Gardner, Decd., Union Parish Louisiana Union Parish Louisiana Succession Book E, pp. 676 - 678 ================================================================================== To the Honorable the Judge of the 12th Judicial District Court in and for the Parish of Union. The petition of Peter R. Wyckoff and Virgil H. Gardner, residents of the State of Alabama, respectfully represents unto your honor that they were appointed on the 26th day of November 1856 executors of the Estate of Garland T. Gardner, Decd. by the Honorable the Probate court in and for the County of Dallas, State of Alabama. The said G. T. Gardner having died and his estate opened in the County and State last named. They further represent that there is some property belonging to the Estate of said decd. in the Parish of Union, State of Louisiana consisting of a tract of land which it is necessary should be administered upon. Wherefore the premises considered, petitioners presents herewith a certified copy of these appointments as Executable by the County aforesaid and pray that their said authority may be recognized by your Honor and they your petitioners authorized to administer upon the property belonging to the Estate of said Garland T. Gardner, decd. to be found in the Parish of Union as aforesaid and for such further orders and decrees as may be. Harvey Brigham Atty. for petitioner State of Louisiana Parish of Union The foregoing petition considered and it appearing from the evidence presented that Peter R. Wyckoff and Virgil H. Gardner were duly appointed by the probate court of Dallas County, Alabama. Executors of the Estate of Garland T. Gardner, Decd. It is therefore ordered, adjudged and decreed that the appointment of said Wyckoff and Gardner as Executors and the same is hereby recognized and they are hereby fully authorized and empowered to act in their said capacity in this state and to administer upon any property belonging to the said estate to be found in the Parish of Union, State of Louisiana. Read and signed in chambers on this 17th day of January 1861. R. W. Richards Judge, 12th District State of Louisiana 12th Judicial District Court Parish of Union The premises considered it is ordered and decreed that the land described in the foregoing petitions to wit: the East ½ of SW ¼ of Sec. 13 Township 21 Range 1 West belonging to the Estate of Garland T. Gardner, decd. be sold for cash. It is further ordered that Allen M. Callaway, Sheriff of Union Parish, Louisiana be and he is hereby authorized and empowered to make the said sale on the first Saturday in march next 1861. Done and signed in office on this the 29th of January AD 1861. Thos. C. Smith, parish Recorder in and for the Parish and State aforesaid, do hereby certify that there is no mortgage extant on record in my office against the Estate of Garland T. Gardner, Decd. on the following described land viz: the East ½ of the South West ¼ of Sec. 13 Township 21 Range one west containing 80 acres. Smith, Recorder To the Honorable Judge of the 12th District Court in and for the Parish of Union, State of Louisiana The petition of Peter R. Wyckoff and Virgil H. Gardner, residents of the State of Alabama, respectfully represents unto your honor that they are the legally appointed Executors of the Succession of Garland T. Gardner, Decd., late of said State of Alabama. That they have been so recognized by a judgment of your honorable court and authorized and empowered to administer upon any property situated in the Parish of Union, State of Louisiana belonging to said succession. That there is a small tract of land belonging to said succession situated in the Parish of Union described as follows: East ½ of SW ¼ of Sec. 13 Township 21, Range 1 West. That it is to the interest of the Succession that said land be sold and converted into cash as soon as possible. Wherefore, petitioner prays your honor for an order of sale authorizing the sheriff of Union Parish to sell said tract of land at public auction at the court here in the town of Farmerville for cash on the first Saturday in march next (1861) after due advertisement &c. then the sheriff be empowered to make, transfer and deed to the purchaser for all orders necessary in the premises and for general relief. Callaway, Sheriff of Union Parish, Louisiana be and he is hereby authorized and empowered to make the said sale on the first Saturday in March next 1861.
