The petition of James D. Creath, a resident of your said Parish and State respectfully represents unto your honor that Nancy J. Creath, late wife of petitioner departed this life in the month of February last AD 1862 at the residence of Petitioner leaving a considerable property consisting of Real and personal rights and credits, the greater part being situated in the said Parish and State, the remainder in the Parish of Morehouse in said State and in the State of Tennessee. Petitioner represents that deceased died intestate and left within descendants nor ascendants but collateral relations only to inherit. He further represents that the property left by his said wife consists of community of Equity and claims made by the joint efforts of himself and the deceased. That an Inventory and Administration is necessary. Petitioner prays that an Inventory and appraisement be made of the effects of said succession as the Law directs and that he be appointed Administrator thereof after notice of this application shall have been given as required by Law. He prays for such other orders as the nature and or [unreadable] of the succession may require and for general relief &c. Jno. W. Creath to be appointed Administrator of the Estate of Nancy J. Creath, Decd. be admitted according to Law. It is further ordered that W. C. Smith, Parish Recorder and be and he is hereby authorized to make an inventory and appraisement of the property belonging to the said estate of Nancy J. Creath, Decd. and due return thereof made without delay. Done and signed in office this the 8th day of March 1862. James L. Guthrie, Clerk State of Louisiana 11th Judicial District Court Parish of Union The premises considered, it is ordered, adjudged and decreed that Mr. Naff, Parish Recorder & Ex Officio Notary Public in and for the Parish of Morehouse, State of Louisiana be and he is hereby authorized to make due inventory and appraisement of the property belonging to the estate of Nancy J. Creath, Decd. and the said Parish of Morehouse and due return make to this office without delay. Given under my hand and the seal of said Parish this the 22nd March 1862. James L. Guthrie, Clerk, District Court State of Louisiana Parish of Union The premises considered, it by reason of proper edict and having been made and no opposition being made, it is ordered and decreed that James A. Creath be appointed Administrator of the Estate as prayed for in this petition. It is further ordered that letters do issue to him upon his giving bond and taking the oath required by law. Creath shall faithfully Administer the said Estate and shall render yearly to the Judge of said Court an account of all his acts in and about said Estate and shall pay on all monies belonging to said estate or other property when legally required so to do to the proper person or persons to receive the same, then and in this case the above obligation shall be null and void, otherwise it will remain in full force and effect. Creath, a resident of the Parish and state aforesaid respectfully represents that he has been appointed Curator and administrator of the Estate of Nancy J. Creath, Decd., his late wife that said Estate consists of the community of assets and gains between petitioners and the said deceased existing at the time of her decease in Feb. last 1862 or portion of said community consists of the Inventory aforesaid made by Wm. C. Smith, Recorder and amounting to [blank] Dollars also of the Inventory of the said estate in Morehouse Parish amounting to [blank] Dollars and to a tract of land in Tennessee of which no Inventory has yet been made. Petitioner avers that the community aforesaid is legally in debt say from Twenty two thousand to Twenty three thousand dollars [unreadable] now till and those debts are mostly due in New Orleans and in the State of Tennessee. To meet these debts will require a sale of all the community property in this sale and perhaps even more. Wherefore he prays that he be authorized to make a sale after the legal advertisement of all the property of the aforesaid Estate belonging to the community aforesaid on at least of a sufficient amount to pay the aforesaid debts and that the sale be made according to law No. CP990, 991 and 992 and for all orders and decrees necessary in the premises and for general relief &c. Jno. L. Barrett State of Louisiana 12th Judicial District Court Parish of Union In the motion of the succession of Nancy J. Creath, Decd. by reason of the facts and the law being in his favor, the premises considered it is ordered, adjudged and decreed that the prayer of the foregoing Petitioner be granted and that James A. Creath, Administrator and curator be and he is hereby authorized to sell all of the property of the Estate of Nancy J. Creath, Decd. in this estate or as much thereof as may be necessary to pay the debts of said Estate in accordance with orders at the Code of Practice No. 990, 991 and 992. The petition of James A. Creath, Admr. of Nancy J. Creath estate respectfully shows that in order to pay the debts of said Estate, it is necessary to sell all of the property of said Estate both in the Parish of Union and the Parish of Morehouse according to law, that the creditors of said Estate are pushing and demanding that the sale be made at once and for cash. Wherefore he prays for an order of court authorizing the sale of all the property of said Estate both in the Parish of Union and of Morehouse, Louisiana according to law, that James C. Creath, Admr. make the said sale in Union Parish and that the Sheriff of the Parish of Morehouse make the sale in that Parish and make due return of the same to the 11th Judicial District Court in and for the Parish of union, Louisiana and for general relief &c. Jno. L. Barrett Atty. Of Admr. State of Louisiana 11th Judicial District Court Parish of Union In the matter of the Succession of Nancy J. Creath, Decd., the premises considered, it is ordered, adjudged and decreed that the prayer of the foregoing petition be granted and that James A. Creath, Admr. be authorized to sell all the property of the Estate of Nancy J. Creath, decd. according to law to ay the debts of said Estate and that the said Administrator be authorized to make the said sale of said property in Union Parish, La. Done and signed in office on this October 19th 1866. J. W. Reid Clerk, District Court State of Louisiana 11th Judicial District Court Parish of Union In the matter of the Estate of Nancy Creath, Decd. the premises considered, it is hereby ordered that the Sheriff of the Parish of Morehouse, La. be and he is hereby ordered to make a sale of the following described tract of land in the Parish of Morehouse, La. belonging to the Estate of Nancy I. Creath, decd. after the legal advertisements according to law, viz. a tract of 560 acres of land more or less and that the said Sheriff make due return of said sale to this office.
