The petition of William M. Lawrence a resident of your said Parish and State respectfully represents unto your Honor that Timothy Crane, late of a resident of your said Parish and State departed this life on the twenty eight of August AD 1845 intestate and leaving considerable property in your said Parish consisting of real estate, slaves, perishable personal rights and credits &c. And your petitioner would further represent unto your Honor that said succession is left vacant there being no heirs present or represented known to this your Petitioner. Wherefore your Petitioner prays your Honor that he may be appointed Curator of said succession, he would show to your Honor that himself and said Decd. Was engaged in Co-partnership in common in land, brick making and various other property, not in any manner of a commercial nature which Co-partnership he alleges give him the preference over all other applicants to be appointed Curator of said Estate and that your Honor cause an inventory and appraisement to be made of the property of the said succession and that an attorney be ppointed to represent the absent heirs, should there be any and that due legal notice be given of these proceedings and for such other orders and decrees as the nature of this case may require and for general as in duty bound for which he will ever pray &c. John Taylor Parish Judge State of Louisiana Parish of Union Know all men by these presents that we William M. Laurence as principal and B. Fuller, J. G. Fuller and A. Fuller his securities of the State and Parish aforesaid are held and firmly bound unto John Taylor, Probate Judge and his successors in office in the sum of Sixteen hundred dollars to the true and faithful payment thereof we bind ourselves to pay in current money of the United States unto him or his successors in office for the faithful performance of which we bind ourselves and each of us our and each of our heirs, Executors and administrators jointly and severally firmly by these presents renouncing all benefit or divisions or discussion whatsoever. Lawrence has been appointed curator of the vacant succession and Estate of Timothy Crane, deceased, late of said Parish. Now if he does well and truly according to law administer the same and farther does make and render a true, just and perfect account of his actions and doings when thereunto lawfully required either by the aforesaid Judge or his successors in office or by the heirs of said Deceased or their Attorney authorized, then and in that case this obligation to be null and void or else to remain in full force and virtue. Laurence, a resident of your said Parish and Curator duly appointed to administer the Estate of Timothy Crane, Deceased with respect represents unto your Honor that there is debts outstanding against said Estate which will have to be paid. He farther says that there is a considerable quantity of personal property belonging to said Estate which is liable to waste and decay. Wherefore he prays your Honor to order the sale of all of said personal effects after due notice as required by law and for all other and further orders which may be necessary in the premises for which he will ever pray as in duty bound &c. McMay account ___4.00 $565.78 The above amount of five hundred and sixty five dollars & 78 cents is all the ordinary claims that have come to the knowledge of your Petitioner. Petitioner avers that there is not sufficient funds on hand belonging to said Estate to pay all the debts against said succession as will be seen by the annexed statement affixed hereto and made part of this petition. Petitioner prays for an order allowing the above claims and that they be homologated after due and legal advertisements according to law. He prays that he be allowed to settle the sum of two hundred and ninety four dollars & 86 cts. after due advertisement and homologated privilege claims against said Succession. Petitioner avers and says that there is the sum of Five Hundred and sixty five Dollars & 78 cents of ordinary debts existing against said Estate besides the above sum of Two Hundred and ninety four dollars and 78 cents privilege claims. Petitioner avers that there is but the sum of Five Hundred and seventy Dollars and 81 cents available funds in favor of said Estates to pay the privilege and ordinary claims existing against said Estate. Petitioner says that there is but Two Hundred and seventy six Dollars and 75 cents left after paying the privilege claims to pay the above ordinary sum or claims against said Succession. Wherefore petitioner prays that he be authorized after due advertisements according to law to pay out what sums or amount he has in his hands besides a negro woman and child value or appraised at seven hundred and fifty dollars now in litigation according to ratio which is about fifty cents on the dollar. Bryan, Attys. ================================================================================== ================================================================================== Union Parish Louisiana Succession Book A, pp. 365 ================================================================================== ================================================================================== To the Honorable the Judge of the Twelfth District Court in and for Union Parish, Louisiana. The petition of William Larrence Curator of the Estate of Timothy Crane, late of your said Parish with respect represents unto you that the funds on hand belonging to said estate are insufficient to discharge the debts outstanding against the same as will appear by the statement of debts below by your petitioner in your honorable court. He further represents that they are two slaves belonging to the said Estate to wit: a Negro Woman Winny and her son Andy both slaves for life and that it would be greatly to the advantage of the said Estate to have the said negroes sold and the proceeds applied to the discharges of the said debt. Wherefore he prays your honor that the said property may be advertised and sold according to law and for all such reasons with the premises as the Nature of the case would require. Wm. M. Larrence, Curator Let the prayer of the Petition be granted and it is ordered that the property namely Winny, a negro Woman and Andy her son as discharged in the said Petition be sold for cash if the appraisement is offered.
