The petition of James Holland of your aforesaid Parish and state respectfully represents unto you Honorable Court that Moses Holland departed this life at his residence in said Parish of Union on or about the 21st of April AD 1860. Intestate leaving a small property consisting of Land personal property rights and curtails and the following being to wit: James Holland your petitioner his Jackson Holland another son decd. but represented by sundry minor children Elizabeth Holland a daughter wife of Allen G. Stripling and Esther Holland deceased but represented by a minor heir and also Civility Holland the surviving widow. Petitioner further avers that he is the only male heir of age in the state and as such is entitled to the administration of said estate whereupon he prays that after the legal advertisements and delay he be appointed administrator of said estate of Moses Holland, decd. and letters of administration to him on his giving bond and taken the oath prescribed by Law. The inventory of the said Estate be entered and for all other orders and decrees necessary in the premises and for general relief &c. Jno. L. & H. M. Barrett, Attys. State of Louisiana 12 Judl. District Court Parish of Union In the matter of the succession of Moses Holland, Deceased. The premises begin considered it is ordered that the aforesaid application of James Holland to be appointed as administrator of the Estate of Moses Holland be advertised according to Law and it is further ordered that W. C. Smith, Parish recorder & proceed immediately to make an inventory and appraisement of the Property of the Estate of the said Moses Holland, Decd. and make due return of the same to this office. Done and signed in office on this April 24th 1860. Thos C. Lewis, Clerk State of Louisiana Parish of Union The premises considered and that by reason by proper advertisement having been made and no opposition being filed in my office. It is therefore ordered and decreed that James Holland be and he is hereby appointed administrator of the Estate of Moses Holland decd. and upon his giving bond and good security. That letters do issue to him. Done and signed in office on this 7th May AD 1860. State of Louisiana 12th Judl District Court Parish of Union I James Holland do solemnly swear that I will faithfully and impartially discharge all and singular the duties incumbent on me as administrator of the Estate of Moses Holland, Decd. according to the best of my ability and understanding. Lewis, Clerk State of Louisiana 12th Judicial District Court Parish of Union Whereas James Holland has been duly and legally appointed admr. of the estate of Moses Holland, Decd. and he has given Bond and good security and has taken the oath prescribed by Law. Now therefore the said James Holland is hereby duly and legally authorized and empowered to do and perform all acts appertaining to said appointment according to Law. State of Louisiana Parish of Union Know all men by these presents that we James Holland as principal and Arthur Stripling as his Security are held and firmly bound by these presents unto Robt. W. Richardson Judge of the 12th Judl. District Court in and for the Parish & State aforesaid for the time being or to his successors in office in the full and Just sum of One Thousand five Hundred and six Dollars the true and faithful payment whereof will and truly to be made we bind ourselves our heirs administrators and legal representatives firmly by these presents dated at Farmerville, La. May 7th 1860. The condition of the above obligation is such that whereas the said James Holland has been duly and legally appointed administrator of the Estate of Moses Holland decd. and has taken the oath prescribed by law. Now therefore if the said Jas. Holland shall faithfully and impartially discharge all and singular the duties incumbent on him as administrator of said Estate and shall faithfully account to the Judges of the said Court for all moneys or property received belonging to said estate from this or any other state and shall under a true and faithful account of all his acts and doings in and about said estate to the Judge of said court and whenever legally required so to do to pay over all sums of money and deliver all the property of whatever nature belonging to said Estate to the proper person or persons to receive the said there the above obligation to be null and void otherwise to be and remains in full force and effect against the principal and his said securities. In pursuance of an order of the 12the District Court in and for said Parish and to me William E. Smith Parish Recorder and ex officio Notary Public in and for said Parish directed I repaired to the late residence of Moses Holland Deceased late of this Parish for the purpose of making an inventory and appraisement of all the property comprising the Estate of the said Moses Holland, Decd. both real and personal and whereas Arthur Stripling and Butler K. Tucker and Levi B. Cobb male witnesses of lawful age and domiciliated in the Parish and state aforesaid who have also signed their names with said appraisers and me the said Recorder on this the day and date written above with my hand and seal of office. District Court in and for the Parish of Union, State of Louisiana. James Holland your petitioner having been duly appointed by your Honorable Court administrator of the estate of Moses Holland Deced. respectfully represents that the said Estate is small as appears from the inventory that it is somewhat in debt and that it [unreadable] necessary in order to pay the debts that the property of said Estate be sold that the condition will wait some time further so that the property might be sold on a credit and that it is important that the sale be made as soon as possible on account of the perishable nature of some of it and the expense connected with keeping [unreadable] the balance. Whereupon he prays that an order be granted authorizing petitioner as admr. Aforesaid to sell all of the property of the Estate of Moses Holland decd. both real and personal the personal property on a credit till March 1st 1860 for all sums over five dollars. All sums under five cash and the land to be sold on a credit, one half payable March 1st 1861 and the other held payable March 1st 1862. Special mortgage and vendors privilege to be retained for all orders and decrees necessary in the premises and for general relief. Jno. L. Barrett, Atty. for Adm. State of Louisiana 12th Judl. Dist. Court Parish of Union Succession of Moses Holland Decd. by reason of the Law and the evidence in the premises being in favor of Petitioner. It is ordered that the prayer of the Petitioner be granted it is further ordered that James Holland Adm. Be and he is hereby authorized to sell at Public auction for the purpose of paying the debts of said succession all of the property both real and personal belonging to the same. The land on a credit, on half payable March 1st 1861 and the other half payable March 1st 1862 and personal property on a credit till March 1st 1861 with Int. on all from day of sale. Sums under five dollars cash with a special mortgage and vendors privileged retained on the land to secure the payment of the price of the same sale to be made after the legal administers and delays. Done and signed in office on this the 17th day of August 1860. Thos. C. Lewis, Clk. State of Louisiana Parish of Union Pursuant to an order of the 12th Judl. District Court in and for the Parish and State above written and to me directed authorizing me to sell all the property of the estate of Moses Holland decd. both real and personal to pay the debts of said Estate at Public Action the land on a credit payable ½ March 1861 and one half March 1st 1862 with 8 per cent Int. from date and a special mortgage and venders privilege retained on the said Land to secure the payment of the price of the same the personal property to be sold on a credit till March 1st 1860 for all sums of five Dollars and over purchasers giving their notes with a approved security and drawing 8 per cent Int. from date of sale all sums under five Dollars cash and the said sale having been conducted according to Law now herefore I James Holland Adm. of the above mentioned estate having on this the 31st day of August AD 1860 in accordance with above mentioned and advertisement which I caused to be publicly read did between the legal hours of sale offer at public Auction the following described property to the following persons with respectfully being the highest and last bidder become purchasers of the same as follows to wit: James Holland Bot. 1 Bed @ 22.25 James Holland also a wagon 50.00 James Holland also 1 mule 27.25 Also sundry other articles amtg. L. Barrett & Thos. C. Lewis lawful witnesses & specially called for the purpose. Jno. L. Barrett James Holland, Adm. Thos. C. Lewis James Holland Adm. in account with the Estate of Moses Holland Decd. The administrator charges himself with the amt. Of the Inventory of said Estate taken by William C. Smith, Recorder and filed May 3rd 1860 Amounting to twelve Hundred and four and 50/100 Dollars 1204.50 He further charges himself with the proceeds of sales over the amount of the inventory see process verbal of sale 247.80 The admr. claims credit for the land which he hereby returns to the Estate Appraised @ 800.00 He also claims credit for the following notes taken at the sale which he herewith returns to Estate to be partitioned by the proper authority amounting the sum of three Hundred forty five & 90/100 Dollars see list 345.90 The admr. has paid the following debts for which he claims a credit from the Estate of Thos. The petition of James Holland Adm. Of the Estate of Moses Holland Decd. respectfully shows that he has completed the Administration of the Estate and that he now files this as his full and final account of said Administration from said account it appears that the admr. charges himself with the whole amt of Inventory the excess of sales over the Inventory and other matters amounting to $1462.05. He credits himself with property returned $1145.90 and he has also paid debts of the Estate which he found to be just to the amount of $[blank] for which he has credits himself which leave a balance of $[blank] due by the admr. to the Estate. Wherefore he prays that this his final account be advertised according to Law that all parties in Interest be notified thereof and that after the legal delays should no opposition be filed that the said account be approved and homolgated in all its parts that then be a Judgment against the said admr. And in favor of the said Estate for the sum of [blank] Dollars with legal Interest from the date of this Judgment and that the said Administrator bond be cancelled upon his producing to the clerk a clear receipt from each of the heirs for the portion to each as decided by a Judicial partition for all orders and decrees necessary in the premises and for general relief. Jno. L. Barrett, Atty. State of Louisiana 12th Judicial District Court Parish of Union It is ordered that the within final account of the Estate of Moses Holland Decd. be advertised according to Law. State of Louisiana 12th Judicial District Court Parish of Union To Elizabeth Stripling of the Parish of Union Whereas James Holland Administrator of the Estate of Moses Holland Decd. has filed with the clerk office of the 12 Judicial District Court in and for the Parish of Union, State of Louisiana a final account of the Estate of said Moses Holland, Decd. asking that the said account be approved and homolgatged according to law. Now therefore you are hereby cited to appear within ten days from the service hereof in the office of the clerk of the said Court in the town of Farmerville and file your objections if any you have to the homolgation of the said account or else the same will be approved & homolgated in all its parts according to Law. Sworn says: The account has been advertised at the court house door for more than ten days. I hereby certify the above & foregoing to be all the evidence adduced in this trial this 13th Oct. 1860. Richardson, Judl. State of Louisiana 12th Judicial District Court Parish of Union In the matter of the final account of Jas. Holland Adm. by reason of the said account having been advertised for more than ten days and all parties rec. Int. in the Parish having been duly notified and no opposition having been filed it is ordered adjudged and decreed that the said account be approved and homolgagted in all it parts and that the said James Holland receive of said estate the sum of [blank] the bal. due on said account with legal int. from this date and on his delivering up the effects of the Estate which he returns as per said account to the notary to be partitioned & filing he receipt of the several heirs for their respective portions that his Bond as Adm. be caused this successor be released from al responsibility thereon.
