The petitioner Marmaduke E. Daniel, a resident of the Parish and State aforesaid respectfully shows that George Clowe, a minor now living with his friend in the Parish of Morehouse has not tutor that petitioner is his uncle and as nearly related to the said minor any person living. That all of the said minors relations are anxious that petitioner should be appointed Tutor and move that said minor from the Parish of Morehouse where he is temporarily remaining to petitioner’s residence in the parish of Union together with his property which petitioner has finely consented to do. Wherefore he prays that this is application be advertised according to law and after the necessary formalities had that he be appointed by your Honorable court Tutor to the said minor that an inventory of said minor’s property be made and for all orders and decrees necessary in the premises and for general relief &c. Daniel to be appointed Tutor of the minor George Clowe be advertised according to law. Done and signed in office on the 23rd day of October AD 1865. Thos. C. Lewis Clerk, District Court State of Louisiana 11th Judicial District court Parish of Union The premises considered and by reason of due and legal advertisement having been made and no opposition being filed thereto, it is therefore ordered and decreed that Marmaduke E. Daniel be and he is hereby appointed and confirmed as tutor of the minor George Clowe and that upon his giving bond with good security and taking the oath prescribed by law that letters of tutorship do issue. It is further ordered he is hereby appointed Under Tutor of said minor and that upon his taking the required oath that Letters as such do issue to him. Daniel do solemnly swear that I will faithfully and impartially discharge all and singular the duties incumbent on me as tutor of the minor George Clowe according to the best of my ability and understanding. Daniel has this day been duly and legally appointed and confirmed as Tutor of the minor George Clowe and he has given bond with good security and has taken the oath prescribed by law. Now therefore the said Marmaduke E. Daniel is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to the said appointment according to law. Daniel as principal and James A. Creath and A. Pistote as his security are held and firmly bound unto Honorable J. D. Watkins, Judge of the 11th Judicial District Court in and for Union Parish, La. for the time being unto his successors in office in the just and full sum of Three Thousand seven hundred and fifty Dollars $3750.00 to the true and faithful payment whereof well and truly to be made we bind ourselves, our heirs assigns and legal representatives firmly by these presents. Dated at Farmerville, la. on this the 9th day of November AD 1865. The consideration of the above obligation is such that whereas the above bounden Marmaduke E. Daniel has been duly and legally appointed and confirmed as tutor of the minor George clowe and has given bond with good security and has taken the oath required by law. Now therefore if the said Marmaduke E. Daniel shall faithfully and impartially discharge all and singular the duties incumbent on him as tutor of the said minor and shall render to the Judge of the said court a true and correct accountant of his acts and doings in and about said Tutorship and shall faithfully look after the interest of the said minor in all things thereto appertaining and shall whenever legally required so to do pay over all sums of money and deliver all the property of whatever nature received by him belonging to the said minor to the proper person or persons to receive the same then this obligation to be null and void, otherwise to be and remain in full force and virtue against the principal and his said securities. It is hereby ordered, adjudicated and decreed that the Final Account of M. E. Daniel, tutor of the minor George W. Clowe hereto annexed be and the same is hereby approved and homologated and the said minor is entitled to receive from the said Tutor two thousand six hundred and eighty four 86/100 dollars to be paid Decr. 18th 1873 with five percent interest from that date. Am satisfied therewith and with the same homologated this September 23rd 1873. G. W. Clowe To the Honorable the Judge of the Parish Court of Union Parish, Louisiana. The petition of Marmaduke E. Daniel of your said parish of Union respectfully shows that he has this day filed his final account as Tutor of the minor George W. Clowe. That said account is complete and filed and shows a balance due by petitioner to the said minor on the 18th day of December next 1873 of Two thousand six hundred and eighty four 86/100 dollars. That said minor is now of full age and he having examined and approved this account and requested its homologation. Therefore petitioner prays that said account be approved and homologated and there be judgment in favor of said minor and against petitioner for the sum of Two thousand six hundred and eighty four and 86/100 dollars.
