To the Honorable the Judge of the Eleventh Judicial District Court, Parish of Union, State of Louisiana. The petition of Mary Jane Edwards, a resident of the Parish of Union, State aforesaid respectfully represents unto your Honor that her husband Cullen Edwards, late of the said Parish and State departed this life on or about the [blank] day of April last, he being absent from the State in the Military Service of the Confederate States leaving herself a widow in community and one child, the issue of the marriage between him and petitioner who is a minor to wit: Sarah Edwards, leaving an Estate consisting of one slave, land and personal property. She prays that an inventory and appraisement may be had according to law and that after due proceedings had, she may be appointed Administratrix of said Estate and appointed Natural Tutrix to her said minor child Sarah Edwards and that [blank] be approved Under tutor and for all such orders as may be necessary in the premises and for general and equitable relief &c. M. J. Edwards State of Louisiana 11th District Court Parish of Union Ordered that the within application be advertised according to law. It is further ordered that an Inventory and appraisement of all the property belonging to the Estate of Cullen Edwards be made and that W. C. Smith, Parish Recorder and Ex Officio Notary Public is hereby authorized to make said Inventory and appraisement and due return thereof make without further delay. Edwards be and she is hereby appointed Administratrix of the Estate of Cullen Edwards, Decd. and upon her giving the required bond and security and taking the oath prescribed by law that letters do issue to her. Edwards, do solemnly swear that I will faithfully and impartially discharge all and singular the duties incumbent on me as administratrix of the Estate of Cullen Edwards, Decd. to the best of my ability and understanding. Edwards as principal and L. B. Fuller and Jesse F. Fuller as her securities are held and firmly bound unto W. B. Egan, Judge of the 11th District Court or to his successors in office in the full and just sum of Three thousand five Hundred and fifty dollars to the true and faithful payment thereof we find ourselves, our heirs, assigns and legal representatives firmly by these presents dated at Farmerville, June 21, 1862. The conditions of the above obligation is such that whereas the said Mary J. Edwards has been duly and legally appointed Administratrix of the Estate of Cullen Edwards, Decd. and she has taken the oath prescribed by law. Now therefore if the said Mary J. Edwards shall faithfully discharge the duties incumbent on her in said administrative capacity and shall faithfully account to the Judge of said court for all monies or other property belonging to said Estate received from this or any other state and shall render a true and faithful account of all her acts in and about said Estate to the Judge of said court and whenever legally required so to do pay over all sums of money and deliver all the property of whatever nature to the proper person or persons to receive the same then the above obligation to be null and void otherwise to be and remain in full force and virtue against the above parties. Edwards of the aforesaid Parish and State respectfully represents unto your honor that on or about the [blank] of [blank] 1863, she was duly appointed Administratrix of the Estate of for deceased husband Cullen Edwards. She further represents that a portion of said Estate is subject to waste and deterioration and that it is necessary that there should be a sale of said property for the interest of the said Estate. Therefore, she prays that after due and legal advertizement and delay of time she be fully authorized to make said sale according to law, and she further prays for all necessary orders and decrees and for general relief &c. M. J. Edwards State of Louisiana 11th District Court The premises duly considered it is ordered that there be a sale of a portion of the Estate of Cullen Edwards, Decd. to wit: The house and lot situated in the town of Farmerville, also a lot of carpenter's tools, household and kitchen furniture &c and that the Administratrix of said Estate be authorized to make sale on Saturday [blank] day of December 1863. Guthrie Clerk, District Court State of Louisiana Parish of Union Be it remembered that pursuant to an order of the 11th Judicial District court authorizing the sale of all the property of the Estate of Cullen Edwards, Decd. for the payment of the debts of said Estate after having advertized the same according to law to wit: for more than thirty days by posting at the courthouse door in the town of Farmerville and two other public places in said Parish of Union. There being no newspaper published in said Parish at the time, I proceeded at 12 o'clock PM on the 26th of December 1863 to offer for cash the highest bidder at public Auction on the premises a certain lot or tract of land in the Town of Farmerville, Louisiana described as follows, bounded by a line commencing at the corner of Academy Street and Main Street and thence running west to Lafayette Street, thence south along Lafayette Street to within one hundred and fifty feet from Green Street, thence East to Main Street, thence North along Main Street to the place of beginning together with all the improvements thereon and after crying the same a sufficient length of time. Mrs. Mary Ann Callaway became the purchaser for the sum of Eight hundred dollars, which sum the purchaser having paid in cash. By the authority vested in me as Administrator of the Estate of Cullen Edwards, Decd., I do hereby sell adjudicate, transfer and deliver the said property unto the purchaser with lawful guaranty forever. In testimony whereof, I have hereto signed my name together with the said purchaser and W. C. Smith and [blank] witnesses on this January the 11th AD 1864. ATTEST: M. J. Edwards, Admx. Wm. C. The petition of Mary J. Edwards a resident of your aforesaid Parish and State respectfully represents that she has been appointed Admx. of the Estate of Cullen Edwards, Decd. That she has administered said Estate and she herewith files a full, complete and final account of her Administration. From said account, it appears that she is due the sum of five hundred and eighty four dollars. She further represents that she is the survivor in community entitled to one half of the Estate and that her daughter, Sallie Edwards is sole heir of the Estate of Cullen Edwards, her father and entitled to the other half, and that petitioner has been appointed and confirmed by your honorable court, Natural Tutrix of said Sallie Edwards. Wherefore she prays that this her final account be advertised according to law and after the legal delays, the said account be approved and homolgated and that the bond of the Admx. be cancelled and she and her securities be released from all responsibility therefrom and for general relief &c. Jno. L. Barrett, Atty. In the matter of the Homolgation of the final account filed by Mary J. Edwards, Admx. of the Estate of Cullen Edwards, Decd. 1st Voucher filed with the final account 2nd Thos. C. Lewis, Clerk of the District Court sworn says "That the final account was filed in the clerk's office on the 30th day of March 1864 and that he has legally advertised it in the following manner to wit: By posting a copy of the advertisement at the Courthouse door in the Town of Farmerville, and by handing two copies of the said advertisement to Rev'd W. D. Slayton and R. M. Gilbert to be posted at two other public places in the Parish of Union. That said account has been advertised for more than thirty days prior to this date and that there has been no opposition filed to the same. Thos. C. Slayton, sworn says that he posted the advertisement herein this succession handed him by Thos. C. Lewis, Clerk to be posted in the Town of Marion, a public place in the Parish of Union more than thirty days prior to this date. R. M. Lewis, Clerk I hereby certify the within to be all the evidence adduced in the homolgation of the final account filed by Mary J. Edwards as Administratrix of the Estate of Cullen Edwards, Decd. Thos. C. Lewis, Clerk, District court State of Louisiana 11th Judicial District Court Parish of Union By reason of the law and the evidence in the matter of the homolgation of the final account filed by Mary J. Edwards as administratrix of the Estate of Cullen Edwards, Decd. and by reason of due proof being made of the legal advertisement of the same and no opposition having been filed thereto, it is ordered, adjudged and decreed that the said final account be and the same is hereby approved and homolgated in all its parts according to law and that the bond of the said administratrix be canceled and she is released from all responsibility on the same.
