The petition of Elisha P. Bolton, a resident of your said Parish of Union, State of Louisiana would respectfully represent that heirs Hopkins Hopkins [sic], Manuel, Mary E. Bolton, daughter of petitioner during the year 1839 as the issue of said marriage. There was the following children to wit: Sallie Virginia, and [unreadable]. Bolton be and is hereby duly and legally appointed Tutor of the minors Sallie Virginia and Augusta G. Hopkins heirs of the Estate of W. L. Hopkins, Decd. and further that Robert J. Tabor be appointed Under tutor to said minors upon complying with the law in such cases made and provided. Done, signed in Chambers this 9th day of October AD 1871. T. B. Weldon who being duly appointed and sworn by me as appraisers proceeded to make said Inventory and Appraisement at my office in the town of Farmerville as presented by Elisha P. Bolton. Tabor has been duly and legally appointed and confirmed as Under Tutor of the following named minor heirs of the Estate of W. L. Hopkins, deceased to wit: Jennie and Guadalupe Hopkins and he has taken the oath prescribed by law. Now therefore the said Robert J. Tabor is hereby duly and legally authorized and empowered to do an perform all the acts appertaining to the said appointment according to law. Tabor, John T. Bolton as his securities are held and firmly bound unto the Honorable T. B. Tompkins, Judge of the Parish Court of Union Parish, La. and unto his successors in office for the just and full sum of one hundred and fifty four dollars to the true and faithfully payment of which well and truly to be made we bind ourselves, our heirs, administrators and legal representatives firmly and in solido by these presents. Dated at Farmerville, La. this 11th day of August 1871. The conditions of the obligation is such that whereas the above bounden Elisha P. Bolton has applied to the aforesaid Parish court for the Tutorship of the minors Virginia and Guadalupe Hopkins, heirs of the Estate of Wm. L. Hopkins, decd. and he has taken the oath required by law. Now therefore if the above bounden Elisha P. Bolton as principal shall faithfully and impartially discharge and perform all and singular the duties incumbent on him as Tutor to the aforesaid minors and shall diligently take after and take care of the interest of said minors and shall when legally required so to do pay over all sums of money and deliver all the property of whatever kind that he may receive belonging to said minors to the proper person or persons belonging to said minors to the proper person or persons to receive the same and shall when legally required so to do render a full and complete account of all his acts and doings in and about said Tutorship. Then and in that case the above obligation to be null and void. Otherwise to be and remain in full force and effect according to law. Hopkins respectfully represents that a certain forty acres lot of land and [unreadable] on inventory as the property of said minors is claimed by W. H. Buce who holds a title to said land older in records than the title of said minor heirs, but that said Buce proposes to compromise with said minors by giving a part of said forty acres and other land to the amount of forty acres in lieu thereof to purchase any claim that said minor may have to said forty acres of land. Wherefore petitioner believing that said bargain and arrangement would be [unreadable] said minors prays that a family meeting be convoked composed of the following named persons to wit: John T. Bolton, W. H. Hamilton, John R. Heard, D. W. Hay and J. A. Heard to consider and advise in reference to this matter and for [unreadable]. E. P. Smith, Recorder and Ex Officio Notary Public in and for the Parish and State aforesaid directed authorizing and command me to convoke a family meeting for the purpose of giving their advise with regard to the interest of the minor heirs of W. L. Hopkins deceased as prayed for in the petition of E. P. Bolton, tutor. I caused to come before me at the office in the Town of Farmerville at 2 o’clock PM the following persons viz. John T. Bolton, W. H. Hamilton, John R. Heard, D. W. Hay and John C. B. White called in place of J. D. Heard who failed to attend being relatives and friends of the minor heirs of w. L. Hopkins deceased who being first duly sworn by me proceeded to give their advice and after mature deliberation. They advise and recommend that the exchange of land as prayed in the petition of E. P. Bolton, tutor be made and it will be to the interest of said minors to make the exchange to wit: William H. The petition of Elisha P. Bolton, Tutor of the minor heirs of Lewis Hopkins, Decd. would respectfully represent that in his capacity as Tutor of said heirs, he has received the property and money as set forth in the amended account total amount of which is twenty three hundred thirty five 50/100 Dollars. He further avers that he has paid for account of said minors the sum of two hundred twenty four 75/100 dollars. Further that the property returned as worthless, lost or [unreadable] in value to the amount of thirty two 13/100 dollars is in his judgment as set forth and that the credit as asked for is just. Wherefore your petitioner prays that Robert J. Tabor, Under Tutor of the minor heirs of Lewis Hopkins, Decd. be fully cited to answer hereto and that contradictory with him there be judgment allowing the credit as set forth amounting to the sum of Two hundred sixty seven 68/100 dollars and that the sum of two thousand seventy seven 42/100 be declared the whole amount due by the Tutor E. P. Bolton to said minors of Lewis Hopkins, decd. homologating the account in all its party and further the Elisha P. Bolton, Tutor as aforesaid be ordered to give bond conditional according to law for said sum due as above and upon so doing that his bond as Tutor aforesaid minor force be cancelled and [unreadable]. Petitioner further prays for general relief &c. Barrett & Trimble, Attys. In the matter of the tutorship of the minors of Lewis Hopkins, Decd. Parish Court Union Parish, Louisiana Robert J. Tabor, Under Tutor of the minor heirs of Lewis Hopkins, decd. for answer admits all and singular the allegations contained in petition of e. P. Bolton, Tutor of said heirs and [unreadable] the prayer of said petitioner. R. J. Tabor Under Tutor Minors of Lewis Hopkins, Decd. Parish Court Union Parish State of Louisiana In the matter of the Tutorship of the minor heirs of L. H. Hopkins, Decd. By reason of the fact that the account of E. P. Bolton’s approved [unreadable] Under tutor of said minors was hereby ordered, adjudged, and decreed that the said foregoing account of the tutor be approved and homologated in all its parts that the amount of two thousand seventy seven and 92/100 dollars be declared as the balance due by said Tutor and on his given new bond to cover that sum, that his old bond be canceled. Lewis, Judge of the Parish Court in and for Union Parish, La. and unto his successors in office in the just and full sum of two thousand six hundred dollars to the true and faithful payment of which we bind ourselves, our heirs, administrators and legal representatives firmly and insolido by these presents dated at Farmerville, La. this 31st day of January AD 1872. The condition of this obligation is such that whereas the above bounden E. P. Bolton has been recommended to the appointment of Tutor to the minors Jennie and Guadeloupe Hopkins and has taken oath prescribed by law. Now therefore if the above bounden E. P. Bolton shall faithfully and impartially discharge all the duties incumbent on him as Tutor to the said minors and render to the Judge of the Parish Court of Union Parish, La. a full and complete and correct account of all his acts in and about said minors and pay or cause to be paid to the proper person or persons to receive the same all monies and deliver all the property belonging to the said minors to the proper persons to receive the same. To the Honorable the Judge of the [unreadable] to Court of Union Parish, State of Louisiana. The petition of Mrs. Julia A. Hopkins of [unreadable] wife and of her husband James T. Wade [NOTE: the next 7 lines are unreadable] of Union Parish of said [unreadable] L. Willis Hopkins who resides in Morehouse Parish, La. respectfully shows that Malinda A. Hopkins, heir of Petitioners is the surviving widow and was partner in community with her late husband William Hopkins, decd. who departed this life intestate about January 1871 at his residence in Union Parish, La. leaving an Estate in said Parish, that the rest of your petitioners are the children and heirs of said descendant except J. T. Wade the husband of one and N. O. Covington the husband of another of petitioners. That Lewis W. Hopkins Decd. but represented by his two minor children, Sallie Virginia and Augusta Guadalupe Hopkins was the brother of Petitioners and also aforesaid heir of said deceased. That Wm. Hopkins, decd. was the legally appointed Tutor of said two minors and that at the time of his decease, he had in his possession as Tutor, property of the said minors as set forth in a schedule filed herewith and marked “A” amounting at this date to two thousand and sixty six 46/100 dollars according to Inventory caused by himself as Tutor. That Elisha P. Bolton is now the legally appointed tutor of said minors. That the aforesaid property of said minors is entirely separate and distinct from the succession of Decd. That said succession is not involved or in debt except for this one claim of the said minors and that any administration thereof is unnecessary. That petitioners are anxious. That the said Estate of Wm. Hopkins, decd. should be partitioned among the heirs. [NOTE: most of next two pages are unreadable. Hopkins, Decd. be heard and ordered among the aforesaid heirs. That an Inventory of said Estate be ordered properly to said partition and that a sale of all of the effects of said estate be made to effect said partition. That the sheriff of the Parish of Union be ordered to make said sale and for all further orders and decrees necessary in the premises and for general relief &c. Jno. L. Barrett Atty. for Pltfs. L. W. Bolton, Tutor By reason of the law and evidence in this case being in favor of plaintiffs by further reason of the answers of [unreadable] partition of the succession of Wm.
