Fanny was born about 1857 in Alabama, so it appears that Horatio McLaine married Fanny's widowed mother in Alabama. In 1870, Horatio operated a store in Shiloh. Fanny was listed as Fannie McLaine. ================================================================================= ================================================================================= To the Honorable the Judge of the Parish Court of Union Parish, State of Louisiana. The petition of Horatio McLain, a resident of your aforesaid Parish and State respectfully represents that his step daughter, Fanny Gray, the daughter of Plaintiff’s wife about 13 years of age is without a Tutor and having some means, it is necessary that a Tutor should be appointed. It is further alleged that her mother, the wife of Petitioner was the Natural Tutor of said minor, but that having contracted a second marriage with Petitioner, she forfeited that right by marrying without having convoked a family meeting. Petitioner, therefore, prays that this his application be advertised according to law and after the legal delays that he be appointed Tutor to the said minor and suggest J. W. Shaw as Under Tutor and further prays for an Inventory of the effects of said minor to be made according to law and for all further orders and decrees necessary. Jno. Barrett, Atty. Parish Court of Union Parish, La. In the matter of the tutorship of the minor Fanny Gray. The premises considered, it is hereby ordered that the application of H. McLain to be appointed tutor of the minor Fanny Gray be advertised according to law and it is further ordered that W. C. Smith, Recorder and Notary Public proceed to make an Inventory of the property of said minor and he make due return thereof. Done and signed in chambers on this December 5th 1870. T. B. Tompkins Parish Judge Premises considered and by reason that the within application of Horatio McLain has been advertised for more than ten days as the law requires and no opposition has been filed to the same and by further reason that said H. McLain has given bond with good security for the faithful performance of his duties as tutor to the minor Fanny Gray which said bond has been duly recorded in the Books of Mortgages for Union parish, La. It is therefore ordered that said H. McLain be appointed tutor to said minor Fanny Gray and that J. W. Shaw be appointed Under tutor to said minor. Done and signed in office this 5th day of July AD 1871. T. B. Tompkins, Judge of the parish Court in and for the Parish of Union and State of Louisiana and to me William C. Smith, Recorder and Ex Officio Notary Public in and for said parish described authorizing and commanding me to make an Inventory and Appraisement of the property, rights and credits belonging to the minor Fanny Gray, a resident of Shiloh, Union Parish, State of Louisiana. I repaired to the village of Shiloh in said Parish and then being assisted by Wm. G. Simmons and David K. McLaurin, two male citizens of said parish of lawful age who being duly empowered and sworn by me as appraisers and in the presence of two lawful and competent witnesses proceeded to make said Inventory and Appraisement as pointed out to me by H. McLain as herein after set forth to wit: Thre thousand and three hundred dollars in the hands of W. A. Shaw of Macon County, Alabama guardian of Fanny Gray. Value by the appraisers as present by H. McLain $3300.00. Thus done and signed in the Town of Shiloh on this the 15th day of December AD 1870 in the presence of the under signed witnesses who sign with said appraisers and me Recorder. Moon and J. W. Shaw as his security and held and firmly bound unto the Honorable T. B. Tompkins, Judge of the parish Court of Union parish, La. for the time being and unto his successors in office in the just and full sum of five thousand dollars to the payment of which will and truly to be made, we bind ourselves, our heirs and legal representatives firmly and in solido by the presence. Dated at Farmerville, La. December 21st 1870. The consideration of this obligation is such that whereto the above bonds of Horatio McLain has been duly and legally appointed Tutor to the minor Fanny Gray and he has taken the oath required by law. Now therefore, if the above bounden Horatio McLain shall faithfully and impartially discharge all the duties incumbent on him as Tutor aforesaid and shall render to the Judge of the aforesaid Court a full and complete account of all his acts in and about said Tutorship and shall when legally required so to do pay over to the proper person or persons to receive all monies and deliver all the property belonging to the said minor. Then and in that case this obligation to be null and void. Otherwise, to be and remain in full force and effect against the principal and his said security.
