The petition of Benjamin F. George, a resident of your honorable court, that Washington L. George late a resident of the parish and state aforesaid departed this life on 26th day of June AD 1867 having a considerable estate consisting of property both real and personal and that said estate is owing a considerable amount of debts and in order to rescue equal Justice to all parties interested in the succession of the said Washington L. George it is necessary that an administrator to conduct and settle up said succession. Petitioner therefore prays that an Inventory of the effects of said succession be forthwith made by the parish recorder and Ex Officio Notary Public of said Parish of Union and that your Petitioner Benjamin F. George be appointed administrator of said succession and that all orders necessary in the premises be granted and for general relief. D. Pucket, Atty in fact State of Louisiana 12th Judicial District Court Parish of Union By reason of the law and the evidence and by further reason of the necessary advertisement and all legal delays having been made and no opposition made there to. It is ordered and decreed that Benj. F. George be and he is hereby appointed administrator. of the Estate of W. L. George upon taking the oath and giving bond according to law. Smith Parish Recorder and Ex Officio Notary Public in and for the Parish and State aforesaid duly commissioned and qualified by virtue of an order issued from the Honorable 12th Judicial Dist. Court in and for said Parish bearing date 9th Inst. I caused to come before me at the late residence of W. L. George, Decd. in said Parish of Union, La. Daniel Pucket and John J. Loper males of lawful age and domicilliated in said Parish and State for the purpose of appraising and making an Inventory of all the property belonging to the estate and succession of the said W. L. George Decd. movable as well as unmovable. Said appraisers being first duly sworn and in presence of lawful witnesses. George do solemnly swear that I will do and perform all and singular the dates incumbent on me as Administrator of the Estate of Washington L. George, Decd. 12th Judl. Disct. Court State of Louisiana Know all men by these presents that I Benj. F. George as principal and Elias George as his security and held and firmly bound unto Robt. W. Richardson, Judge of the 12th Judicial District Court in and for the Parish of Union, State of Louisiana or to his succession in office in the full and just sum of twenty two thousand dollars to the true and faithful ____mentence thereof we bind ourselves our heirs and assigns firmly by these presents dated at Farmerville, La. 18th day of July 1857. The condition of the above obligations is such that whereas the said Benjamin F. George has been duly appointed Administrator of the Estate of W. L. George, Decd. by the clerk of the 12th Judicial District Court in and for the Parish and State aforesaid. Now therefore if the said Benjamin F. George shall do and perform all and singular the duties incumbent on him as administrator of said Estate and shall render a true and faithful account of all his acts and doings in and about said estate to the Judge of the said Court or to his successors in office and will pay over to the proper persons or to the legal representatives all sums of money or property belonging to said estate whenever legally required so to do. Larche Elias George State of Louisiana 12th Judl. Disct. Court Parish of Union Whereas Benjamin F. George has been duly and legally appraised Administrator of the estate of Washington L. George, Decd. by the clerk of the 12th Judicial District Court in and for the Parish and State aforesaid and hath given bind and taken the oath prescribed by law. Now therefore he is hereby duly and legally authorized to do and perform all and singular the duties appertaining to said appointment according to law. To the Honorable the Judge of the 12th Judicial District Court in and for the Parish of Union, State of Louisiana. The petition of B. Frank George of the Parish and State aforesaid respectfully represents unto your honor shows that having been duly appointed as admin. Of the Estate of Washington L. George, Decd. he has fully administered the same and herewith files his acct. of the same it being a full complete and final account of all his proceedings in the administration of said Estate from the said account. It appears that the debts have all been paid without the sale of the property and nearly all the property upon the Inventory of said Estate is herewith returned that the administrator has paid debts of the succession to the amount of $4817.62 and that there is a balance due the administrator of one thousand seventy two and 2/100. Petitioners avers that he has paid all the debts of the succession and there is no necessity of continuing his administration that the debts being just and the estate solvent he has paid them without awaiting an order of court. Wherefore he prays that this his final act be advertised according to law and after the legal delays the same be approved and homolgated according to law that he have judgement against the succession for One thousand Seventy two and 2/100 Dollars. It being the balance due petitioner as per said account with Int. according to law that petitioner be authorized to turn over the effects of said succession to Mrs. Martha George, the surviving widow of decd. husband and natural Tutrix of the minor and sole heirs of said Estate and upon his so doing and producing her receipts for the same that his bond may be cancelled and he be discharged from all responsibility as administrator as aforesaid for all orders necessary in the presence and for general relief. Jno. L. Barrett, Atty. Benjamin F. George, administrator of the estate of Washington L. George, Decd. in account with said Estate. The administrator charges himself with the amount of the inventory of said estate made by order of Court and dated July 11th 1857. Amounting to thirteen thousand Dollars four hundred eleven dollars $13411.00 Also with the cotton crop of 1857 the net proceeds of which as per account sales was two thousand and thirty nine and 65/100 dollars $2039.65 He also charges himself with the proceeds of the cotton crop of the year 1858 which was per a/c sales amounted to fifteen hundred forty seven and 95/100 Dollars $1547.95 $16998.60 The administrator herewith returns of the Inventory of said estate with which he is chargeable except. 1 note on James R. Ross for $117.00 cr. $ 117.00 Double barrel Gun $ 35.00 $ 152.00 Amounting to thirteen thousand two hundred and fifty nine dollars for which he claims a credit $13259.00 The administrator has paid the following debts for the Estate for which he claims a credit viz. George, Decd. the premises being considered is hereby ordered and decreed that the forgoing final account of B. F. George, administrator be advertised according to law. By reason of the law and the evidence on this case and by forth reason of the proper advertisements having been made and no opposition being filed thereto it is ordered adjudged and decreed that the within foregoing final acct. of B. F. George, Administrator of the Estate of W. L. George, Decd. be homologated in all its parts according to law. It is further ordered that B. F. George, Administrator have judgment against the succession of W. L. George in the sum of One thousand and seventy two and 2/100 dollars and that the said administrator be authorized to turn over the effects of said succession to Mrs. Martha George the surviving Widow of decd. and natural Tutrix to the minors and sole heirs of said estate and upon do doing and producing her receipt for the same that his bond as administrator be canceled. The petition of Martha Ann George a femme sole and resident as above respectfully represents unto your Honorable Court that on or about the 25th day of June 1857 Washington Lafayette George died at his residence in the above parish leaving the following minors to wit: Josephine A., William A. and Clarence A. George all the issue of his marriage with your petitioner. Petitioner being the mother of said minors and having contracted no second marriage since the death of her said husband is of right and by virtue of the law entitled to the tutorship of his children and to the administration of their property. The premises duly considered she prays your honor that she be appointed natural Tutrix to said minor children and that [blank] be appointed undertutor. She further prays for all other orders and decrees necessary to effect said appointment and for general relief. F. G. Hargis, Atty. for Petitioner State of Louisiana 12th Judl. Disct.
