In 1860, she lived with her family near Downsville. ================================================================================== ================================================================================== ================================================================================== ================================================================================== Union Parish Louisiana Succession Book F, pp. 432 - 436 ================================================================================== ================================================================================== To the Honorable the Judge of the 11th Judicial District Court, Parish of Union, State of Louisiana The Petition of Calvin Davis, a resident of the Parish and State above written respectfully shows that Mrs. Nancy Davis, departed this life on or about the 4th day of February 1867 intestate leaving a small Estate in your said parish of Union consisting of land, horses, mules, hogs, rights and credits, household and kitchen furniture, right and credits and leaving the following heirs to wit: Josiah Davis, Emily Ann Davis, wife of Wiley Henton of the Parish of Jackson, Nancy Davis, the wife of David Jackson, Thomas Davis, Cildy Davis, wife of Lewis Futrul of Jackson Parish, Elizabeth Davis also of Jackson Parish, Roland D. Davis, Lucinda Davis, wife of Rudolph Cuder, Marion F. Davis, Elliot Davis and your Petitioner. Petitioner further represents that there are large amounts due by the Estate and the creditors among whom he is one are desirous of a speedy settlement of the Estate and that an Administration therefore is necessary and that Petitioner has an equal or better right to administer than any other person. Wherefore he prays that this his application be duly advertised according to law and after the legal delays he be appointed Administrator of the Estate of Nancy Davis, Decd. that an Inventory of said Estate be ordered and for all other orders and decrees necessary and for general relief &c. The premises considered, it is hereby ordered and decreed that the foregoing application of Calvin Davis to be appointed Administrator of the Estate of Nancy Davis, Decd. be advertised according to law and it is further ordered that Wm. C. Smith, Recorder &c do make an Inventory and Appraisement of said Estate immediately and due return thereof make to this office. Done and signed in office this February 18th 1867. J. W. Reid Clerk, District Court Succession of Nancy Davis, Deceased State of Louisiana 11th Judicial District Court Parish of Union I, Calvin Davis do solemnly swear that I will faithfully and impartially discharge all the duties imposed upon me as Administrator of the Estate of Nancy Davis, deceased according to the best of my abilities and understanding. Reid, Clerk State of Louisiana 11th Judicial District Court Parish of union Whereas Calvin Davis has been duly and legally appointed Administrator of the Estate of Nancy Davis, deceased and has given bond with good security and has taken the oath prescribed by law. Now therefore the said Calvin Davis is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to said appointment according to law. Davis and Thomas Davis as securities are held and firmly bound unto the Honorable J. D. Watkins, Judge of the Eleventh Judicial District Court in and for Union Parish, La. for the time being or to his successors in office in the just and full sum of seven hundred and seventy three and 87/100 dollars to the true and full payment thereof we bind ourselves, our heirs, executors, administrators and legal representatives firmly and in solido by these presents. Dated at Farmerville, La. this 2nd day of March AD 1867. Now therefore if the said Calvin Davis shall faithfully and impartially discharge all the duties incumbent on him as Administrator of the said Estate and shall render to the Judge of said court a true and correct account of all his acts and doings in and about said Estate and shall when legally required so to do pay over all sums of money and deliver all the property belonging to the said Estate to the proper person or persons to receive the same; then this obligation to be null and void, otherwise to be and remain in full force according to law. The petition of Calvin Davis respectfully shows that he has been legally appointed Administrator of the Estate of Mrs. Nancy Davis, decd. late of your said Parish and State and further that said Estate is largely in debt and that the creditors are urgent for their claims to be paid, that a sale of all the property of said Estate is necessary to pay the debts of the same. Whereupon he prays for an order of your Honorable Court authorizing him as Administrator of said Estate to make a sale of the whole property of the same both real and personal according to law to pay the debts of the same for all further orders and decrees necessary in the premises and for general relief &c Jno. Davis 679.00 15th Claims of Elliot Davis 679.00 To the Honorable the Judge of the Parish Court of Union Parish, Louisiana. The petition of Colvin Davis of your aforesaid Parish and State respectfully shows that he as Administrator of the Estate of Nancy Davis, Decd. has fully administered the same and herewith files his final account and Tableau of Distribution for which it appears that he has in hands the whole assets of the Estate amounting to $769.80. That the Estate owes more than that amount and is consequently insolvent. That the then last mentioned debts are sums due the heirs of the Estate. Wherefore he prays that this his final account and Tableau of Distribution be advertised according to law. That the said heirs Elliot Davis and F. M. Davis be duly notified thereof and after the aforesaid account and Tableau be approved and homologated and that the Administrator be authorized to pay all of the debts of said Tableau in full except Nos. 13, 14 & 15 and the balance of the assets left after pay all the debts in full but the said nos. 13, 14 & 15 be equally divided between the three aforesaid creditors to wit Calvin Davis F. M. Davis and Elliot Davis and that the bond of the Administrator be canceled on his producing the required receipts for all orders and decrees necessary in the premises and for general relief &c. State of Louisiana Parish Court Parish of Union It is ordered that the within final account filed by Colvin Davis as Administrator of the Estate of Nancy Davis, Decd. be advertised in the Union Record for ten days. Davis Elliott Davis By F. M. Davis, Agent State of Louisiana Parish Court Parish of Union In the matter of the homologation of the final account filed by Colvin Davis as administrator of the Estate of Nancy Davis, Decd. 1st Vouchers filed with said account 2nd J. W. Reid, Clerk of said Court sworn says he was the acting clerk of said Court in October last, that said final account was filed on the 19th of October 1868 and has been duly advertised for more than ten days prior to this date by publication in a weekly newspaper published in Union Parish, Louisiana called the Union Record and by posting at the door of the Court House in the Town of Farmerville in said Parish and that no opposition has been filed to the homologation of the same. 3rd F. Marion Davis sworn says he signed the acknowledgement for himself and as agent for his sister Elliot Davis and that he is her [unreadable] agent. J. W. Tompkins Parish Judge I hereby certify the foregoing is all the evidence adduced on the trial of the homologation of the final account filed by Colvin Davis, Administrator of the Estate of Nancy Davis, Decd. In the matter of the homologation of the final account of Colvin Davis, Administrator of the Estate of Nancy Davis, Decd. by reason of the law and evidence in this case being in favor of the said Administrator and by further reason that the account and Tableau has been advertised according to law and legal notice filed. It is ordered, adjudged and decreed that the account and Tableau be and the same are hereby approved and homologated that the Administrator pay all the debts in full as privileged debts except Vouchers 13, 14 and 15 on the Tableau and that the residue of the assets after paying the debts above protracted one Nos. 13, 14 & 15 and that the Administrator bond be canceled.
