The petition of Isaac C. Mayes, a resident of your said Parish and State with respect represents unto your Honor that William E. Fuller late of your said parish died somewhere about the seventh of February 1844 intestate and leaving a considerable property, real and personal and the following heirs: (The said fuller having no children) to wit: Jesse Fuller and Mary Fuller, Father and Mother of the deceased now residing in Alabama together with the following brothers and sisters; Elijah G. Fuller, Andrew J. Fuller, Seborn J. Fuller, Jesse F. Fuller, John A. Fuller, David M. Fuller, James Fuller, Jefferson Fuller, George A. Fuller, all residents of the State of Alabama and unrepresented together with Lucrecia B. Fuller, wife of your Petitioner and resident of the Parish of Union, Louisiana. Wherefore your petitioner prays that an Inventory of said Estate be ordered by your Honor of the effects real and personal belonging to said Estate, that an attorney be appointed as counsel to the absent heirs to assist at said Inventory to attend to the interest of said absent heirs and that your Petitioner be appointed Administrator of said Estate upon due notice being given according to law and upon his giving bond and the required legal security for the faithful performance of the duty of said office and for all such other and further relief in and about the premises as the nature of the case may require. Isaac C. Mayes Let an Inventory of the Estate set forth in the within petition be made as prayed for and Philip May be appointed counsel to the absent heirs of said Estate and Isaac C. Mayes be appointed Administrator of said Estate after ten days note in from this date hereof upon his giving bond and security as the law directs this 15th day of February 1844. Fuller, Deceased. Now therefore he is hereby authorized and fully empowered to discharge and perform all and singular the duties appertaining to the said appointment according to law. In testimony whereof, I have hereunto signed my name and affixed my seal of office on this 15th day of February AD 1844. John Taylor Judge of Probates State of Louisiana Parish of Union Be it remembered that on this 15th day of February AD 1844 that I, John Taylor, Parish Judge and Ex Officio Notary Public in and for said parish and State; having received official information of the death of William E. Fuller, who departed this life intestate on or about the 7th of this instant February AD 1844 at his residence in said Parish of Union, leaving the following Jesse Fuller and Mary Fuller, Father and Mother of deceased, Elijah G., Andrew J, Seaborn J., Jesse F., John A., David W., James, Jefferson, George Fuller all residents of the State of Alabama, Lucrecia B., sister, wife of I. C. Mayes, a resident of the Parish of union, Louisiana besides a considerable Estate consisting of real and personal, rights and credits, land and tenements and for the purpose of making an Inventory and Appraisement of said Decedent’s Estate. I have repaired to the late residence of said decedent and for the purpose as aforesaid, I have appointed William M. Lawrence and B. Fuller, residents and freeholders of said parish appraisers to appraise all the property comprising said decedents Estate and whom after being well and duly sworn by me the said Judge, well and truly to do and perform all and singular the matters and things herein according to law have proceeded as follows together with me the said Judge and Isaac C. Mayes who gave in the property and undersigned witnesses and parties to wit: Inventory Two hundred and forty acres of land @ $2 per acre $480.00 One negro boy, Peter, aged 12 years 350.00 One horse, saddle and bridle 50.00 One wild horse 25.00 1500 lbs. of fodder more or less 7.00 100 bus. corn more or less 50.00 Bed and furniture 25.00 Three chairs and castings 6.00 Two shot guns and one rifle 60.00 One cross cut saw, augers, chisels 12.00 1 set planes, hand axe, iron wedge 6.50 2 axes, grindstone, ploughs and gear 9.50 Table, 2 watches, one note on J. In testimony whereof said parties appraisers have signed their names together with Isaac C. Mayes who gave in the property with Philip May, attorneys for the absent heirs and the undersigned witnesses and me Judge the date above . John Taylor Parish Judge State of Louisiana Parish of Union Know all men by these presents that we Isaac C. Mayes as principal and William M. Lawrence his security of the State of Louisiana are held and firmly bound unto John Taylor, Judge of the Court of Probates in and for the Parish of Union or to his successors in office in the sum of fifteen hundred dollars current money of the United States of America which we promise to pay to him or his successors in office for the faithful performance of which we bind ourselves and each of us, our heirs, executors, Administrators jointly and severally by these presents announcing all benefit or discussion or division whatsoever. Signed and acknowledged on this the 29th day of February AD 1844. The condition of the above obligation is such that if the above bounden Isaac C. Mayes, Administrator of the Estate of William E. Fuller, Deceased does well and truly according to law Administer the same and further does make and render a true, just and perfect account of all his actions and doings. When thereunto lawfully required either by the aforesaid Judge or his successors in office or by the heirs of said Decedent or their lawful attorney or by the duly appointed and authorized Executor or Executors of the last will and testament of the said Decedent, then this obligation to be void, else to remain in full force and effect. Fuller, Deceased and having given bond and authority and taken the oath as prescribed by law. Now therefore he is hereby authorized and fully empowered to discharge and perform all and singular the duties appertaining to the said appointment according to law. In testimony whereof, I have hereunto signed my name and affixed my seal of office on this 29th day of February AD 1844. John Taylor Judge of Probates To the Honorable John Taylor, Probate Judge in and for the Parish of Union, State of Louisiana. The petition of Isaac C. Mayes, a resident of your said Parish and State and also Administrator of the Estate of William E. Fuller consists of personal property and real estate, that it is liable to waste and decay if it remains long in its present condition. Wherefore Petitioner prays your Honor to grant him an order for the sale of all the property of said Estate according to law on a twelve months credit. Petitioner further prays your Honor to grant an order for the partition of said Estate between the legal Heirs as the law requires as soon after the sale as it can be done. Petitioner avers and verily believes that it would be to the advantage of all the Heirs to said Estate and the creditors also, for your Honor to grant him an order for the sale of said property and for a partition as soon thereafter as it can be done for the reason above set forth and for all further and general relief that may be necessary in the premises &c. N. M. Bryan, Atty. Let the prayer of the petitioner be granted and it is ordered, adjudged and decreed by the Court that the property of said William E. Fuller, Deceased be sold on a credit of twelve months, all sums under ten dollars to paid down at the time of purchasing purchasers note with approve security with a mortgage on the real Estate. Done and signed in chambers this 29th day of February AD 1844. John Taylor, Judge State of Louisiana Parish of Union Be it remembered that I John Taylor, Parish Judge and Ex Officio Auctioneer in and for said Parish and State in pursuance of a judgment and decree of the Honorable the Probate Court of said parish. I have repaired to the late residence of William E. Fuller, Deceased and after the usual and legal advertisements at three public places in said Parish more than thirty days and also published in the Ouachita Courier printed at Monroe during said time and after due proclamation have proceeded to offer for sale all the property comprising the Estate and Succession of said Decedent on this 6th day of April 1844. Terms of sale, twelve months credit, sums over ten dollars, under ten cash. Notes with approved security and a mortgage on the real Estate retained. Whereupon the following persons became the last and highest bidders upon said terms, to wit: Isaac C. He prays the same may be allowed and homologated after due and legal advertisements and that he be authorized to pay the same in due course of Administrationship and for all orders that may be necessary in the premises as in duty bound &c. Bryan Let the prayer of the petitioner be granted by reason of the law and evidence and by further reason of the legal and usual advertisements having been made over ten days and there being no opposition it is ordered, adjudged and decreed that the within account be approved and homologated as set forth and that the Curator settle the same in due course of his administration.
