Union Parish Louisiana Succession Book A, pp. 112 – 118 ================================================================================== ================================================================================== To the Honorable John Taylor, Judge of the Court of Probates in and for the Parish of Union, State of Louisiana. The petition of Matthew Wood, a resident of your said Parish and State with respect represents unto your Honor that he has purchased and is now the owner of the equal undivided interest of Francois Goulette and Caroline Goulette now the wife of David E. Allen in and to a Tract of Land situated in your said Parish on the Ouachita River having six arpents front running forty arpents back containing two hundred and forty arpents inherited in common with their co-heirs from their Father and Mother Francois and Josette Goulette, Deceased and the same that was inventoried as their property. You petitioner further represents that by the purchase aforesaid he is now the owner of the two undivided sevenths of said Tract of Land and that the following persons are also interested therein as heirs of the said Francois and Josette Goulette, Deceased. To wit: Alexis Goulette, son of the said Francois and Josette Goulette, Edmund and Louise Goulette, minor children of Gabriel Goulette, Decd. and who have no Tutor at present, Edmond Cabrara minor child of Aspana Goulette, Decd. who was daughter of Francois and Josette Goulette, Decd. by her marriage with Edmond Cabrara who has as yet not been confirmed as natural Tutor of his minor child Modesta, Augustine, Joseph, Adeline and Jerome Pivoto minor children of Roselle Goulette, Decd. daughter of the said Francois and Josette Boulette, Decd. by her marriage with Augustine Piroto also decd. who have no Tutor at present, all resident of your said Parish and State and Louis Goulette, son of the said Francios and Josette Goulette, Decd. a minor represented by his Tutor Antonio Drago, a resident of the Parish of Ouachita in said State. Your petitioner further represent to your Honor that he is unwilling to hold said land in common and undivided with the aforesaid persons and heirs any longer. Wherefore he prays your Honor to decree a partition of the same and that your Honor appoint Tutors ad hoc to represent the minors interested therein who have no Tutors legally appointed, and that your Honor cause all the aforesaid persons and heirs interested therein as aforesaid to be cited in the Partition and that your Honor appoint experts to appraise the property and report whether the same should be Partitioned in kind or sold in order to effect a partition. Petitioner further represents that it would be diminishing the value of this property to partition it in kind. Wherefore, he prays that it be sold in order to effect the Partition and on such terms as your Honor may deem most advantageous and for all such other and further decrees in the premises as the nature of the case may require &c. State of Louisiana Parish of Union Let the prayer of the Petition be granted and it is ordered that David Ward be appointed Tutor ad hoc for Edmund and Louise Goulette, minor children of Gabriel Goulette, Deceased, that Edmond Cabrara be appointed Tutor ad hoc for his minor child Edmund Cabrara and that David Ward be appointed Tutor ad hoc for Modesta, Augustine, Joseph, Adeline and Jerome Pivoto, minor children of Roselle Goulette, Deceased and that W. C. Carr and Thomas Vanhook be appointed experts to appraise the property and say whether a Partition in kind can be made without diminishing the value of the Property and that the parties be cited according to law. David Ward, Tutor ad hoc Edmund Cabrara, Tutor ad hoc Alexis Gulett heir Antonio Drago State of Louisiana Parish of Union We do solemnly swear that we will to the best of our abilities and understanding appraise the trace of land owned by the heirs of Francois and Josette Goulette, Decd. and their assigns and say whether in our opinion it can be partitioned in kind without diminishing its value. Carr, experts appointed by the Honorable Probate Court in said Parish to appraise a tract of land owned by the heirs and assigns of Francois and Josette Goulette, Deceased and to give our opinion whether it can be divided in kind or not without diminishing its value do report as follows, to wit. We appraise the land at two dollars, twelve & half cents per arpent and further give it as our opinion that it would be diminishing the value of the property to divide it in common and that it would be to the interest of all parties to have it sold in order to effect the partition. Parish of Union Heirs of Francois & Josette Goulette By reason of the law and evidence and by further reason of the report of Experts, it is ordered, adjudged and decreed by the Court that a partition be made as prayed for and that the land be sold on a credit of one, two and three years purchaser giving personal security and a Mortgage on the property sold in order to effect a Partition after the legal and usual advertisements according to law. Done and signed in Chambers on this 27th day of February AD 1840. John Taylor, Judge State of Louisiana Probate Sale Parish of Union Be it remembered that on this the 1st day of April AD 1840 that I John Taylor, parish Judge and Ex Officio, Judge of Probates and Auctioneer in and for said parish and State in pursuance of a decree of the Honorable the Court of Probates of said parish. I have at the late residence of Josette and Francois Goulette, Deceased proceeded to offer for sale after the legal and usual advertisements at three public places in said Parish from Saturday the 28th Feb. until Tuesday the first day of April 1840 the same not published in any newspaper being none printed within fifty miles at the time. The land of the said Decedents situated on the west Bank of Ouachita River being six arpents front running forty back sold to effect a partition with the heirs and legal representatives of the said Josette & Francois Goulette, Decd. Conditions of sale (unreadable) one, two and three years, purchaser giving notes with approved security and a mortgage on the premises at ten per cent per annum from the first of April 1841 until paid whereupon after due proclamation the following person become the purchaser as the last and highest bidder upon said conditions to wit: Gramon Cabro $960.00 John Taylor, Parish Judge The purchaser Gramon Cabro failing to comply with the conditions of sale, I have readvertised the said land to be sold on the 15th day of June 1840. April 1st 1840. John Taylor, Judge State of Louisiana Probate Sale Parish of Union Be it remembered that on this the 15th day of June AD 1840 that I John Taylor Parish Judge and Ex Officio Judge of Probates and Auctioneer in and for said Parish and State in presence of the Honorable the Court of Probates of said Parish. I have at the late residence of Josette and Francois Goulette, Deceased preceded to offer for sale after the legal and usual advertisements at three in said Parish from May the 13th day until Monday the fifteenth day of June 1840 the land of the said decedents situated on the west bank of Ouachita River being six arpents front running forty back sold to effect a partition with the heirs and legal representatives of the said Josette and Francois Goulette, Decd. Condition of sale a credit one, two and three years. Purchaser giving notes with approved security and a mortgage on the premises at ten percent per annum the first of April 1841 until paid where upon after due proclamation the following person became the purchaser as the last and highest bidder upon said conditions to wit: Peter F. Neman $840.00 The purchaser Peter F. Neman failing to comply with the conditions of sale, I have readvertised the said land to be sold on the 15th day of October 1840. June 15th 1840. John Taylor, Judge State of Louisiana Probate Sale Parish of Union Be it remembered that on this 15th day of October AD 1840 that I John Taylor, Parish Judge and Ex Officio Judge of Probate and Auctioneer in and for said Parish and State in presence of a decree of the Honorable the Court of Probates of said parish. I have at the Town of Farmerville proceeded to offer for sale after legal and usual advertisement at three public places in said parish and also in the Olive Branch published at Monroe, Ouachita, La. from Saturday the 12th of August last until Tuesday the 13th day of October interest the land of Francois and Josette Goulette, Decd. situated on the west bank of Ouachita River being six arpents front running forty back sold to effect a partition with the heirs and legal representatives of the said Josette and Francois Goulette, Decd. Conditions of sale a credit one, two and three years purchaser giving small notes with approved security and a mortgage on the premises at ten per cent per annum on the whole amount from the first of April 1841 until paid.
