Heard late of your said Parish departed this life at his residence on or about the 21st day of December last leaving your petitioner widow and partner in the Eternity and nine children the issue of the marriage between the deceased and Petitioner to wit: Jane, wife of James Grogis [?] of the state of Alabama, Elissa wife of Mosely Oats of the Parish of Claiborne, La, William C. Heard, Junr., Eva wife of Columbus Hoff, Francis wife of Alvin Davis, Martha Heard a minor, Thomas Heard a minor, James Heard a minor, Ephrem Heard a minor and also a considerable estate consisting of land personally property [unreadable] & credits. She prays that an inventory and appraisement may be had according to Law and that after due proceedings she may be appointed Administratrix of said Estate and for such other orders and duress in the premises and such general relief as the case require. Court Parish of Union The premises considered it is ordered and decreed that the within application of Mary Heard to be appointed Administratrix of the Estate of Joseph M. Heard Decd. be admitted according to Law. It is ordered that William C. Smith, Parish Recorder & Ex Officio Notary Public in & for said Parish & State be & he is authorized to make an inventory and appraisement of the Property belonging to the estate of Joseph M. It is therefore ordered and deduced that Mary Heard be and she is hereby appointed Administratrix of the Estate of Joseph M. Richardson, Judge of the 12 Judicial District Court in and for the Parish of Union and State of Louisiana for the time being or to his successors in office in the full and just sum of seven thousand six hundred & ninety six dollars. The true and faithful payment whereof well and firmly to be made we bind ourselves our heirs assigns and administrators Executors and legal representatives firmly by these presents. The condition of the above obligation is such that whereas the said Mary Heard has been appointed duly and legally Administratix of the estate of Joseph M. Heard, deceased and She has taken the oath prescribed by law. Now therefore if the said Mary Heard shall faithfully and impartially discharge all and singular the duties incumbent on her as administratix of the said estate and shall faithfully account to the Judge of the said Court for all moneys or property received (belonging to said Estate) from this or any other State and shall render a true and faithfully account of all her acts and doings in and about said Estate to the Judge of said Court and whenever legally required so to do to pay over all sums of money and deliver all the property of whatever nature belonging to said estate to the proper persons to receive the same then the above obligation to be null and void, otherwise to be & remain in full force and effect against the principal and his said successors. Heard a resident of your said Parish and State respectfully represents unto you that she is administratrix of the Estate of Joseph M. Heard, Decd. late of the said Parish & State. Petitioner represents that said succession is composed of Personal and real property a considerable portion of which is perishable and that it is necessary to the settlement of the debts against said succession that the perishable effects be sold. Wherefore your petitioner prays your honor for an order of sale ducting the sale of the personal effects of the said succession of Joseph M. Heard Decd. And that said sale be made on account till 1st of January next (1861). Purchases for all sums of five Dollars and over to give their notes with approves security and drawing 8 per cent interest from date. All sums under five dollars, cash, that said sale after having been advertised according to law be made on the 13th of October at the late residence of said Joseph M. Heard, Decd and that Petitioner be ordered to make it an finally for general relief. Charles A. Heard, Atty. State of Louisiana 12th Judl. District Court Parish of Union The premises being duly considered it is ordered and decreed that all the personal property belonging to the Estate of Joseph M. Heard decd. be sold on a credit with the 1st of January 1861 for all sums of Five Dollars and over purchasers giving their notes with approved Security bearing eight per cent interest form date, all sum under Five Dollars cash. It is ordered that Mary Heard the Admx. of said estate be authorized to make said sale. Done and signed in office on the 9th August 1860. Thos. C. The petition of Mary Heard a resident of your said Parish & State respectfully represents unto your Honor that she is the Administratrix of the estate of Joseph M. Wherefore your petitioner prays your Honor for an order of sale authorising the sale of the effects of said succession and that said sale be made on a credit till the 1st day of January AD 1862. That said sale after being advertised according to Law be made on the 24 day of November at the late residence of said Joseph M. Heard decd. and the Petition order to make it for general relief. State of Louisiana 12 Judicial District Court Parish of Union Succession of Joseph M. Heard, Decd. The petition having been duly considered it is ordered that the prayers of Petitioner be granted. It is further ordered that all the personal property of the estate of Joseph M. Heard Decd be sold on the following terms. All sums of five dollars and over on a credit until the first day of January AD 1862. Purchasers giving their notes with approved Security bearing eight per cent Interest from date until paid. All sums under five dollars, cash. It is further ordered that Mary Heard administratrix of said Estate be authorised to make said sale on the 24th day of November AD 1860. Guthrie, DC ================================================================================= ================================================================================= Union Parish Louisiana Succession Book F, pp. 446 - 448 ================================================================================== ================================================================================== To the Honorable the Judge of the 11th Judicial District Court holding session in and for the Parish of Union and State of Louisiana. The petition of Mary Heard, a resident of your said Parish and State, respectfully represents unto your honor, that she is the duly appointed Administratrix of the Estate of Joseph M. Heard, Decd., late of said Parish and State. Petitioner represents that said succession is composed entirely of real or landed property that it is necessary in order to effect a partition among the heirs that therein be an order of sale. Wherefore, your petitioner prays your court for an order of sale directing the sale of said effects of said succession and that said sale be made for one half cash on day of sale, the other half on a credit of twelve months, purchasers giving their notes drawing 8 per cent from date. Also with approved security and a special Mortgage retained on said land for punctual payment of the same. That said sale after being advertised according to law be made on the [blank] of December 1866 at the late residence of Joseph M. hears, decd. and that Petitioner be ordered to make it and further that if the said effects fail to being their appraised value, that said effects be offered a second time on the same day and sold to the highest and last bidder. And further that William C. Smith be appointed Administrator Ad Hoc to represent Jane Goodyer, an absent heir and for all such orders as the case may require and finally for general relief &c. C. A. For Petitioner State of Louisiana 11th District Court Parish of Union The premises considered, it is ordered that the prayer of the within application be granted and that all the property belonging to the Estate of Joseph M. Heard, Decd. be sold in accordance with article 990, 991 & 992 Code of Practice and in case the property failing to being its appraised value to be offered a second time on the same day. It is further ordered that Mrs. Mary Heard Admx. Of the Parish and State make the said sale and due return thereof make to this office and it is further ordered that William C. Smith be and he is hereby appointed curator and have to represent the absent heir Jane Goodyer. Done and signed in office this 3oth day of October AD 1866. J. W. Reid Clerk, District Court Pursuant to an order of the 11th District Court in and for the Parish of Union and State of Louisiana and to me directed authorizing the sale of all the property of the Succession of Joseph M. Heard, deceased, on terms one half cash, the other half on twelve months credit to affect a Partition of the same and having advertised the same according to Law to wit by publishing thirty days in the Union Record, a weekly newspaper published in the Town of Farmerville, Union Parish, La. from October 31st to December 3rd, 1866 of the same year, on the last day mentioned between the legal hours of sale at the late residence of the said Joseph M. heard, deceased. I, Mary Heard, Administratrix of said Estate having caused the terms of sale to be made known in a loud voice and the advertisement which hereto appeared having been read a loud did there and then proceed to offer at Public Auction the following described property for one half cash, the other half on twelve months credit when the following persons being the last and highest bidders did become the purchasers of the same as follows: John G. Hollis bought the south half of the south East fourth and North East fourth of the South East fourth of Section twenty two Township twenty two Range three West. The North half of the North East fourth of Section twenty seven Township twenty two Range three West and North West fourth of the North West fourth of Section twenty seven Township twenty two Range three West and North West fourth of the North West fourth of Section twenty six Township twenty two Range three West containing two hundred and eighty acres more or less @ ($2.76) two and 76/100 dollars per acres making in the aggregate ($772.80) Seven hundred and seventy two and 80/100 dollars with 8 percent per annum interest from date all paid $772.80 James T. Mabry bought the south half of the North West fourth, the North East fourth of the South West fourth, the North West fourth of the South East fourth of Section twenty six Township twenty two North Range three west containing two hundred acres more or less at one and 80/100 dollars per acre making ($360.00) three hundred and sixty dollars with 8 per cent per annum interest from date till paid $360.00 Alrah P. Davis bought the South East fourth of the North East fourth and the North East fourth of the South East fourth of section twenty six in Township twenty two Range three West the South fourth of the South West fourth Section twenty five South East fourth of the South West fourth of Section twenty six in Township twenty two North of Range three West containing one hundred and eighty acres more or less at three dollars per acre making four hundred and eighty dollars with 8 per cent interest from date till paid $480.00 Now therefore the terms of all having been complied with, I do hereby bargain, sell, transfer, deliver and adjudicate to each of the aforesaid purchasers all and singular the property purchased by each respectively by each as herein before set forth with full legal warranty.
