all the property pointed out to us as belonging to the Succession of Mrs. Lettitia Cherry, Decd. to the best of our knowledge and belief. This done and signed this the 2nd day of October AD 1861 in the presence of John B. Naff and R. R. Vinson, witnesses hereto of lawful age and residence who have signed with said appraisers and me the said Recorder. Cherry, resident of said Parish, Tutor to the minor children of [blank] Cherry duly approved &c respectfully represents that there is a lot of personal property belonging to Heirs subject to loss, wasted and destroyed. About this he prays for an order to sell according to law said property being situated in Morehouse Parish. He prays the order to be directed to himself authorizing him to sell the same.
