The petition of John M. Defee, a resident of your said Parish and State with respect represents unto your Honorable Court that Wiley W. Defee, late a resident of your said Parish of Union and State of Louisiana, departed this life intestate on or about the [blank] day of June AD 1873 possessed of some property consisting of real estate and personal goods, rights & credits situated in your said Parish. Petitioner avers the necessity of an administrators appraisement to take charge of premises, collect and secure the effects of the said deceased Wiley W. Defee and that said succession owes some debts which it is necessary should be paid in due course of law. Your petitioner represents further that he is the legitimate brother of the deceased Wiley W. Defee and is entitled to the administration of his estate. Petitioner avers the absence of the Recorder of the Parish of Union from the State of Louisiana and Parish of Union and that there is no Notary public in your said Parish of Union. Wherefore your petitioner prays that your honor in your capacity of Parish Judge in and for the Parish of union make a true and faithfully inventory of the property of Wiley W. Defee, Deceased and appraised the same and that L. R. Taylor and Geo. M. Alston be appointed appraisers to appraise the same and that after due and legal notice given of this application by advertisement in the official Journal of the Parish of Union. That your petitioner be appointed Administrator of the Succession of Wiley W. Defee, deceased with the benefit of inventory and that letters of confirmation issue accordingly. Petitioner continues to pray for all orders incidental hereto and necessary in the Administration of the Succession aforesaid and that this application be duly advertised and lawful notice of the same given as required by law and for general relief in the premises. Defee for letters of Administration of the Succession of Wiley W. Defee, deceased be advertised in the Union Record as the law directs and that L. R. Taylor and Geo. M. Alston be and they are hardly appointed appraisers to appraise the property real and personal, rights and credits of Wiley W. Defee, Deceased found within the Parish of Union. Defee be and is hereby appointed Administrator of the Estate of W. W. Defee, Decd. upon his taking the oath required by law. State of Louisiana Parish of Union Be it remembered that on this the 5th day of July AD one thousand eight hundred and seventy three (1873), I Thomas C. Lewis, Parish Judge in and for the Parish of Union, La. being assisted by L. R. Taylor and G. M. Alston, males of lawful age resident of said Parish and State did proceed to make an inventory and appraisement of the property pointed out as belonging to the Estate of Wiley W. Defee, Decd. as follows. The said L. R. Taylor and G. M. Alston having been first appointed and sworn by me as appraisers: 1 lot in the town of Spearsville, La. $50.00 Sundry notes and accounts 25.00 1 bay mare 50.00 1 bridle and saddle 5.00 1 feather bed 15.00 1 revolver 8.00 1 shuck mattress ___5.00 $158.00 Having completed the foregoing inventory and appraisement, we the said appraisers have closed the same and together with the Judge of the Parish Court have hereto affixed our names in the presence of the undersigned lawful witnesses on this 5th day of July 1873. Defee as principal and James C. Cargill and [blank] as securities are held and firmly bound unto the Honorable T. C. Lewis, Judge of the Parish Court of Union Parish, Louisiana and unto his successors in office in the just and full sum of Two hundred dollars to the true and faithful payment of which we bind ourselves, our heirs, administrators and legal representatives firmly and in solido by these presents. Dated at Farmerville, La. this 24th day of July AD 1873. The condition of the above obligation is such that whereas the above bound John M. Defee has this day been duly and legally administrator of the Estate of Wiley W. Defee, deceased and he has taken the oath required by law. Now therefore, if the above bound John M. Defee as principal shall faithfully and impartially discharge all the duties incumbent on him as Administrator fo said Estate and shall render to the Judge of the aforesaid Court a true and correct account of all acts and doings in and about said Estate and shall when legally required so to do, pay over all sums of money and deliver all the property of whatever nature that may have in hands belonging to said Estate to the proper person or persons to received the same. Then this obligation to be null and void. Otherwise to be and remain in full force and effect according to law. Done, signed and acknowledged before me this the day and date above written. J. W. Defee, Deceased Parish Court of Union Parish, Louisiana Whereas, John W. Defee has this day been duly and legally appointed Administrator of the Estate of Wiley W. Defee, deceased and he has given bond with good security and taken the oath required by law. Now therefore, the aforesaid John M. Defee is hereby duly and legally authorized and empowered to do an perform all the acts appertaining to the said appointment according to law. The petition of John M. Defee, Administrator of Wiley W. Defee, Deceased and resident of your said parish of union, State of Louisiana with respect represents that there are debts against the estate praying for settlement and that it is necessary that a sale of all the Estate real and personal of said Estate is necessary in order to pay the debts referred to. Wherefore petitioner prays that an order for and a commission issue directed to John M. Defee, Admr. authorizing him to sell all of said Estate for cash belonging to Wiley W. Defee for the payment of said debts and for all other orders decreed necessary and incidental in the premises and for general relief. Ellis & Roberts Attorneys for Petr.
