Graves, be it remembered that on this the 3rd day of January 1872, in my office in the Town of Farmerville, parish and state above written at 10 o’clock a.m. the time and place fixed for the Probate of the will of Mrs. Happe S. Graves, decd. and it appearing that said last will of said decd. was executed in accordance with the laws of the State of Vermont where said deceased resided at the time of the execution of said will and it appearing further that two of the witnesses to wit: Ellen Derby and Hannah B. Howe are decd., the testimony of the sole surviving witness Eliza H. Collins taken before Walter C. Dunton, Probate Judge of the County of Rutland, State of Vermont being produced duly certified and read in evidence and this being the only evidence obtainable and pertaining to said will the court hereby probates said will and decrees the said Mrs. Bell Mingo Trimble a resident if said parish and State to be the sole legatee of the said deceased interesting all her property, rights and credits as provided in last will of deceased and that said will be executed and recorded and that the original be deposited in the clerks office of said parish and State. Done and signed in chambers this 3rd day of January 1872. T. B. Tompkins Parish Judge Process Verbal The above mentioned will was duly presented by petitioner of J. E. Trimble and read aloud and the proof thereof was made by reading the testimony of Eliza H. Collins whose testimony was taken before Judge Walter C. Dunton of Rutland County, Vermont, after which the will was read in a clear audible voice to be heard by persons present, after which the court rendered a decree probating said will and ordering it executed and recorded and deposited in the Clerk’s office of said Parish and State, after it had been signed, we verified at the beginning and end of each page. This cone, read and signed in chambers on this 3rd day of January 1872. T. B. Tompkins Parish Judge State of Vermont Rutland County I, Walter C. Dunton of Rutland in the County of Rutland aforesaid and State of Vermont being duly sworn on oath say that I am Judge of the Probate Court in and for the district of Rutland in same county and am a lawyer by profession and have practiced in the State of Vermont for the last ten years. I further say that I have examined the last will and testament of Happalonia S. Graves marked for [unreadable] W. C. D. October 2, 1871 in the back thereof and I have also read the affidavit of Eliza F. Collins subscribed and sworn to before me this 2nd day of October 1871 and marked W. C. D. October 2, 1871 on the back thereof. I further say that said last will and testament of the said Happalonia S. Graves is executed in due form as required by the laws of the State of Vermont and that the said affidavit of the said Eliza F. Collins sets forth and proves all the facts required to admit said last will and testament to probate in this State. Walter C. Dunton Subscribed and sworn to before me this 2nd day of October AD 1871. Henry H. Smith Rutland County Clerk State of Vermont County of Rutland Personally appeared before me the undersigned legal authority Mrs. Eliza F. Collins, resident aforesaid and to me well known who after being sworn by me says that she was well acquainted with the late Hapelonia S. Graves, deceased, that on the 2nd day of November AD 1865 affiant was present at the making and signing of the will of the said Hapalonia S. Graves and saw said deceased sign the will made on that day and date, said will for identification is marked WCD Oct. 2nd AD 1871. Affiant further declares that she signed as attesting and subscribing witness in the premises of Hannah B. Howe and Ellen Derby and that she said Hannah B. Howe and Ellen Derby signed in the presence of affiant as subscribing witnesses was called for the purpose as the requires of the said Testatix Mrs. H. S. Graves, deceased of witnessing the will above described and that the signatures were affixed each in the presence of the other affiant further swears that she recognizes the signatures of the Testatix Hapalonia S. Graves deceased was on the day and date of the making of said will of sane mind and memory. Eliza F. Collins Sworn and subscribed to before me on this 2nd day of October AD 1871. Walter C. Dunton Judge of Probate For District of Rutland In the State of Vermont I, Hapalonia S. Graves, of Castleton in the County of Rutland and State of Vermont do hereby make this my last will and testament. I give grant and bequeath to my niece Belle Mingo Trimble of Farmerville in the State of Louisiana all my estate both real and personal including all my goods, chattels, rights, credits and choices in action to have and to hold the same to her and her heirs forever to her sole use and benefit. I also nominate, constitute and appoint my friend John Howe of Castleton aforesaid sole executor of this my last will and testament. In testimony whereof, I hereunto set my hand and seal and publish and declare this to be my last will and testament this 2nd day of November AD 1865. Happa S. Graves Signed, sealed, published and dated by the said Happalonia S. Graves as her last will and testament in presence of us who have hereunto subscribed our names as witnesses thereof at the request and in the presence of the said Testatrix and in the presence of each other. Eliza F. Collins Hannah B. Howe Ellen Dearby To the Honorable the Judge of the Parish Court in and for the Parish of Union, State of Louisiana. The petition of James E. Trimble for his wife Isabella Mingo resident of said parish of Union and State of Louisiana would respectfully represent that Mrs. Happa S. Graves departed this life on or about the 24th day of July AD 1870 in the Parish of Union and State of Louisiana. Petitioner avers that said Happa S. Graves, Decd. left her last will and testament constituting and declaring Isabella Mingo Trimble her sole heir and legatee which will is herewith presented. Petitioner avers that the Executor appointed under said will declares accepting said Will. Wherefore your petitioner prays that the will herewith presented be probated and that said Bella Mingo Trimble be declared sole heir and legatee of said deceased Happa S. Graves and for all such other orders and decrees as are necessary in the premises and further prays for general relief &c. J. E. Trimble A true record, December 3rd, 1873. W. W.
