Union Parish Louisiana Succession Book E, pp. 298 - 301 ================================================================================== To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, Louisiana. The petition of William P. Smith, a resident of your said Parish and of Amanda M. Cook, lately removed from the State of Texas to said Parish and State, respectfully represents that William A. Cook and Joseph D. Cook, minor children of Petitioner Amanda M. Cook are now visiting your said Parish, and have no tutor legally appointed to represent their interest. Petitioners represent that the said minors are as heirs of Joseph A. Cook, decd. owner of a considerable amount of property consisting of negroes and an interest in certain land in said State of Texas and that the interest of said minors requires that this negro property should be removed to this state and that a tutor be appointed to represent them. They represent that petitioner Wm. P. Smith is the maternal uncle of the above minors and prays that he may be appointed their tutor and that Joseph Baker be appointed under tutor. They herewith file a transcript of the proceedings had in the tutorship of said minors in the Circuitry Court of the County Trustee in the State of Texas duly certified by the proper office and in accordance with its terms of the Confederate States by reference whereto the amount of property belonging to each of said heirs may be ascertained for the purpose of compensating the amount of the Tutor's bond. They further pray that such that orders and decrees be rendered as the nature of the case may require. H. Regenberg, Atty. State of Louisiana 11th Dist. Court Parish of Union The premises considered it is ordered, that William P. Smith be appointed tutor of Joseph Baker, under tutor to the minors William A. Cook and Joseph D. Cook and that on the said Wm. P. Smith executing his bond according to law and they with taking the oath prescribed by law, letters be issued to them accordingly. Court Parish of Union Know all men by these presents that we, William P. Smith as principal and Joseph Baker and L. A. Coty as his securities are held and firmly bound unto Judge W. B. Egan in and for the Parish of Union and State of Louisiana for the time being or to his successors in office in the fully and just sum of Thirty thousand Dollars, the true and faithful payment thereof will and truly to be made in binding ourselves and heirs and executors, administrators and legal representatives firmly by these presents dated Farmerville, La., December 4th 1861. The condition of the above obligation is such that whereas the said William P. Smith has been appointed tutor to the following minors of the Estate of Joseph A. Cook, Decd. to wit William A. and Joseph D. Cook and he has taken the oath prescribed by law. Now, therefore if the said William P. Smith shall faithfully and impartially discharge all and singular the duties incumbent on him in his said capacity and shall faithfully account to the Judge of said Court for all monies or property received from this or any other state and shall render yearly to the Judge of said court a true and faithful account of all his acts and doings in and about said matter of Tutorship and shall faithfully look after the bodies of said minors and study their interest in all things and shall whereas legally required so to do [unreadable] of money or other property belonging to said minors of whatever nature to their or to their legal representatives or to the proper [unreadable] to receive the same then the above obligation to be null and void.
