The petition of Elizabeth Ann Cross, a resident of your said Parish and State with respect represents to your Honor that her husband Drury Cross departed this life on the ninth day of January (1862) at his residence in said Parish of Union intestate leaving your petitioner, his wife and the following named minor children issue by his marriage with your petitioner to wit: Spencer Franklin Cross, aged about 15 years, Manerva Eliza Cross, aged about 11 years, John D. Cross, aged about 7 years, besides considerable property real and personal, rights and credits wherefore your Petitioner prays your Honor to cause an Inventory and Appraisement to be made of said property and that your petitioner be appointed Administratrix and confirmed as Natural Tutrix to her said minor children and all other orders and decrees as the nature of the case may require as in duly bound your petitioner ever pray. Cross has been duly and legally appointed Administratrix of the Estate of Drury Cross, Decd. and she has given bond and taken the oath required by law. Now therefore the said Eliza A. Cross is hereby duly and legally authorized and empowered to do and perform all acts appertaining to said appointment according to law. Given under my hand and the seal of said Court April 1st 1862. Jas. L. Guthrie, Clerk State of Louisiana Parish of Union Know all men by these presents that we Eliza A. Cross as principal and John Taylor as her security are held and firmly bound unto W. B. Egan, Judge of the 11th District court, Parish and State aforesaid in the just and fully sum of three thousand, one hundred dollars to the true and faithful payment well and truly to be made, we bind ourselves, our heirs, assigns and legal representatives firmly by these presents. Date at Farmerville, Louisiana March 31st 1862. The condition of the above obligation is such that whereas the said Eliza A. Cross has been duly and legally appointed Administratrix of the Estate of Drury Cross, Decd. and she has taken the oath prescribed by law. Now therefore if the said Eliza A. Cross shall faithfully administer said Estate and shall render a true and faithful account of the said Judge of all her acts in and about said Estate and shall wherever legally required so to do pay over all sums of money or other property belonging to said Estate to the proper person or persons to receive the same, then the above obligation to be null and void. Cross Clerk, District Court John Taylor To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, Louisiana. The petition of Eliza a. Cross, Administratrix of the Estate of Drury Cross, Decd. respectfully represents that there is a widow's privilege, one the Negro woman and child belonging to said estate for the amount of the purchasers sum of the same Negroes, and that it is necessary in order to pay the said debt which is now due that she should be sold. She therefore prays for an order of sale of the said slaves and that she be authorized to make the sale and for such orders and decrees in the premises as may be necessary. H. Regenburg, Atty. Be it remembered that on this the Eleventh day of March AD one thousand eight hundred and sixty three, Administratrix of the Estate of Drury Cross, Decd. in compliance with an order of the Honorable Eleventh District Court and after having duly advertised by posting notices for more than thirty days in three public places there being no newspaper present in this Parish did offer for sales at the court house door in Farmerville in the Parish of Union, Louisiana for cash to the highest bidder, a certain Negro woman named Fanny about [blank] years of age and her child Ann about six years of age, both blacks, the property of the said estate of Drury Cross and that after crying the sale a proper time and having all the bids made, Mistress Sarah J. Scale became the purchaser. She making the highest and last bidding, the sum of one thousand and five dollars. Now therefore the said Mrs. Sarah J. Scale having complied with the condition of the sale by paying the sum of one thousand and five dollars cash in hand to me the said Administratrix. The said Negro woman Fanny and her child Ann are hereby granted, bargained and sold and [unreadable] to her the said Sarah J. Scales, her heirs and assigns forever with a full warrantee in every respect. In testimony whereof, I have hereto set my hand on this the day and date above written. ATTEST: Eliza A. Cross John Taylor Administratrix James A. Dean To the Honorable Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana The petition of Eliza A. Cross, a resident of your Parish and Administrator of the Estate of Drury Cross, Decd., late of same residence respectfully represents unto your honor that the Estate of her husband, Drury Cross is considerably in debt from the last information that she the Administratrix can gather and that all this property belonging to the said Estate will have to be sold. Wherefore petitioner pray you honor for an order from your honorable court authorizing your petitioner as Administratrix of the Estate of Drury Cross to sell all the property belonging to said Estate both real and personal after due advertisement according to law. That the Administrator be appointed to make said sale for all other orders and decrees necessary in the premises and for general relief. R. W. Fubets, Atty. State of Louisiana 11th District Court Parish of Union The premises considered it is ordered and decreed that the within applications be granted that there be a sale of the Negro woman belonging to the Estate of Drury Cross and that the Administratrix be authorized to make said sale according to Law. Guthrie, Clerk State of Louisiana 11th Judicial District Court Parish of Union It is ordered that the prays of the above petition be granted and that all the property both real and personal belonging to the Estate of Drury Cross be sold in accordance with Articles 990 and 991 of the Code of Practice. It is further ordered that Mrs. Eliza A. Cross, the Administratrix of the said Estate be and she is hereby authorized to make the said dale and due return thereof make to this office according to law. Cross, Administratrix of the Estate of Drury Cross, Decd. in pursuance to an order from the 11th Judicial District Court in and from the Parish aforesaid did on this the 7th day of April AD 1866 offer for sale at the late residence of said deceased at public auction all the property real and personal belonging to said Estate on a credit of twelve months after having advertised the same for full thirty days in the “Union Record” published in the town of Farmerville in said Parish. Whereupon Mrs. Eliza A. Cross surviving partner in community of deceased became the purchaser of the following described property to wit: 1st Tract of land with the improvements therein described as follows to wit: THE s ½ OF SE ¼ and SE ¼ OF SW ¼ OF Sec. 17 T 21 R 26. The NE ¼ of SE ¼ of Sec. 17 and E ¼ of NW ¼ of Sec. 20 in T 21 R 2E and the NW ¼ of the NE ¼ of Sec. 20 in Township 21 North of Range two East containing in all two hundred and eight acres for the sum of 680.00 2nd Twelve head of cattle 50.00 3rd Eighteen head of hogs 25.00 4th Lot of farming utensils 8.00 5th Lot of carpenter’s tools 1.30 6th Sand rock 4.00 7th Household & kitchen furniture 25.00 8th 1 horse 50.00 9th 1 colt 20.00 10th 1 shot gun 5.25 H. H. Hill bought yoke oxen & wagon __107.50 Total Amount sale $976.75 Now therefore by virtue of the authority vested in me as Administratrix and hereby transfer and deliver unto said purchasers said property with all its rights, title and interest in said Estate vested.
