To the Honorable the Judge of the twelfth Judicial District Court in and for the Parish of Union, Louisiana The petition of William A. Darby, a resident of your said Parish and State respectfully represents unto your honor that Permelia Gilbert, late of said Parish and Administratrix of the Estate of Charles L. Gilbert, Decd. departed this life lately to wit: on or about the 16th December Instant leaving the said Estate in an unsettled condition. He represents that the heirs of the Estate of Charles L. Gilbert are also the heirs of said Permelia and that both Estates merge into one. He represents that it is therefore necessary that an administrator be appointed to settle the Estate of Charles L. Gilbert finally and as an inventory has already been had for the partition of the same said inventory will serve as a basis for the Administration. He prays to be appointed Administrator of said Estate of Charles L. Gilbert, Decd. and for all such orders and decrees in the premises as may be necessary. H. Regenburg, Atty. O. Larche, Clerk State of Louisiana 12th Judicial District Court Parish of Union It is ordered that William A. Darby be and he is hereby appointed Administrator of the Estate of Charles L. Gilbert, Decd. upon giving bond and taking the oath prescribed by law. That letters do issue him. Done and signed in office this 29th day of December AD 1859. Thos. C. Lewis, Clerk State of Louisiana Parish of Union Know all men by these presents that we William A. Darby as principal and William C. Carr and S. C. Lee as his securities are held and firmly bound unto Robert W. Richardson, Judge of the 12th Judicial District Court in and for the Parish of Union and State of Louisiana or to his successors in office in the full and just sum of Thirty thousand seven hundred and seventy five dollars, the true and faithful payment whereof well and truly to be made. We bind ourselves, our heirs, assigns, Administrators and legal representatives firmly by these presents dated this 29th day of December 1859. The condition of the above obligation is such that whereas the said William A. Darby has been duly and legally appointed Administrator of the Estate of Charles L. Gilbert, Decd. Now therefore if the said William A. Darby shall faithfully and impartially discharge all the duties incumbent on him in his said capacity and shall faithfully account to the Judge of the said court for all monies or property received from this or any state and shall render a true and faithful account to the Judge of said Court of all his acts and doing in and about said Estates and shall whenever legally required so to do pay over all money and deliver all the property belonging to said Estates to the proper person or persons to receive the same. Gilbert, Decd. and he hath given bond with good security and taken the oath prescribed by law. Now therefore the said William A. Darby is hereby duly and legally authorized and empowered to do and perform all and singular the acts appertaining to said appointment according to law. Gilbert, Decd. both real and personal upon the following terms to wit: The land on a credit of one, two and three years. The slaves on one and two years, the personal property on a credit until the first of January AD 1861. All sums of five Dollars and under Cash. Purchasers giving their notes with approved security and to bear eight per cent interest from date. And a mortgage retained upon the land and slaves. Land after the legal advertisement of the same for more than thirty days in the Union Democrat, a paper published in the town of Farmerville in said Parish and after reading the terms of sale, I proceeded to sell at Public Auction to the last and highest bidder at the last residence of said Charles L. Gilbert, Decd. on Monday the 30th of January AD 1860 the following described property to the following purchasers to wit: To R. M. This amount is contained in the notes taken for the property sold and in accordance with the orders of your honorable court. He represents that all the debts as far as he has been able to ascertain, have been paid and that to the best of his knowledge the Estate is finally settled up. He therefore prays that this account may be advertised according to law and after due proceedings had, be homolgated allowed and approved and that he may deliver over to the heirs of the Estate for partition the notes aforesaid and on so doing that he may be discharged from the administration and that his bond be cancelled and for such other orders and decrees in the premises as the case requires and for general relief. Gilbert, Deceased By reason of the law and the evidence in this case and by further reason of the proper advertisement having been made and no oppositions being filed thereto. It is ordered, adjudged and decreed that the within and foregoing final account of W. A. Darby, Administrator of the Estate of Charles L. Gilbert, Decd. be homolgated in all its parts according to law. It is further ordered that the said W. A. Darby, Administrator deliver to the heirs of the Estate for partition the notes mentioned in the final account and on so doing that he may be discharged from the administration and that his bond be cancelled.
