The petition of Lonny A. Gully and names W. Davenport her husband, both residents of your said Parish respectfully represents unto you honor that petitioner Lavincy A. Gully is the mother of Jennie, John and Matthew Goyne, Minor heirs of [blank] Goyne, Decd. that said minors are the issue of a former marriage of your petitioner Lavicy A. Goyne with said [blank] Goyne, Decd. that at the death of the father of said minors, he and your petitioner Lavicy A. Gully [unreadable] possessed of a small amount of property real and personal all of which was community property, that one half of said community belongs of right to said minors, that petitioner L. A. Gully by contracting the marriage with her present husband Warren Davenport forfeited her right as Natural Tutrix, that it is necessary that a family meeting be convoked for the purpose of recommending some suitable person to be appointed Tutor to said minors and that an inventory be made of the property. Wherefore petitioner prays your honor that the Recorder and Ex Officio be ordered to make an Inventory of all the effects belonging to the Estate of [blank] Goyne, Decd. and that a family meeting be convoked for the purpose of recommending a suitable person to be appointed to said minors and an Under Tutor and for all other orders and decrees necessary in the premises and for general relief. C. Smith, Recorder &c for the purpose of advising and recommending on the appointment of a Tutor and Under Tutor to the said minors and it is further ordered that W. C. Smith, Parish Recorder do proceed to make and Inventory and Appraisement of all the property belonging to the said Estate of H. Goyne, Decd. and due return thereof make to this office. Smith State of Louisiana Parish of Union Be it remembered that on this 27th day of December AD 1866 pursuant to an order of the Honorable 11th Judicial District Court in and for Union Parish, State of Louisiana and to me William C. Smith, Recorder and Ex officio Notary Public in and for said Parish directed, I caused to come before me at my office in the Town of Farmerville in said Parish the following relatives and friends of the minor heirs of Harrison Goyne, Decd. to wit: John M. Gully, Henry B. T. Goyne, Simpson W. Ramsey, Frederick H. Cann, Robert C. Webb convoked as a family meeting for the purpose of recommending a suitable person to be appointed Tutor or Tutrix and Under Tutor to said minor heirs who being first duly sworn by me proceeded to deliberate and advise on the subject matter as above set forth and after mature deliberations they advise and recommend that Mrs. Lavincy A. Davenport the Natural mother of said minors viz: Jenny Goyne, Matthew Goyne, and John Goyne be appointed Tutrix and her husband Warren M. Davenport, Co-Tutor and that Joseph R. Goyne, the uncle of said minors be appointed Under Tutor and complying with the law in such cased made and provided. Thus done and signed in my office in the Town of Farmerville in the presence of Henry B. Walters and George Rossiter, lawful and competent witnesses this the day and date above written. The petition of [blank] a resident of your Parish aforesaid respectfully represents unto you that a family meeting has been duly held pursuant to an order form your Honorable Court before W. C. Smith, Parish Recorder and Ex Officio Notary Public for the purpose of recommending a suitable person to be appointed Tutor of the minor heirs of [blank] Goyne, Decd. that said family meeting recommended that L. Gully, mother of the said minors and wife of your petitioner be appointed Tutrix of said minors and petitioner, Co-Tutor. Petitioner prays your honor that the proceeding of said family meeting be homologated in all its parts for all orders and decrees necessary in the premises and for general relief. R. W. Futch, Atty. State of Louisiana 11th Judicial District Court Parish of Union By reason of the law and the endurance in this case, it is hereby ordered, adjudged and decreed that the process verbal be and the same is hereby allowed approved and homologated in all its parts according to law. Goyne and Wm. A. Darby as her securities are held and firmly bound unto the Honorable J. D. Watkins, Judge of the 11th Judicial District Court for the true being and to his successors in office in the just and full sum of Two thousand three hundred and fifty four dollars to the true and faithful payment whereof to be and truly to be made we bind ourselves, our heirs, assigns and legal representatives firmly and in solido by these premises. Dated at Farmerville, La. this 17th day of January AD 1867. Now, the condition of the obligation is such that whereas the above bounden Lavincy A. Davenport has been duly and legally appointed Tutrix to the following minor children, heirs of the Estate of Harrison Goyne, Decd. to wit: Jincy A., Mathew and John W. Goyne and she has taken the oath re1quired by law. Now therefore, if the said Lavincy A. Davenport shall faithfully and impartially discharge the duties incumbent on her as Tutrix to the said survivors and shall render to the Judge a true and correct account of all her acts and doings in and about the said appointment and shall render wherever legally required so to do pay over all sums of money and disclose all the property of whatever nature belonging to the said minors then this obligation to be null and void. Goyne, Deceased and being assisted by Simpson W. Ramsey and Robert C. Webb, male citizens of lawful age and domicile who being duly appointed and sworn by me as appraisers and in presence of witnesses proceeded to make said Inventory and Appraisement as herein after mentioned. 31 acres of land more or less situated in the Parish of Union, known as the late residence of Harrison A. Goyne has been duly and legally appointed Under Tutor of the following minor children to wit, Jincy A., Matthew & John M. Goyne, heirs of the Estate of Harrison Goyne, Decd. and he has taken the oath prescribed by law. Now therefore, the said Joseph R. Goyne is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to said appointment according to law. The petition of Lavincia A. Davenport, wife of Warren M. Davenport, husband both residents of the Parish aforesaid respectfully represents unto your honor that petitioners are Tutrix and Co-Tutor of the minors Jincy, John & Matthew Goyne, that the property belonging to said minors [unreadable] half of the [unreadable] property which existed between the father of said minors and your petitioner, Levincy A. Davenport who is the surviving partner in community of said father of said minors. Petitioner represents that it is necessary that a partition be affected between said minors and their said mother Lavincy A. Davenport and that the property and [?] to be sold before then can be a partition. There are also more debts against the Estate of Harrison Goyne, Decd. that must be paid. Wherefore petitioners pray your Hon. That an order of sale issue from your honorable Court authorizing your petitioners to sell after legal advertisement all the property belonging to the succession of Harrison Goyne, Decd. that said sale be made according to law. For all other orders and decrees necessary in the premises and for general relief. R. W. Futch, Atty. State of Louisiana 11th Judicial District Court Parish of Union The premises considered, it is hereby ordered, adjudged that all the property both real and personal belonging to the Estate of Harrison Goyne and be sold in accordance with articles 990 and 991 of the Code of Practice for the purpose of paying the debts of the said Estate. And it is further ordered that Mrs. Lavincy A. Davenport, Tutrix to the said minor heirs of said Estate make the said sale and due return thereof make to this office.
