State of Louisiana Parish of Union To the Honorable the Judge of the 12th Judicial District Court in and for the Parish and State aforesaid. The petitioner Austin Honeycutt, a resident of the Parish and State aforesaid respectfully shows that on or about the 7th of May AD 1860, the wife of Petitioner Mrs. Susan Ann Mixon, departed this life at the residence of Petitioner in the State and Parish intestate leaving some property both personal and real in her own right besides a community of acquired and existing on her decease between herself and petitioner her husband and also leaving nine children her force heirs and the issue of her marriage with petitioner to wit: Margaret Jane Honeycutt, wife of John R. Shultz, John Burnard Honeycutt, Joel Austin Honeycutt, Mary Elizabeth Honeycutt, Feraby Susan Ann Honeycutt, James Wesley Honeycutt, Emarilla Eliza Permelia Honeycutt, William A. H. Cloy Honeycutt and Ira Britton Honeycutt. Petitioner further represents that the Estate is somewhat in debt and that an administrator of the same is necessary and that as survivor in community and the Natural Tutor of seven of the aforesaid minors which are her heirs, he prays that this his application be advertised according to law and after the legal delays he be appointed administrator of the said estate and upon his giving bond and taking the oath according to law that letters do issue in his favor and in the meantime an inventory of said estate be made according to law for all orders and decrees necessary in the premises and for general relief &c. State of Louisiana 12th Judicial District Court Parish of Union In the matter of the succession of Susan Ann Mixon Honeycutt and due process having been made before me and the previous considered, it is hereby ordered, adjudged and decreed that the foregoing petition of Austin Honeycutt to be appointed Administrator of the Estate of the aforesaid Deceased be duly advertised according to law. And it is further ordered that Wm. C. Smith, Parish Recorder &c do proceed individually to make an inventory of the Estate of Susan Ann Mixon Honeycutt, deceased according to law and that he make a return of the same to this office. Done and signed in office this the 5th day of June AD 1860. Thos. C. Lewis, Clerk State of Louisiana Parish of Union The premises considered and by reason that proper advertisement having been made and no opposition being filed in my office, it is ordered and decreed that Austin Honeycutt be and he is hereby appointed Administrator of the Estate of Susan Ann Mixon Honeycutt, decd. and upon his giving bond and good security and taking the oath prescribed by law that letters do issue to him. State of Louisiana, Parish of Union, 12th District Court Whereas, Austin Honeycutt has been duly and legally appointed Administrator of the Estate of S. A. M. Honeycutt, decd. and he has given bond and good security and has taken the oath prescribed by law. Now therefore the said Austin Honeycutt is hereby duly and legally authorized and empowered to do and perform all acts appertaining to said appointment according to Law. Given under my hand and seal of said court on this the 16th day of June AD 1860. J. L. G. State of Louisiana Parish of Union Know all men by these presents that we, Austin Honeycutt as principal and Wm. Willhite as his security are held and firmly bound unto Robert W. Richardson, Judge of the 12th Judicial District Court in and for Union Parish and State of Louisiana or to his successors in office in the full and just sum of Eleven thousand one hundred and sixty and 50/100 dollars to the true and faithful payment thereof we bind ourselves, our heirs and assigns in solid on this the 16th day of June AD 1860. The condition of the above obligation is such that whereas the said Austin Honeycutt has been duly appointed Administrator of the Estate of S. A. M. Honeycutt, Decd. and he has taken the oath prescribed by law. Now therefore is the said Austin Honeycutt shall faithfully administer said estate and shall do and perform all the acts in and about said estate and shall render a true and correct account to the judge of said court or to his Successors in office or to the legal heirs of said estate when required so to do, then this obligation to be null and void, otherwise to be and remain in full force and affect against the principal and is said securities. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the 12th day of June AD one thousand eight hundred and sixty, in presence of an order of the Honorable the 12th Judicial District Court in and for the parish of Union, La. And to me, William C. Smith, Parish Recorder directed commanding me to make an inventory of the property of the Estate of Susan Ann Mixon Honeycutt, decd. late of this parish. I repaired to the late residence of said Decd. together with James C. Manning and Daniel B. Shultz), John Burnard, Joel Austin, Mary Elizabeth, Ferriby Susan Ann, James Wesley, Emarilla Eliza Permelia, Wm. A. H. Cloy and Ira Britton Honeycutt all her children and issue of the marriage between the said deceased and petitioner and the last sum of which are minors. He further alleges that he is the Natural Tutor of the aforesaid minors to wit: John Bernard, Mary Elizabeth, Ferriby Susan Ann, James Wesley, Emarilla Eliza Permelia, William A. H. Cloy, and Ira Britton Honeycutt. Wherefore he prays that he be appointed and confirmed as Natural Tutor to the said children minor and issue of the marriage aforesaid and that [blank] be appointed Under tutor to the said minors for all orders and decrees necessary in the presence and forgoing relief &c. Of the facts set forth in the foregoing petition has been made before me, it is hereby ordered, adjudged and decreed that Austin Honeycutt be and he hereby is appointed Natural Tutor of the minors John Burnard, Mary Elizabeth, Ferriby Susan Ann, James Wesley, Emarilla Eliza Permelia, William A. H. Cloy, and Ira Britton Honeycutt and upon his taking the oath prescribed by Law that letters of tutorship do issue in his favor accordingly and it is further [unreadable] and it is further ordered that [blank] and he is hereby appointed Under Tutor to the said minors and that letters do issue on his taking the oath prescribed by law.
