Gilbert [NOTE: In the first document Emma A. is named as Elizabeth A.] Union Parish Louisiana Succession Book E, pp. 655 - 657 ================================================================================== NOTE: Charles Larkin Gilbert died in 1853 and his wife Permelia A. Taylor Gilbert in 1859. This record deals with the appointment of a legal guardian (tutor, in Louisiana legal lingo) for their two youngest children. ================================================================================== To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana. The petition of Richard M. Gilbert of the Parish and State aforesaid respectfully represents that the minor heirs of C. L. Gilbert, Decd. to wit: Chas. H. Gilbert and Elizabeth A. Gilbert are without a tutor, that it is necessary a tutor should be appointed to them and that petitioner is their nearest male relative of age and at home and he is their brother that they have some property and it is necessary for someone to be authorized to take charge of the same and manage for the minors. Therefore he prays that he be appointed tutor to the said minors after the legal delay and that on giving the required bond, that letters of Tutorship do issue accordingly and that an Inventory of the property of said minors be made according to law and for all other orders and decrees necessary in the premises and for general and equitable relief &c. Jno. L. Barrett, Atty. State of Louisiana 11th Judicial District Court Parish of Union It is hereby ordered and decreed that the within application of Richard M. Gilbert to be appointed Tutor of the minors Chas. H. and Emma A. Gilbert be advertised according to law. It is further order that William C. Smith, Parish Recorder &C be and he is hereby authorized to make an Inventory and appraisement of all the property belonging to the said minors and due return thereof make to this office. Done and signed in office on this the 17th day of March AD 1865. Thos. C. Lewis, Clerk State of Louisiana 11th Judicial District Court Parish of Union The premises considered and by reason of the proper advertisement having been made and no opposition being filed thereto. It is hereby ordered and decreed that Richard M. Gilbert be and he is hereby appointed and confirmed as Tutor of the Minors Chas. H. and Emma A. Gilbert and that upon his giving bond with good security and having taken the oath prescribed by law that letters do issue to him. It is further ordered that [blank] be appointed Under tutor of the said minors and upon his taking the oath prescribed by law that letters of Under Tutorship do issue to him. Done and signed in office on this the 8th day of May AD 1865. Thos. C. Lewis State of Louisiana 11th District Court Parish of Union Know all men by these presents that we Richard M. Gilbert as principal and [blank] his security are held and firmly bound unto Honorable W. B. Egan, Judge of the 11th Judicial District Court in and for Union Parish, State of Louisiana for the time being or to his successors in office in the just and full sum of [blank] dollars to the true and faithful payments whereof well and truly to be made, we bind ourselves, our heirs, assigns and legal representatives firmly by these presents. Dated at Farmerville, La. on this the 8th day of may AD 1865. The condition of the above obligation is such that whereas the above bounden Richard M. Gilbert has been duly and legally appointed and confirmed as Tutor of the following minor heirs of the Estate of C. L. Gilbert, Decd. to wit: Charles H. And Emma A. Gilbert and he has taken the oath prescribed by law. Now, therefore if the said Richard M. Gilbert shall faithfully and impartially discharge all the duties incumbent on him in his said capacity and shall render a true and correct account of all his acts and doings in and about said matter of Tutorship to the Judge of said Court and shall faithfully look after the interest of said minors in all things thereto pertaining and shall whenever legally required so to do pay over all sums of money and deliver all the property in his hands belonging to the said minors to the proper person or persons to receive the same then and in that case this obligation to be null and void, otherwise to be and remain in full force and effect against the principal and his said securities. Gilbert, do solemnly swear that I will faithfully and impartially discharge all the duties incumbent on me as Tutor of the following minor heirs of the Estate of C. L. Gilbert, Decd. to wit: Charles H. and Emma A. Gilbert according to the best of my abilities and understanding. So help me God. R. M. Gilbert State of Louisiana 11th Judicial District Court Parish of Union Whereas, Richard W. Gilbert has this day been duly and legally appointed and confirmed as Tutor of the following minor heirs of the Estate of C. L. Gilbert, Decd. to wit: Chas. H. and Emma A. Gilbert and he has given bond with good security and has taken the oath prescribed by law. Now, therefore, the said Richard W. Gilbert is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to said appointment according to law.
