Davis served as a private in Company I, 31st Louisiana Infantry Regiment. He enlisted with his company at Monroe on 16 March 1862. He was present on rolls through February 1863, and was captured and paroled at Vicksburg in July 1863. He died only a few weeks after his parole. ================================================================================== ================================================================================== To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana. The petition of William E. Davis, a resident of the Parish of Union and State above written respectfully represents that on or about the 24th of July 1863 his brother James H. Davis also of same residence departed this life intestate leaving a small Estate consisting of personal effects, rights, credits and a considerable amount of debts and also leaving a minor child to wit James L. Davis. Petitioner avows that the estate is probably insolvent and that an administration of the same is necessary in order to secure the rights of the creditors and that he is the tutor of the said minor child to wit James L. Davis who is the sole heir of the said Estate and that he is the proper person to administer said Estate. Wherefore he prays that this his application be advertised according to law and after the legal delays that he be appointed Administrator of the Estate of the said James H. Davis, Decd. That an Inventory and Appraisement of said Estate be ordered as required by law and for all further orders and decrees necessary in the premises and for general relief. Jno. L. Barrett, Atty. State of Louisiana 11th District Court Parish of Union The premises duly considered, it is ordered and decreed that the within petition of William E. Davis to be appointed Administrator of the Estate of James H. Davis, Decd. be advertised as the law directs. It is further ordered that W. C. Smith, Parish Recorder and Ex Officio and Notary Public be and he is hereby authorized to make an Inventory and Appraisement of all the property belonging to the Estate of James H. Davis, Decd. and due return thereof make to this office without delay. Done and signed in office this the 19th day of March AD 1866. Thos. C. Lewis Clerk, District Court State of Louisiana 11th Judicial District Court Parish of Union The premises considered and by reason of the proper and legal advertisement having been made and no opposition being made thereto, it is ordered and decreed that William E. Davis be appointed and confirmed Administrator of the Estate of James H. Davis, Decd. and that upon his giving bond with good security and taking the oath prescribed by law. That letters of Administration to issue to him. Done and signed in office this 1st day of April AD 1866. Thos. C. Lewis Clerk, District Court I, Thomas F. Nolan and I, John T. Ogletree, do solemnly swear that I will faithfully and impartially appraise the property that may be presented to you belonging to the Estate of James H. Davis, Deceased at its cash value in specie[sic] to the best of my Judgment. So help me God. Thos. F. Nolan John T. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the 7th day of April AD 1866, pursuant to an order from the Honorable 11th Judicial District Court in and for said parish and to me William C. Smith, Recorder and Ex Officio Notary Public in and for said Parish directed, commanding me to make and Inventory and Appraisement of the property, rights and credits belonging to the Estate of James H. Davis, Decd. late of the Parish of Union, La. and being assisted by Thos. F. Nolan and John T. Ogletree, males of age and residents of the parish of Union, La., who being duly appointed and sworn by me as appraisers proceeded to make said Inventory and Appraisement as herein after set forth. One promissory note on Stephen Manning for one hundred and twenty five dollars dated January 1st 1866 with 8% Interest from due $125.00 One promissory note on K. Henderson for two hundred and firty dollars due Jan. 1, 1866 with 10% interest from due 225.00 One promissory note on J. H. Gathright and M. L. Simmons for forty dollars less a credit of $20 March 1861 balance 20.00 One promissory note on W. L. Montgomery and James C. Creath for one hundred dollars Due Jan. 1st 1866 with 8% interest from Due valued at 41.25 One promissory note on William J. Lee for one hundred and forty dollars due 1st day Jan. 1863 considered worthless by the appraisers Four bales of cotton in the hand of [unreadable] and Mays commission Merchants [unreadable], La. weighing say 450 pounds each more or less making 1800 pounds apprd. @ 5 cts. per lb. 896.25 Thus done and signed in my office in the Town of Farmerville, La. in presence of J. C. Gee, Robert W. Winds, witnesses of lawful age and domicil who signs with said appraisers and me Recorder this the 7th day of April AD 1866. ATTEST J. C. Gee Thos. F. Nolen R. W. Winds John T. Davis do solemnly swear that I will faithfully and impartially discharge all and singular the duties incumbent on me as Administrator of the Estate of James H. Davis, Decd. to the best of my ability and understanding. So help me God. William E. Davis Sworn to and subscribed before me this the 10th day of April AD 1866. Thos. C. Lewis Clerk, District Court State of Louisiana 11th District Court Parish of Union Whereas William E. Davis has this day been duly and legally appointed Administrator of the Estate of James H. Davis, Decd. and he has given bond and good security and taken the oath required by law. Now, therefore the said William E. Davis is hereby duly and legally authorized and empowered to do and perform all and singular the duties appertaining to said appointment according to law. Given under my hand and seal of office this 10th day of April AD 1866. Thos. C. Lewis, Clerk, District Court State of Louisiana Parish of Union Know all men by these presents that we William E. Davis as principal, Thomas f. Nolen as his security are held and firmly bound unto honorable J. D. Watkins, Judge of the said court in and for Union Parish, Louisiana for the time being or to his successors in office in the just and full sum of eleven hundred and fifty $1150.00 dollars to the true and faithful payment whereof well and truly to be made, we bind ourselves, our heirs, assigns and legal representatives firmly by these presents. The condition of this obligation is such that whereas the said William E. Davis has been duly and legally appointed Administrator of the Estate of James H. Davis, Decd. and he has taken the oath prescribed by law. Now, therefore, if the said William E. Davis shall faithfully and impartially discharge all the duties incumbent on him as Administrator of the said Estate and shall render to the judge of said court a true and correct account of all his acts and doings in and about said estate and shall faithfully account for all moneys and other property received by him belonging to the Estate and shall whenever legally required so to do, pay over all money and deliver all the property of whatever nature received by him belonging to the said Estate to the proper person or person to receive the same, then this obligation to be null and void.
