The petition of Joseph R. Goyne as resident of said parish and State respectfully represents unto your honor that Thomas J. Howell, late a resident of said Parish, departed this life at his residence on or about the 22nd day of may AD 1860 leaving a widow and a number of children and also a considerable Estate consisting of Land, Stock and other personal property also leaving unsettled debts due. Petitioner represents that he is one of the greatest creditors of said Estate that no other person has applied for the administration or taken any steps to have the same settled. He therefore prays that an Inventory appraisement may be had according to law that after legal delays and proceedings he may be appointed Administrator of said Estate & for such orders and decrees in the premises as shall be necessary. Goyne to be appointed Admr. of the Estate of Thos. J. Howell, Decd. be advertised according to law. It is further ordered that Wm. C. Smith, Parish Recorder &C in & for said Parish & State be & he is authorized to make an Inventory and appraisement of the property belonging to the said Estate of Thos. J. It is therefore ordered and decreed that Joseph R. Goyne be and he is appointed administrator of the Estate of Thomas J. Howell, Deceased, late of this parish for the purpose of making an inventory and appraisement of al the property both real and personal belonging to the Estate of the said Thomas J. Howell, Decd. Whereas David Henderson & David M. Jamison citizens of said parish being duly appointed and sworn by me the said Recorder as appraisers, I proceeded to make the following Inventory and appraisement to wit: A tract of land the late residence of the Deceased viz. the E ½ of the NE ¼ of Section five in township Twenty Two N of R 2 West containing 80 Acres more or less with improvements thereon Mill &C appraised @ $400.00 Amount Brought forward $400.00 An the NW ¼ of NE ¼ and a fraction of five acres more or less off of the North East of the SW ¼ of NE quarter of Section Five Township 22 Range Two West containing 124 Acres more or less appraised @ $ [blank] per acres $240.00 One Yoke of Oxen appraised @ 75.00 9 head cattle more or less, apprd. @ $5 per head 45.00 20 head hogs more or less, apprd. @ $2 per head 40.00 1 Large Waggon & chain apprd. @ 25.00 1 Rifle gun & shot punch apprd. @ 5.00 1 Grind stone apprd. @ 3.00 1 Steel Mill apprd. @ 1.00 1 Lot of farming Utensils apprd. @ 10.00 1 Plains Jack Smoother & Match plains, apprd. @ 5.00 1 Tape measure apprd. @ .75 800 feet of Lumber more or less, apprd. @ $1.50 per ft. ___12.00 Total amount $861.75 Having completed the foregoing Inventory and appraisement, I have on this the 25th day of July closed the same. Goyne as principal and David Henderson as his Security are held and firmly bound unto Robert W. Richardson, Judge of the 12th Judicial District Court in and for Union Parish, State of Louisiana or to his successors in office in the sum of One Thousand and Seventy Seven Dollars to the true and faithful payment we bind ourselves, our heirs, assigns and legal representatives firmly by these presents. Dated Farmerville, La, July 28th AD 1860. The condition of the above obligation is such that whereas the said Joseph R. Goyne has been duly and legally appointed Administrator of the Estate of Thomas J. Howell decd. and he has taken the oath prescribed by Law. Now therefore if the said Joseph R. Goyne shall faithfully administer said Estate and shall do and perform all the acts in and about said Estate and shall render a true and correct account to the Judge of said court or to his successors in office or to the legal heirs of said Estate when required legally so to do. Then this obligation to be null and void otherwise to be and remain in full force and effect against the principal and his said securities. J. Howell, decd. and he has given bond and good security and has taken the oath prescribed by Law. Now therefore the said Joseph R. Goyne is hereby duly and legally authorized and empowered to do and perform all acts appertaining to said appointment according to Law. Goyne, a resident of said parish, administrator of the Estate of T. J. Howell, Decd. appointed by your Hon. Court, respectfully represents that there are debts against said Estate amounting to more than the inventory and that it is necessary that all the property of the same both real and personal should be sold for the purpose of paying the same. He believes that it would be to the interest of the said Estate that the property should be sold on a credit of twelve months for all sums over ten Dollars. He therefore prays for an order from your Hon. Court ordering the sale of all the said property on a credit of twelve months for all sums over ten dollars. All sums under ten dollars cash and for such other orders & decrees as the case may require. H. Rebenburg, Atty. State of Louisiana 12th Judl. Disct. Court Parish of Union The premises being duly considered, it is ordered and decreed that all the property belonging to the Estate of Thomas J. Howell decd. be sold to pay the debts of said estate on a credit of twelve months for all sums over ten dollars. All sums under Ten dollars Cash. It is further ordered that Joseph R. The consideration having been complied with by the purchasers, the property was adjudicated to each of them respectively on the day and date above written. Joseph R. Goyne, Admr. Be it remembered that on this 4th day of August AD 1866, Joseph R. Goyne Administrator of the Estate of Thomas J. Howell, deceased in pursuance to an order of the Honorable the 11th District Court in and for the Parish of Union and after having first advertised the same for more than thirty days in the Union Record, a weekly paper published in said Parish proceeded to offer for sale at public auction and did sell according to Law the following property of said estate. 1st One tract of land the residential tract described as the E ½ of NE ¼ of section 5 Township 22 R 2 West was bid off by David Henderson at $1.32 per acre amounting to one hundred and five and 62/100 dollars $105.62 2nd One tract of land containing 80 acres more or less described as the West half of the North West quarter of Sec. 4 township 22 Range 2 W was bid off by Mrs. Jennie Howell, widow of the deceased, at $.25 cents per acre amounting to twenty dollars 20.00 The purchasers having complied with the terms of sale by paying in cash the same bid by them the said land was adjudicated and is hereby granted, bargained and sold to them respectively. Joseph R. Goyne, Admr. To the Honorable the judge of the eleventh Judicial District Court in and for the Parish of Union, Louisiana, James R. Goyne Admr. of the Estate of T. J. Howell, decd. herewith respectfully files an account of his acts and doings as Administrator as aforesaid as follows: 1st He charges himself with the amount of the sale of property as per pro verbal on file $591.16 He prays credits as follows: Voucher No. 1 T. Fees 30.00 Administrator’s Commission ___14.77 $362.16 The amount of the said privileged debts deducted from the sum of $591.16 leaves the sum of $229.00 to be paid on the privileged debts due the widow and leaving nothing to be paid on the lower privilege and ordinary debts. Petitioner prays that this account may be advertised according to law and after due proceedings that it be homologated and allowed in all its parts that he be discharged and his bond canceled. H. Regenburg, Atty. State of Louisiana 11th Judicial District Court Parish of Union Let the prayer of the petitioner be granted and it is hereby ordered that the within final account of Joseph R. Reid, Clerk State of Louisiana 11th Judicial District Court Parish of Union In the matter of the Homologation of the final account filed by Joseph R. Goyne as Administrator of the Estate of T. J. Howell, Decd. 1st Vouchers filed with said account. 2nd J. W. Reid, sworn, says that he was the acting clerk of the District court in January last and that said final account was filed January 17th 1867 and has been advertised for more than thirty days prior to this date by publication in the Town of Farmerville and by posting at the door of the Court House in said Parish and State and that no opposition has been filed to the Homologation of the same.
