Slayton, Deputy Clerk ============================================================= ============================================================= Union Parish Louisiana Succession Book F, pp. 427 - 431 ============================================================= ============================================================= To the Honorable the Judge of the 11th Judicial District Court, holding session in and for the Parish of Union, State of Louisiana. The Petition of Elizabeth A. Hargis, Administratrix of the Estate of F. G. Hargis, Deceased resident of your aforementioned State and parish with respect shows that the petition presented to your Honor November 8th 1866 for the sale of lots 35 & 46 in the Town of Farmerville is the property of the Estate of F. G. Hargis, deceased was made by [unreadable] of Petitioners attorney in settling for this, the said lots belonged to said Estate whereas the said Estate owns only an undivided one half interest in the said two lots situated as aforesaid. Therefore petitioner setting forth again that the said Estate is wholly insolvent, that there are minor heirs, that there exists a special mortgage and vendors privilege on these two lots in favor of C. H. Morrison made and executed by the said F. G. Hargis, Deceased, that said special mortgage due note give and payable corresponding with said mortgage and owed to said lots have been sold by said Morrison to Dr. Jeff F. Fuller subjecting him the said Fuller to all his rights and privileges as a mortgage creditor that said Dr. Jeff F. Fuller having purchased an undivided one half interest in the two said lots from the said F. A. Hargis, deceased and having raised the mortgage on the whole of the two lots as aforesaid perfects his, Fuller’s, title to an undivided one half interest and the rights and privileges of a mortgage creditor on the remaining one half interest in the two said lots, said notes and special mortgage still remaining in his hands against the said one half interest of the Estate and unsatisfied. Wherefore Petitioner prays that the order of sale of the entire two lots as aforesaid given by your Honorable Court 8th November 1866 be evoked and that you grant an order for the sale of the undivided one half interest of the Estate in said two lots No. 35 & 46 situated as aforesaid to satisfy and relieve said special mortgage and vendors privilege existing as aforesaid in the hands of J. F. Fuller and for all orders and decree necessary and for general relief. Tompkins & Lewis, Attys. State of Louisiana Parish of Union Let the prayer of the within application be granted and it is hereby ordered and decreed that the undivided one half interest of the Town lots Nos. 35 & 46 known as the property of the Estate of F. G. Hargis, decd. be sold in accordance with Articles 990 & 991 Code of Practice. And it is further ordered that Mrs. E. A. Hargis, the Administratrix, be and she is hereby duly and legally authorized to make the said sale after the proper and legal advertisement and due return thereof make to this office. Done and signed in office on this 16th day of November AD 1866. J. W. Reid Clerk, District Court To the Honorable Judge of the 11th Judicial Court in and for the Parish of Union, State of Louisiana. The Petition of E. A. Hargis, Administratrix of the Estate of Felix G. Hargis deceased, a resident of your said State and Parish, with respect shows that said Estate is greatly in debt and entirely insolvent, that there is no money in the hands of the petitioner to pay the numerous debts, that there is in the Inventory of the Estate two lots situated in the town of Farmerville described in said Inventory of lots No. 35 and No. 46 on block 3 on which the drug store and another small building now stands. Lot number 35 having 33 feet front on the Public Square and lot No. 46 having a front of 33 feet on the street next east of the Public Square and each lot having a length of 150 feet as described in the plot of the said Town of Farmerville. Petitioner further shows that F. G. Hargis, deceased, purchased these said lots from Charles H. Morrison, Esq. Giving his promissory note for the same to the said Morrison and the said Morrison receiving specially the vendors privileges and special mortgage on said lots to secure the payment of said note. Petitioner further shows that said Morrison sold said note receiving the money for the same to Dr. Jeff F. Fuller of your said parish and State subjugating the said Fuller to all his rights and privileges in the premises. Petitioner alleges that said note is still due and unpaid and still outstanding against the Estate. Wherefore she prays for an order to sale from your Honorable Court for selling said Lots to satisfy said special mortgage and vendors privileges on said property after due and legal advertisements and for all other necessary orders and decrees and for general relief. Tompkins & Lewis, Attys.
