It is hereby name that the proceeding of the family meeting as declared in the above be homologated and confirmed and it is further decreed that George O. Griffin be appointed Tutor to Sydney H. & Mary Ann Griffin minor Children of George W. Griffin, deceased upon his complying with the law in giving bond & security and taking the prescribed. Done & signed in office on this the 11th day of May 1841. Thos. VanHook, Clk. To the Honorable the Judge of the 12th Judicial District Court in & for the Parish of Union, State of Louisiana. The petition of Samuel Griffin, a resident of your said Parish with respect represents unto your honor, that John H. Griffin, late Tutor to Sidney H. & Mary Ann Griffin, minor children of George W. Griffin, deceased, late of the State of Alabama departed this life on or about 26th day of March 1847 in the said Parish of Union leaving said minors without a Tutor. Petitioner further represents that he is the Paternal Uncle to said minors & that George O. Griffin a resident of the Parish of Morehouse is the Natural Uncle of said children and that there is no other relatives in this State and your petitioner alleges that on the 22nd day of April 1847 petitioner & the said G. O. Griffin filed their several petitions in the Clerk’s office of the 12th Judicial District Court in and for Union Parish, La. Praying to be appointed Tutor to said minors whereupon the Clerk’s called together a family meeting composed of some of the nearest friends of said minors to deliberate and advise who should be appointed to said Tutorship. Said Family Meeting convened in the Town of Farmerville in your said parish on the 24th of April 1847 & after deliberating, recommended that the said George O. Griffin be appointed Tutor to said minors as appears by the process verbal of Claiborn M. Smith, the recorder & Ex Officio Notary Public in and for your said parish & the said recommendation of said Family Meeting on file in the said Office marked D. Petitioners respectfully opposed the Homologation of the deliberation & recommendation of the said Family Meeting recommending the said Geo. O. Griffin to be appointed to said Tutorship petitioner particularly apposes the Homologation of aforesaid and the appointment of George O. Griffin, Tutor as aforesaid on the following grounds to wit; 1st that the said George O. Griffin resides in the Parish of Morehouse while this petitioner is a resident of your said parish & the said minors are also residents of Union Parish. 2nd the said George O. Griffin is a maternal uncle & a young man with no family and therefore is not a suitable person to be Tutor to young females or children of any kind. Which Petitioner is married man and the Paternal Uncle & the oldest man. 3rd the Family meeting was not unanimous in believing that George A. Griffin should have said Tutorship, although they all signed their recommendation four of them, believing that your petitioner should be appointed to said Tutorage and signed the deliberations through error not understanding their position believing at time that they signed the same that an opposition would set it aside for which they wished. 4th the process verbal of the Notary & deliberation of the family meeting is not made out & returned according to law being communicated unduly. 5th the family meeting has commenced George O. Griffin appointment to Tutorship when he the said George is appointed administrator to the estate & succession of his brother John H. Griffin, the former Tutor to said minors and the said estate is largely indebted to said minors. 6th the said George O. Griffin & the said minors and co-heirs to the estate of the said John H. Griffin, deceased the said George O. being his brother & the said minors by representation their mother having given sister of the said deceased their interest thereby conflicting. 7th that the said George O. Griffin claims whole estate of the said John H. Griffin after the debts are paid by virtue of the certain written agreement which the said George pretends was made & entered into between him and the said Joseph H. Griffin in the life time of said John Griffin, deceased, the said minors being legal heirs to the estate of the said John H. Griffin therefore the interest of the said George O. Griffin and the said minors conflict in various ways for which reason the said deliberation of the said family meeting should not be homologated or the said George O. Griffin appointed Tutor as aforesaid you petitioner retains his claim to the Tutorship of the said minors made by him by petition filed as aforesaid on the 22nd 1847 and alleges that the is the paternal uncle of said minors said petition marked B & of which reference is had. Wherefore he prays your honor that his opposition be sustained the homologation be refused and the appointment of the said George O. Griffin to the tutorship of the said be rejected & that he be appointed Tutor to said minors and that the said George O. Griffin & Simpson W. Ramsey Under Tutor to said minors be notified & cited according to law of this opposition & for judgment in his favor & cost & for all other and further orders that the nature of the case may require and for general relief as in duty bound &c. Bryan & Regenburg, Attys. Know all men by these presents that we George O. Griffin, Tutor of the minors children Sydney H. & Mary Ann as prescribed & Simpson W. Ramsey, Jas. E. Jones for the purpose of securing to the said minors a faithful administration & return of their property by the said Geo. A. Griffin, they are joined & firmly bound unto Geo. W. Copley, Judge of the 12th Judicial District Court in & for the Parish of Union, Louisiana for the time and his succession in office in the sum of two thousand dollars to the true & faithful payment of which we firmly bind ourselves, our heirs & assigns on this 19th day July AD, 1847. Daniel Griffin The consideration of the above obligation is such that the said George O. Griffin has been appointed Tutor of the said minor children Sidney H. & Mary Ann by the Clerk of this said Court in and for the said Parish. Now therefore if this above bounden Geo. O. Griffin shall discharge & perform all & singular the duties appertaining and faithfully administer the property of said minors and shall render to the said Judge or his successor in office or to the said Sydney H. & Mary Ann Griffin or to their heirs & legal representatives when legally required so to do, receive a true and faithful acct. of his acts and doings as Tutor aforesaid and returnable the property and money coming into his hands as Tutor aforesaid belonging to the said minors, the above obligation is to be null and void or else to be & remain in full force and effect.
