Griffin is undoubtedly the man who served as a substitute for Frederick H. Cann, a wealthy farmer born in England. W. N. Griffin enlisted as a private in Company E, 1st Louisiana Heavy Artillery in 1862. He died on 5 December 1862. The petition of Andrew J. Eubanks, a citizen and a resident of the aforesaid Parish and State respectfully shows that Wm. Griffin, late of your aforesaid Parish and State also lately died in the Army and left a small estate and consisting of rights and credits and a tract of land and also leaving seven children, Ann Griffin, the wife of petitioner and Ellen, Ella, Sally, Daniel, William and George Griffin, the last six being minors. Your petitioner avers that he is brother in law to the said minors and entitled to the tutorship. Wherefore, he prays that he be appointed legally to the said Tutorship on given bond and taking the oath prescribed by law and that an inventory and appraisement of the said minors property be made according to law and for all orders and decrees necessary in the premises and for general relief &c. Jno. L. Barrett, Atty. State of Louisiana Parish of Union It is ordered and decreed that the within application be granted upon Andrew J. Eubanks given bond and good security and taking the oath prescribed by law, that letters do issue to him as tutor to the minors of Wm. Griffin, Decd. It is further ordered that an Inventory and appraisement of the property belonging to said estate be made by W. C. Smith, Parish Recorder &c and that he make due return without delay. Egan Judge of the 11th Judicial District court for the time being or to his successors in office in the just and fully sum of fourteen hundred dollars to the faithful payment thereof well and truly to be made. We bind ourselves, our heirs, and assigns firmly by these presents. Dated Farmerville, La. January 17th 1863. The condition of the above obligation is such that whereas the said principal has this day been appointed tutor to the minor heirs of the Estate of William M. Griffin, Decd. and he has taken the oath required by law. Now, therefore, if the said Eubanks shall faithfully and impartially discharge all and singular the duties appertaining to said appointment and shall render a true and faithful account yearly to the Judge of all his acts and doings in and about said matter of tutorship and shall wherever legally required so to do pay over all sums of money or other property belonging to said estate to the heirs or the proper person or persons to receive the same, then this obligation to be null and void. Eubanks, Tutor of the minor heirs of the Estate of Wm. M. Griffin, Decd. respectfully annexes hereto the process verbal of a family meeting duly convoked under and order of your Honorable Court to advise as to the sale of the property of the Estate of the said Wm. M. Griffin, Decd. to pay debts and prays that the same be approved and he further prays for an order to sell all the said property according to law as advised by said family meeting and for an order of Court ordering the said property to be reappraised before selling and for general relief. Barrett State of Louisiana 11th Judicial District Court Parish of Union The premises considered, it is hereby ordered that these proceedings be and the same is hereby approved and homologated in all its parts according to law and it is further ordered that all the property belonging to said minors be sold in accordance with Articles 990 & 991 of the Code of Practice and that A. J. Eubanks, Administrator make the said sale and due return thereof make to this office and further that W. C. For 10 months @ $8 per month 88.00 The tutor herewith returns all of the property appraised less $111.25 cash. Collected for 6/7 of which he claims a credit to it $821.88 Sum total of Credits $1388.18 Recapitulation Amount of Debts of Tutor $917.22 Amount of Credits __1388.18 Balance due the Tutor $470.96 To the Honorable the judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana. Petition of Andrew J. Eubanks, Tutor of the minor heirs of Wm. M. Griffin, Decd. respectfully shows that he took charge of the Estate of said deceased as Tutor of the minor heirs and that he herewith files his account as Tutor up to date. From which it will be seen that the minors are in his debt in the sum of four hundred & seventy and 96/100 dollars. Petitioner represents that one half of the property of said minors as appears from the Inventory is land which is entirely unproductive and must remain so for many years and their hands, that five out of the six forties of the said land was entered during the war and the title is supposed to be mortgaged, that the personal property is perishable in its nature and ought to be disposed of, that the debts paid by the Tutor were all privileged except his own account for board which is just ought to be paid. He therefore prays that an Under Tutor be appointed to (which has not yet been done) whom this account may be submitted, that Ellen Griffin be duly cited personally and with the approval of said Under Tutor that the same be approved and homologated according to law. He further prays that a family meeting be convoked according to law to advise and recommend regard to the sale of all the land to advise and recommend regard to the sale of all the property of the said minors for the purpose of paying the debts contracted for their benefit by their tutor and the privilege debts which he has paid there not being enough personal property to pay the said debts and that the said property be appraised for the purpose of making the said sale and for all further orders and decrees necessary in the premises and for general relief &c. Tisdale be and he is hereby appointed Under Tutor to the minors to wit: Ellen, Helen I., Sally, Daniel, William and George Griffin on his taking the oath prescribed by law. Reid Clerk, District Court State of Louisiana 11th Judicial District Court Parish of Union The premises considered, it is hereby ordered, adjudged and decreed that a family meeting be convoked according to law by William C. Smith, Notary to advise and recommend with regard to the sale of the property both real and personal to pay the debts of said minors and that he make and return of the same according to law to this office. Griffin, Decd. and being assisted by John Taylor and James R. Albritton, male citizens of said Parish of lawful age and domicile who being duly appointed and sworn by me as appraisers proceeded to make said inventory and re-appraisement as follows: 1st 40 acres of land situated in the Parish of Union known as the late residence of Wm. M. Griffin with the improvements thereon apprd. @ 1.50 per acre. $60.00 3 feather beds 40.00 2 bed quilts, common 1.00 2 common pine bedsteads apprd. @ 3.00 1 trundle bedsteads apprd. @ 1.00 1 small pot apprd. @ 1.50 1 small looking glass apprd. @ .25 1 pair fire dogs apprd. @ _____.50 Total amount $107.25 Thus done and signed in my office in the presence of the undersigned lawful witnesses, who signs with said appraisers and me Recorder on this the 6th day of July AD 1867. J. Eubanks as Tutor of the minor heirs of the Estate of Wm. M. Griffin, Decd. be and the same is hereby allowed approved and homologated in all its parts according to law.
